Abstract

The present study investigates the consequences of supervisory law on the regional regulations with local characteristics. The study is normative with regards to the commandment and conceptual approaches. The consequences of supervisory law on the regional regulations with local characteristics, according to Article Number 251 verse 1 and 2, are dismissed (‘vernietigbaar’). ‘Vernietigbaar’ is ‘ex nunc’ that means ‘since the moment’. As a consequence of the law, the dismissal of regional regulations is valid until it is issued by the regional government. Due to the existing supervisory law performed by the Supreme Court, the judge declares the regional regulations ‘invalid’ since they are lack of powerful relevant laws. The Regional Government took a legal action on the issue of dismissed regional regulations by submitting an objection to the Supreme Court.

Abstract

AbstrakUpaya pemajuan, perlindungan, penghormatan, dan pemenuhan terhadap HAM mendapat perhatian penting oleh Komnas HAM saat penyusunan SNP tentang Pembela HAM. Masalah penulisan adalah bagaimana urgensi pengaturan pembela HAM yang berasal dari masyarakat adat di bidang lingkungan hidup dalam peraturan perundang-undangan. Keberadaan Pembela HAM dibutuhkan dengan mendesak dalam perlindungan, pemajuan, penghormatan, dan pemenuhan HAM, karena Pembela HAM di bidang lingkungan hidup, khususnya yang berasal dari masyarakat adat, juga memiliki peran yang sangat signifikan dan berkontribusi nyata dalam memajukan dan melindungi HAM, pada skala lokal, daerah, nasional bahkan internasional. Penelitian ini adalah penelitian normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual.  Hasil penelitian menunjukan bahwa keberadaan masyarakat adat sebagai Pembela HAM, berpengaruh terhadap penyelamatan lingkungan dari kerusakan dan pengalihfungsian yang berakibat pada hilangnya hak masyarakat adat atas tanah, hutan dan kepemilikan atas wilayah laur. Pengkajian ini untuk menganalisa urgensi pengaturan pembela HAM khusunya yang berasal dari masyarakat adat di bidang lingkungan hidup dalam peraturan perundang-undangan.Kata Kunci: pembela HAM lingkungan; masyarakat adat AbstractEfforts to promote, protect, respect, and fulfill human rights receive important attention by Komnas HAM when compiling the SNP on Human Rights Defenders. The problem of writing is how urgency to regulate human rights defenders from indigenous peoples in the environmental field in the legislation. The existence of human rights defenders is very urgent in promoting, protecting, respecting, and fulfilling human rights, because human rights defenders in the environmental field, especially those from indigenous peoples, also have a very significant role and contribute significantly in promoting and protecting human rights, on a local scale, regional, national and even international. This research is normative research with a statute approach and conceptual approach. The results of the study indicate that the existence of indigenous peoples as human rights defenders has an effect on saving the environment from damage and conversion which results in the loss of indigenous peoples' rights to land, forests and ownership of sea areas. This study is to analyze the urgency of regulating human rights defenders, especially those from indigenous peoples in the environmental field, in laws and regulations.Keywords: environmental human rights defenders; indigenous people

Abstract

Discretion by the village head of Kokwari which was reported by the community to the Inspectorate Board of Southwest Maluku Regency as a form of alleged corruption in the case of misuse of village funds. This research is a normative juridical research, and then examines and knows the answers to this problem through a concept approach, statutory approach and case approach, then from the results of the description conclusions and suggestions can be drawn. The results of this research and analysis of the problem use the concept of the Pancasila legal state and the concept of binding legal force, which are the initial framework for thinking about binding legal force. The results showed that the Recommendations of the Inspectorate of Southwest Maluku Regency regarding the return of state financial losses by the Kokwari Village Head have binding legal force, which lies in various normative provisions in a hierarchical manner so that they can guarantee and assess the quality or quality of each implementation of the work carried out by the Village Government on the management The Village Fund Budget is within the scope of the Regional Government of Southwest Maluku Regency, for this reason the Inspectorate Board of Southwest Maluku Regency issued a recommendation regarding the return of state financial losses by the Kokwari Village Head, of course, administrative legal consequences in terms of accountability that with the completion of the return of state financial losses carried out by the Kokwari Village Head cannot be prosecuted for criminal responsibility under Article 4 of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning the Eradication of Corruption Crimes.

Abstract

Formation regulation must meet the indicator does not contradict the legislation ofhigher and not contrary to public interest. If both indicators are not met in the establishmentof a law, then in the evaluation by the Government, there apabil established law contrary tothe legislation of higher and contrary to public interest, the Government may cancel a legalproduct. Indicators of general interest in the cancellation law is vague norm, because thisindicator is to open a space for the Government to make the interpretation of the meaning ofpublic interest norms. Very complex public interest, public interest is not always to beunderstood as a national interest, regional interest may also be the public interest because itincludes all interests in the communal areas. Interest means the area of interest to allindividuals in the region as a whole.

Abstract

Based annulment nomenclature that used in Article 251 paragraph (1) and paragraph (2) may be canceled under vernietigbaar category. Vernietigbaar or ex nunc, means that the annulment is effective at that immidiate time. The legal consequences of cancellation pursuant to Article 251 paragraph (1) and paragraph (2) are considered to exist until there is a revocation by the Local Government. This is in accordance with the principle and the principle praesumptio iustae causa and contrarius actus. the changes to the legislation in the field of local government is very important. Additions are required in relation to the establishment of the Local Regulation, as mandated in Article 18B paragraph (1) NRI Constitution of 1945, and Act No. 23 of 2014. The Act No. 23 of 2014 does not specify clearly the procedures for the supervision and control parameters of the Local Regulation.
