Abstract

There is a legal disharmony with the Sharia Banking Law in the regulation on alternative dispute resolution institutions. This problem arises because the regulation does not pay attention to sharia principles, as mandated by Article 55, Paragraph 3 of the Sharia Banking Law. Meanwhile, the application of sharia principles is a spiritual right of consumers which also requires legal protection. This research is intended to assess alternative dispute resolution institutions' regulations, particularly Financial Services Authority Regulation from a consumer protection perspective, particularly spiritual rights. This research is categorized as an empirical normative study, using a philosophical, historical approach and a content analysis of the Financial Services Authority Regulation. The results of this study indicate that the Financial Services Authority Regulation on Alternative Dispute Resolution Institutions has not accommodated spiritual rights in dispute resolution for the Islamic banking industry. A weak understanding of spiritual rights causes it in the context of dispute resolution. It also creates another problem in the form of a lack of attention and policies that support the protection of spiritual rights, both in regulatory and banking institutions. In the context of dispute resolution, there are general consumer rights, such as the right to get advocacy, while the application of sharia principles is a special right. Based on these findings, it is recommended that regulatory institutions, particularly the Financial Services Authority, pay adequate attention to the entire financial service industry under their respective characteristics. It is an important matter because the protection of spiritual rights supports the development of the Islamic finance industry both in Indonesia and globally.

Abstract

ABSTRAKSI Perkawinan mempunyai arti penting dalam kehidupan manusia di mana perkawinan menimbulkan akibat-akibat hukum, bukan hanya terhadap suami-isteri yang bersangkutan, melainkan juga terhadap anak dan/atau keturunannya. Anak sebagai hasil dari suatu perkawinan merupakan bagian yang sangat penting kedudukannya dalam suatu keluarga menurut hukum Islam. Sebagai amanah Allah, maka orang tuanya mempunyai tanggung jawab untuk mengasuh, mendidik dan memenuhi keperluannya sampai dewasa. Status sebagai anak luar kawin merupakan suatu masalah bagi anak tersebut, karena mereka tidak bisa mendapatkan hak-hak keperdataan sebagai anak pada umumnya seperti anak sah karena secara hukum mereka hanya memiliki hubungan perdata dengan ibunya dan keluarga ibunya. Anak luar kawin tidak akan memperoleh hak yang menjadi kewajiban ayahnya, karena ketidak-absahan anak di luar kawin tersebut. Pasal 43 ayat (1) Undang-undang Perkawinan menyatakan: “Anak yang dilahirkan di luar perkawinan hanya mempunyai hubungan perdata dengan ibunya dan keluarga ibunya”. Di sisi lain, Putusan Mahkamah Konstutusi Nomor 46/PUU-VIII/2010 telah membuka peluang bagi seorang anak luar kawin untuk mendapatkan hubungan keperdataan dengan sang ayah yang selama ini telah tertutup rapat oleh Undang-undang Perkawinan. Putusan MK ini menuai pro dan kontra di masyarakat, hal ini wajar dikarenakan cara memandang kebijakan atau putusan tersebut memang berbeda sudut pandangnya. Berdasarkan gambaran latar belakang masalah tersebut, maka dapat dirumuskan pertanyaan penelitian sebagai berikut. Pertama, Bagaimana perlindungan dan kepastian hukum bagi anak luar kawin berdasarkan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010? Kedua, Bagaimana implikasi hukum putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 terhadap pemenuhan hak-hak Keperdataan anak luar kawin berdasarkan pandangan Hakim Pengadilan Agama Yogyakarta Kata Kunci: perlindungan hukum, anak luar kawin, dan hak-hak keperdataan.

Abstract

This study aims to obtain data and information or information for: Knowing the Implementation of Piercing The Corporate Veil by Shareholders in Limited Liability Company law, Knowing the implementation of Piercing The Corporate Veil by holders share. The approach used in writing this thesis is a normative juridical approach. This means reviewing statutory provisions while still addressing existing problems as well as researching their implementation in practice. only as a tool used by shareholders to fulfill their personal goals, usually these illegal acts are carried out by majority shareholders who do not have good intentions. If a shareholder commits an unlawful or fraudulent act on behalf of the company, he must be responsible for his personal wealth, and this is detrimental to shareholders and stakeholders. Recognition of this principle is something that is generally accepted in any legal system, in the Indonesian legal system it is expressly recognized by UUPT Number 1 of 1995, through Article 3 paragraph (1). 2. Piercing the Corporate Veil by shareholders can be enforced as stated in Article 3 paragraph (2) which states that if there is a mixing of the shareholder's personal assets with the company's assets, then the limited liability will be abolished. The holder of 101 shares is not only responsible for the capital deposited in the company, but must bear the risk to personal assets, if the company suffers a loss, then the responsibility becomes unlimited or no longer a legal act of PT.

Abstract

According to Law Number 3 of 2020 as an amendment to Law Number 4 of 2009 concerning Mineral and Coal Mining and Government Regulation Number 78 of 2010 concerning Reclamation and Post-mining, it requires companies to carry out post-mining reclamation. There are 1,735 ex-mine pits that are not reclaimed in East Kalimantan, which is evidence of the poor responsibility of coal mining managers. As a result, ex-mines that are left gaping without reclamation and recovery will cause 40 people to die by 2021. The purpose of this research is to find out the responsibilities of mining managers and how the community's legal protection of guarantees for reclamation of coal mining companies in East Kalimantan. This research is a non-doctrinal legal research with a socio-legal approach. Researchers focus on the social, economic, political and cultural contexts that develop and influence law. The results of this study indicate that coal mining managers in East Kalimantan are not fulfilling their responsibilities as they should. Environmental interests are often ignored and defeated by economic and political interests, various regulations regarding the environment and post-mining reclamation are unable to compel related parties to carry out statutory orders. Furthermore, regarding the legal protection of the community, it is also not implemented properly, as evidenced by the dozens of souls who died needlessly, which did not even receive serious attention from the regional government of East Kalimantan Province. From each incident the death of the victim in the mining pit was never completely resolved through legal channels, only 1 (one) case was convicted and the sentence imposed was very light, namely only 2 (two) months, while the rest of the cases had no follow-up.

Abstract

The brand is one form of the identity of a product that is marketed. In order to avoid the act of plagiarism toward a brand, the government already issued Law No. 20 of 2016 concerning Trademarks and Geographical Indications as a form of legal protection against brands. The purpose of this study is to find out the legal protection and legal attempts of registered brand disputes contained in court decision number 2/Pdt.Sus.HKI/Merek/2022/PN.NiagaSby Commercial Court in Surabaya between PS Glow and MS Glow. This study is a normative legal research that uses case and statute approaches. Data sources come from secondary data with data collection methods by library research and documentary research. The result of this study shows that legal protections for both registered brands that are disputing are related to the first-to-file principle that applies in Indonesia. The brand holders of PS Glow are entitled to obtain legal protection because it has a certificate based on Law No. 20 of 2016 concerning Trademarks and Geographical Indications. Meanwhile, the legal attempts which can be made by the registered brand holders towards the registered brand dispute are compensation claims through litigation if negotiation steps aren’t successful.

Abstract

This research is about legal protection of information on the content of ethylene oxide in Indomie instant noodle. This research is normative type. This research uses a case approach method. The data collection technique uses secondary data collection techniques. The results of the study, first, consumer legal protection in this study is still weak. Consumers do not obtain correct, clear, and honest information regarding the content of ethylene oxide levels in Indomie instant noodle packaging as they should. This causes consumer rights regarding open information not to be fulfilled properly and correctly. Second, the responsibility of business actors is not appropriate for the loss of consumers who consume Indomie instant noodle products with excess ethylene oxide levels.

Abstract

This study discusses the fulfillment of consumers' rights to information regarding discrepancies between prices on shelves and shopping receipts at Alfamart. This type of research is normative law, the approach method used is law. The source of data obtained through legal materials is in the form of primary data, namely data collection carried out through a library study basis. The results of this study are first, the right to information has not been fulfilled because business actors still tend to ignore their obligations in fulfilling consumer rights to obtain correct, honest and clear information in accordance with the condition of the goods being traded in accordance with Article 4 of Law Number 8 1999 concerning Consumer Protection. Second, business actors ignore consumer rights where when there is a difference in the price listed on the shelf and on the shopping receipt, the price on the shopping receipt is more expensive in accordance with Article 19 of Law Number 8 of 1999 concerning Consumer Protection.
