Abstract

Ray Bachtian Rangkuti (* Nurmalawaty (** Mohammad Ekaputra (*** Hukum positif di Indonesia tidak memandang semua hubungan kelamin diluar perkawinan sebagai zina (overspel). Perbuatan zina menurut KUHP hanya meliputi mereka yang melakukan persetubuhan atas dasar suka sama suka tanpa ada unsur paksaan, kekerasan dan ancaman kekerasan, KUHP juga memandang ada suatu perbuatan yang melakukan persetubuhan dengan daya paksa, kekerasan, atau ancaman kekerasan, yaitu delik pemerkosaan, Tindak pidana pemerkosaan ironisnya tidak hanya berlangsung di lingkungan luar atau tempat-tempat tertentu yang memberikan peluang manusia berlainan jenis dapat berkomunikasi, namun juga dapat terjadi di lingkungan sekitar yang seharusnya menjadi tempat memperoleh perlindungan. Pada hakikatnya korban tidak dapat melindungi diri sendiri dari berbagai macam tindakan yang menimbulkan kerugian mental, fisik, sosial dalam berbagai bidang kehidupan dan penghidupan. Kejahatan seksual sekarang ini merebak dengan segala bentuk. Khususnya pada kasus pemerkosaan, pelaku tidak mengenal lagi status, pangkat, pendidikan, jasmani, dan usia korban. Bahkan banyak juga yang tega memperkosa orang yang dalam keadaan tidak berdaya, baik secara fisik maupun mental. Semua ini dilakukan apabila mereka merasa terpuaskan hawa nafsunya. Demikian juga usia pelaku yang tidak mengenal batas usia. Pada penulisan skripsi ini, penulis menggunakan metode penelitian hukum normative melalui studi pustaka (Library search). Sumber hukum dalam penulisan skripsi ini adalah bahan hukum primer, yaitu Undang-undang, bahan hukum sekunder yaitu buku yang relevan dan putusan pengadilan, serta bahan hukum sekunder yang bersumber dari artikel, majalah, internet, dan lain-lain. Hasil penelitian ini menunjukkan bahwasanya pelaku pemerkosaan dapat dikenakan pasal 285 KUHP, tetapi jika korban adalah orang yang tidak berdaya maka dikenakan pasal 286 KUHP, ditambah lagi jika perbuatan tersebut dilakukan secara berkesinambungan, maka akan ditambah pemberatan atas perbuatan pidana tersebut. Maka dari itu peran pengadilan terutama hakim sangat menentukan dalam proses penegakkan keadilan, hakim dituntut bijaksana, adil dan jeli dalam menjatuhkan pidana bukan hanya melihat dari sisi pelaku tapi juga dari sisi korban.

Abstract

AbstractLaw No. 2 of 2004 was enacted to organize the mechanism of the settlement by involving the government (executive) through mediation and litigation. However, a number of complaints may have indicated some weakness in that mechanism. The objective was to identify the substance of Law No. 2 of 2004, which needs to be improved by formulating the ideal model. The data is consisted of primary and secondary data, which are gathered by using questionnaires to the industrial community in Medan and Deli Serdang Regency. The result showed that quick, accurate, fair, and inexpensive principles have not been implemented yet. Therefore, it is necessary to reorganize the mechanism of settling labor relations disputes.    IntisariUndang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisishan Hubungan Industrial ditetapkan untuk mengatur mekanisme penyelesaian yang melibatkan pemerintah (exekutif) melalui mediasi dan litigasi. Namun, sejumlah keluhan dapat menunjukkan kelemahan dalam mekanisme tersebut. Tujuannya adalah untuk mengetahui isi dari Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisishan Hubungan Industrial, yang butuh untuk dikembangkan dengan merancang model ideal. Data terdiri dari data primer dan sekunder, yang dikumpulkan menggunakan kuisioner untuk komunitas industri di Medan dan Kabupaten Deli Serdang. Hasil menunjukkan bahwa prinsip cepat, akurat, adil, dan murah belum diimplementasikan. Maka, sangat diperlukan untuk mengatur ulang mekanisme penyelesaian sengketa hubungan kerja.

Abstract

Corruption case No. 10/Pid.Sus-TPK/2021/PN Bna, this case is quite interesting because it itself explains how a tendering process for the procurement of goods/services by the government which turns out to have many irregularities and conspiracies in it which actually also aims to benefit and enrich oneself by harming the state's finances. The research methods used in this study are normative with analytical descriptive properties, the approach used is normative and case approaches, data sources used are secondary data, techniques and data collection tools for literature studies, qualitative data analysis with deductive and inductive conclusions drawn. The results of the study stated that the Regulation regarding the procurement of goods and services according to Presidential Regulation Number 12 of 2021 concerning the Procurement of Government Goods and Services provides guidelines for the Regulation, to the procedures for the Procurement of Government Goods and Services that are Simple, Clear, and Comprehensive in accordance with good governance. It is carried out in 3 stages, namely: Unlawful acts in the procurement of goods and services can be subject to criminal sanctions are acts that abuse authority and arbitrariness. Abuse of authority and arbitrariness is basically a teaching of state administrative law, in the law on the eradication of corruption (PTPK Law), namely Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 explains the abuse of authority, namely in the provisions of article 3. Consideration of the Panel of Judges on Unlawful Acts that resulted in Criminal Offense in case no. 10/Pid.Sus-TPK/2021/PN Bna That the defendant was the head of the Simeuelue Regency PUPR office and as a budget user in road and bridge maintenance activities at the Simeulue Regency PUPR office in 2017.
