Abstract

Hadith is not only as the second source of Islamic law after al-Qur’an, but also as the model in organizing human life in both social and spiritual practice. However, the hadith historiography mentions that there is some Muslim communities that doubt the function and legality of those second source of Islamic law. One case that is still debated according to them is the hadith qualification about talqin stated in Sunan Abu Dawud book no. Index 2710. This study is library research that aims at researching and explaining the qualification of sanad and matan of hadith talqin mayit stated in Sunan Abu Dawud book, and how is the hujjah of the hadith, and what is the meaning of talqin word in those hadith. The research finding shows that based on sanad side the hadith is ahad hadith having shahih level. Since all critics value thiqoh in all linking (riwayah,) and there is no shudud and ’illat on it. Furthermore, from matan side, the hadith is also shahih since it has been fulfilled the shahih (validity) norms. Keywords: talqin, hadith qualification, matan, ṣahīh

Abstract

Abstract: Islamic Family Law (Ahwal Syakhsiyah) is a set of rules and procedures in the household ranging from pre-marriage, the implementation of marriage to the usual things that occur after marriage. Plus the chapter endowments, wills, grants and inheritance. This paper will explain the sketch and the existence of Islamic Family Law (IPR) in Contemporary Arabic literature. This finds the value of urgency considering that Islamic Family Law in the contemporary period has become an independent and separate study from other fiqh studies although basically Islamic Family Law is part of Jurisprudence. The creativity shown by the mujtahid and the next generation of Islamic thinkers through the means of ijtihad manifests the flexibility of Islamic law, especially IPR and can keep it away from the threat of stagnation which results in Islamic law being like a fossil because it is unable to match the times.

Abstract

Hadith selain sebagai sumber hukum Islam kedua setelah al-Qur’an juga sebagai model dalam menata kehidupan umat manusia, baik dalam ranah sosiologis maupun dalam praktek spiritual. Namun demikian, historiografi hadith menyebutkan bahwa masih ada sebagian masyarakat muslim meragukan fungsi dan legalitas sumber hukum kedua tersebut. Salah satu di antara yang yang masih diperdebatkan menurut mereka adalah kualifikasi hadith tentang talqin yang termaktub dalam kitab Sunan Abu Dawud dengan nomor indeks 2710. Tulisan ini merupakan penelitian kepustakaan (Library Research) yang bertujuan untuk meneliti dan menguraikan kualifikasi sanad dan matan hadith talqin mayit yang termaktub dalam kitab Sunan Abu Dawud, dan bagaimana kehujjahan hadith tersebut serta bagaimana maksud kata talqin dalam hadith tersebut. Hasil penelitian menunjukkan bahwa hadith tersebut jika ditinjau dari sisi sanad merupakan hadith ahad yang memiliki derajat ṣaḥīh karena semua kritikus menilai thīqoh pada semua periwayatnya dan tidak ada shudhud dan ‘illat padanya. Sedangka ditinjau dari sisi matan, hadith tersebut juga bersifat ṣahīh karena sudah terpenuinya kaidah-kaidah keshahihan matan.

Abstract

The study of raḍā‘ah (breastfeeding) occupies an important position in Islamic Family Law because it has implications for the establishment of maḥram relationships and marriage prohibitions. Although Islamic scholars generally agree that raḍā‘ah can produce legal consequences equivalent to those arising from blood kinship (nasab), differences of opinion remain regarding the criteria and limitations of breastfeeding that establish maḥram status. These differences have generated academic discourse concerning the relevance and application of raḍā‘ah law in contemporary society. This study aims to comparatively analyze the concept of raḍā‘ah according to Imam al-Nawawi and Sayyid Sabiq and to examine its implications for Islamic Family Law. This research employs a normative legal method with comparative and conceptual approaches. The data were obtained through library research on relevant primary and secondary sources and analyzed using a descriptive-analytical method. The findings reveal that both scholars agree that raḍā‘ah gives rise to a maḥram relationship that results in a prohibition of marriage. However, Imam al-Nawawi requires five separate breastfeeding sessions to establish such a relationship, whereas Sayyid Sabiq emphasizes breastfeeding that significantly contributes to a child’s growth without strictly limiting the number of feedings. These differences reflect variations in their methods of legal reasoning (istinbāṭ), although both ultimately pursue the same objectives of Islamic law: the preservation of lineage (ḥifẓ al-nasl), the protection of family honor, and the welfare of children.
