Abstract

forced sell on margin trading financing is securities selling which done forcefully with or without announcement or investor’s approval. Some cases related to this force selling considered as a violation of investor’s rights. This research purposed to knowing whether force selling on margin trading financing by securities fulfilled by the investor legal protection and how is the investor legal protection ideal concept in force selling. This research was using statute approach and conseptual approach. Based on the result of the research, force selling as written on the Bapepam-LK Rule Number V.D.6 has been appropriated by the Indonesian Civil Code but this rule against investor legal protection as ruled on The Capital Market Law and The consumer Protection Law. The investor legal protection concept consists of preventive protection and repressive protection.Key Words: Capital Market, Margin Trading Financing, Force Selling, Securities, Investor

Abstract

AbstractThis article purposed to describing the black campaign through social networks as a cybercrime and defamation as ruled in the Penal Code and Law of Information and Electronic Transaction. As the technology going bloom, the black campaign on president-vice president election by using social network practically done nowadays. How this black campaign by using social network seen as a cybercrime and defamation on The Penal Code and Law of Information and Electronic Transaction. This research used normative method with statutes approach. The black campaign is one of the cybercrime which using illegal contents. The black campaign as a defamation delict is a crime that insulting victim’s pride and feeling by using Ethnicity, Religion, Race and Social Groups issues to other candidates and mean it to be publicy. Keywords: Black Campaign, Cybercrime, Defamation, President-Vice president ElectionAbstrakArtikel ini bertujuan untuk mendeskripsikan kampanye hitam di jejaring sosial sebagai sebuah kejahatan mayantara dan pencemaran nama baik sebagaimana diatur dalam KUHP dan UU ITE. Seiring perkembangan teknologi, kampanye pilpres memunculkan praktik kampanye hitam di jejaring sosial. Bagaimanakah kampanye hitam dalam pilpres di jejaring sosial dilihat sebagai suatu kejahatan mayantara dan pencemaran nama baik dalam KUHP dan UU ITE. Metode yang digunakan adalah normatif dengan pendekatan perundang-undangan. Kampanye hitam merupakan salah satu kejahatan mayantara yang menggunakan illegal contents sebagai modus operandinya. Kampanye hitam sebagai sebuah tindak pidana pencemaran nama baik adalah tindak pidana yang menghina kehormatan, harga diri dan perasaan dengan menggunakan isu-isu Suku, Agama, Ras dan Antar golongan (SARA) terhadap kandidat lain dan memaksudkan penghinaan ini untuk diketahui umum.Kata Kunci: Kampanye Hitam, Kejahatan Mayantara, Pencemaran Nama Baik, Pemilihan Umum Presiden dan Wakil Presiden
