Abstract

This paper aimed to elaborate the participation of Adat Law Community in Public-Private Partnership (PPP) to introduce new approach to replace compensation to more participative and collaborative scheme of infrastructure development in PPP. This article uses the normative legal research with the conceptual, statute, and case approach. This research show that releasing the land used for infrastructure development procurement will abolish the identity of the community. It have shown that failure in recognizing Adat Law Community as rightful party over their land neglects their right to entitle compensation. Furthermore, instead of economically compensating ulayat land of Adat Law Community used for infrastructure development, Adat Law Community’s participation shall be involved in infrastructure development on their land. The active participation of Adat Law Community can be exercised through placing the community as public entity in PPP. For comparison in China, the State does not pay according to market prices to farmers. However, it provides a compensation package that includes employment opportunities for farmers, housing compensation, compensation for crop loss, and / or granting a residence permit in urban areas. This make them eligible for their social welfare such as health insurance, pensions and / or retirement plans, access to high-quality schools and subsidized agricultural goods that were not previously available to farmers

Abstract

AbstractAfter the amendment of the 1945 Constitution, a phenomenon of distinct and special autonomy surfaced,  based on Article 18B the 1945 Constitution. This study will determine how the values of Pancasila are manifested to the norm of law that regulates special autonomy, such as Law Number 21 of 2001 regarding Special Autonomy for Papua Province. From this research, it is concluded that values of Pancasila has not be manifested perfectly in Law Number 21 of 2001 because the political situation in the formulation of this law was pragmatic, where the understanding of special autonomy was not based on deliberation among options of values in line with the nation’s ideology, but it was only a tool to solve immediate state problem. However, Law Number 21 of 2001 regarding Special Autonomy for Papua Province has reflected nationalism principle, a principle to maintain Unitary State Republic of Indonesia. IntisariPasca amandemen UUD 1945, muncul fenomena otonomi khusus yang didasarkan pada Pasal 18B UUD  1945. Penelitian ini membahas bagaimana nilai-nilai Pancasila dimanifestasikan dalam undang-undang yang mengatur tentang otonomi khusus, yaitu UU Nomor 21 Tahun 2001 tentang Otonomi Khusus Bagi Provinsi Papua. Dari penelitian ini disimpulkan bahwa nilai-Nilai Pancasila belum termanifestasikan secara sempurna ke dalam dalam UU Nomor 21 Tahun 2001 karena undang-undang tersebut disusun dalam suasana politik hukum yang pragmatis, sehingga pemaknaan otonomi khusus bukan didasarkanpada musyawarah yang melibatkan pilihan-pilihan nilai yang selaras dengan ideologi bangsa, namun hanya merupakan suatu tambal sulam untuk menyelesaikan masalah kenegaraan yang mendesak. Namun bagaimanapun, UU Nomor 21 Tahun 2001 tentang Otonomi Khusus Bagi Provinsi Papua bagaimanapun telah mencerminkan asas kebangsaan, yaitu asas yang tetap menjaga prinsip NKRI.

Abstract

AbstractThis research discusses on men’s position in the law culture of DIY sultanate. The questions posed are (1)  How is the value system in DIY sultanate as a source of Paugeran determination? (2) How is the position of men in the DIY sultanate law culture? (3) How does the Paugeran respond to current development? The research shows that (1) the value system is heavily influenced by Islamic law, thus making a king caliph for the people; (2) Men’s position in said sultanate is depicted through Law number 13 of 2012, in which a Sultan is deemed to be both the leader of region and head of province, and traditionally Sultans are men; (3) Paugeran’s response to current development is an effort to rationalize sultanate traditions to be in line with modern values.IntisariPenelitian ini membahas tentang kedudukan laki-laki dalam budaya hukum kesultanan DIY. Rumusan  masalah yang dikemukakan adalah (1) Bagaimana sistem nilai dalam Kasultanan DIY sebagai sumber penyusunan Paugeran? (2) Bagaimana kedudukan laki-laki dalam budaya hukum Kasultanan DIY? (3) Bagaimana Paugeran merespon perkembangan zaman? Kesimpulan dari penelitian ini adalah (1) sistem nilai dalam Kasultanan DIY sangat erat kaitannya dengan Islam di konsep kekuasaan, kedudukan dan fungsi raja dalam perspektif ajaran Islam, yaitu sebagai khalifah; (2) Kedudukan laki-laki dalam budaya hukum dilihat dari Undang-Undang Nomor 13 Tahun 2012 tentang Keistimewaan DIY dan sejarah kepemimpinan Kasultanan DIY, yang telah mengakomodasi dwifungsi Sultan sebagai kepala daerah di tingkat provinsi, pemegang kekuasaan tertinggi di kerajaan yang bertugas untuk memelihara dan melestarikan tradisi. Berdasarkan sejarah kepemimpinan Kasultanan DIY, secara turun-termurun Sultan adalah laki-laki; (3) Respon Paugeran terhadap perkembangan zaman merupakan upaya untuk merasionalisasi nilai-nilai luhur budaya Kasultanan Daerah Istimewa Yogyakarta sesuai dengan nilai-nilai modernitas.

Abstract

The purpose of this research is to analyze the control of Sriwijaya and Majapahit Kingdom towards their maritime territory and to learn whether their control may be practiced in the regulatory on the maritime territory of Unitary State Republic of Indonesia today. It is a legal normative research which has descriptive and analytical nature. The control of Sriwijaya and Majapahit Kingdom towards their maritime territory was conducted through adat law. Maritime territory of Indonesia today is controlled by the written law created by the government and the unwritten law practiced by the people.
