Abstract

The development of Legal Science in Indonesia has disappointed the society, since the products of law give no good benefit impact even make more difficulties without any problem solving as the main point of the products. It seems that Legal Science in Indonesia is stuck between Continental and Anglo Legal Systems. Science Philosophy is the right tool to give the basic and direction to the development of legal Science in Indonesia, because the aspects of Science Philosophy, as Knower, Knowing, and Knowledge, will lead the Legal Science in Indonesia developed in the right track. The Legal Science in Indonesia should be based on the religious, humanity, united in diversity, democracy, and social justice, as the basic philosophy of Indonesian nation.

Abstract

Labor Law in Indonesia is one of specific law that has a main goal to protect the workers in front of entrepreneur’s power. This article uses normative method in analyzing the interrelation of Constitutional State, Democracy, and Administrative Law, in Labor Law aspect, especially on the government intervention to the worker and entrepreneur relationship. Based on a democratic and constitutional state, the government shall protect and respect human rights of citizen by using juridical instruments. Thus, in fulfilling his duties in labor aspect, the government has a responsibility in order to reach a social justice between the parties in working relationship. Also, the government has a responsibility to interfere the working relationship between parties by some limitations and regulations of the Indonesian Democratic and Constitutional State based on Pancasila.

Abstract

The article 52 verse (3), the Teacher and Lecturer's Act Number 14 Year 2005, says that a lecturer who works ina private Institution isgiven a payment base dont he work agreement or collective labor agreement. It shows that the private lecturer's payment will beregulated basically on the two party's agreement, the lecturerandthe private institution. Although thereare some provisions that regulate about the payment'details from the Act, some questions will come up In the legal protection to the private lecturer in getting good payment, for example "howisthe payment regulation based on the work agreement?", "howisthe protection to the private lecturer's payment?"

Abstract

There is a govemment's intervention in the Labour Dispute Resolution Law, called Veto, that is belong to the Minister of The Employment and Transmigration. The Veto influences the parties'right to have a just decision in their labour dispute resolution process because it can be made by the Minister's will. The Veto should be diminished or even wiped out from the process because it only gives a political decision that influence the juridical decision of the Central Institution (Panitia Penyelesaian Perselisihan Perburuhan Pusat/Panitia Pusat.

Abstract

Dilematisme tentang pekerja wanita di sektor informal masih terus bergulir. Kekosongan hukum dalam masalah ini ternyata sangat mendukung semua upaya yang dilakukan pihak-pihak tertentu untuk semakin menyudutkan mereka. Meski faktor yuridis bukan satu-satunya penyebab ketersudutan pekerja wanita di sektor ini namun, sangat mendesak kiranya untuk segera diberikanperlindungan yuridis yang lebih riil kepada mereka.

The Industrial Relationship Dispute Resolution Law Number2 Year 2004, has a bolished the existence of The Labor Dispute Committee and replaced by the  Industrial Relation ship Court. The existence of the Industrial Relation ship Court can influence the relation ships here between worker and employer in the future and subtractthe government intervention in labordispute resolution. Although the Court is notexistyet until 2006, but the resolution process will be questioned whether it will give more effectiveness for theboth parties, the worker and the employer, or make more difficulties

Abstract

The Indonesian Labour Dispute Resolution Law: No.22, 1957,-has provided two kinds of mechanism, namely compulsoly arbtration and voluntary arbitration. Both of them are non-litigation dispute resolutions, but, in tact, the voluntary arbitration is rarely used by the partiesto settle their labour dispute. The voluntary arbitration (arbitration) givesless steps on its mechanism and it-has more benefits for the parties, especially on its confidental process. The arbitration-process will fit as the altemative labour dispute resolution, in-Indonesia in the Globalization Era.

Abstract

The freedom of lndoriesian Judges in making decision is still asked at this moment. Judge has the duty to maintain justice. He has to have the freedom to do his duty. Yet, the Indonesian Judge is facing  some internal and external problems. In thelegal reasoning of Pragmatis Realism believes that the Judicial decision-making is a creative activity, so it needed a qualified thinking from the judge that can be supported by the high technology.Judge is not only ascertain and apply the law also must be makers of law. The legal reasoning of Pragmat is Realismis been hoping to make a good solution thatis related to the freedom of Indonesian Judge.
