Abstract

The issue in this research is the regulation of legal protection against justice collaborators of corruption in Indonesia which is not optimal, and the absence of an appropriate protection model for optimum efforts of protection for justice collaborators in handling corruption in Indonesia. This needs to be studied because the role of justice collaborator is very much needed to disclose major cases such as corruption, whereas his testimony can pose a large risk that must be borne by the justice collaborator, hence legal protection for justice collaborators is crucial. The method in this study uses a type of juridical normative research that is focused on studying the norms of positive law. This research concludes, first, the regulations regarding the protection of justice collaborators are listed in various regulations, but there are no specific, clear and firm regulations regarding protection and procedural arrangements for determining a justice collaborator. Thus an appropriate legal protection model is needed to optimize protection for justice collaborators in criminal acts of corruption in order to fill the legal vacuum. Second, the legal protection model for justice collaborators in handling corruption in Indonesia can utilise a persuasive protection model.

Abstract

Watershed management is closely related to regulations on the affairs of local governance, water resources, spatial planning, as well as soil and water conservation. All forms of regulation relating to watershed management must be strictly regulated as the legal basis for watershed management in Indonesia. This study aims to identify, understand, and analyze the juridical constraints faced in managing watersheds in Indonesia and to analyze the ideal juridical regulatory model for watershed management in Indonesia. This research was conducted using normative juridical research, by focusing on testing the implementation of rules or norms in positive law. The results of the study show juridical constraints in watershed management in Indonesia relating to the Revocation and Substitution of the Water Resources Law; the lack of synchronization between the Water Resources Law, the Regional Government Law and the Soil and Water Conservation Law. Therefore, the authors formulate the ideal form of watershed management arrangements, among others by taking quick and effective steps through district / city regional policies while continuing to synchronize efforts through policies in the form of mandates and tasks of assisting watershed management sub-affairs.

Abstract

Penelitian ini membahas mengenai pasar tradisional yang merupakan representasi dari ekonomi rakyat. Pasar tradisional sebagai salah satu pusat perekonomian rakyat pada awalnya jumlahnya cukup banyak dan tersebar di setiap daerah di Indonesia.Pasar tradisional juga merupakan representasi dari nilai-nilai kearifan lokal dan bagian dari kebudayaan nasional Indonesia yang harus dilestarikan sebagaimana dijamin dalam Pasal 28 I ayat (3) dan Pasal 32 ayat (1) UUD NRI 1945. Namun dalam perkembanganya, jumlah pasar tradisional semakin menurun digantikan pasar-pasar modern. Hingga saat ini belum ada undang-undang organik yang khusus mengenai pasar tradisional di Indonesia sehingga penulis menganggap sangat perlu untuk melakukan penelitian yang berjudul : Penataan Ideal Pasar-Pasar Tradisional di Indonesia   Berdasarkan  Teori “Von Stufennaufbau De Rechtsordnung”.Penelitian ini bertujuan untuk memahami, mengkaji, dan menganalisis pengaturan yuridis mengenai faktor-faktor yuridis apa saja yang mempengaruhi penataan pasar tradisional di Indonesia. Penelitian ini juga bertujuan untuk memahami, mengkaji, dan menganalisis bentuk penataan ideal pasar-pasar tradisional di Indonesia berdasarkan Teori “Von Stufennaufbau De Rechtsordnung”. Penelitian ini dilakukan dengan menggunakan tipe penelitian yuridis normatif yaitu penelitian yang difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma-norma dalam hukum positif. Sumber data yang digunakan dalam penelitian adalah menggunakan data sekunder  sebagai data utama dan data primer sebagai data pendukung. Pendekatan penelitian yang digunakan adalah pendekatan perundang-Undangan (statute approach), Pendekatan Konseptual (conceptual approach), dan pendekatan kasus ( case approach.Kata Kunci : Penataan, Pasar Tradisional, Teori Von Stufennaufbau De Rechtsordnung

Abstract

Konstitusi merupakan dasar suatu negara yang harus ada di setiap negara. Apabila tidak didasarkan pada konstitusi maka negara tidak mungkin terbentuk. Negara-negara di dunia pasti memiliki konstitusi yang dapat berbeda maupun dapat sama. Indonesia dan Swiss merupakan negara yang sama-sama memiliki konstitusi dalam bentuk tertulis, sehingga akan menarik untuk memperbandingkan antara konstitusi yang dimiliki oleh Indonesia dengan konstitusi Swiss dengan melihat pada aspek prosedur perubahan konstitusi, bentuk pemerintahan, bentuk negara serta sistem pemerintahannya. Abstract

The 1945 Constitution of Republic of Indonesia states that it is mandatory for government to ensure all of citizen life and well-being in any conditions and to protect them. This mandate take its concrete form by constructing the relevant National Development Plan. The government responsibility in disaster management is in the hands of central and local government—it is supposedly in well-planned and integrated manner. However, in reality, there is still a lot of overlapping authority and bureaucracy from both the central and local or regional governments in disaster management. The harmonization is needed between the central and regional governments, with the basis of granting the widest possible autonomy within the framework of a unitary state. The purpose of this research is to identify the central and regional relationship arrangements in disaster management in the prevailing regulations and to identify steps that must be taken to realize the harmonization of regulation arrangement between the central government and the regions in disaster management. This research is a normative juridical research and uses a basic, systematic approach and the law synchronization approach. From this paper, it is found that the legal politics of central and regional relations in the planning document have been designed to always be synchronous and consistent and have a high level of harmonization, but in the implementation stage it still needs to be reviewed because there are still disharmony caused by the lack of involvement of local governments as partners and communication between the central government and the local government.

Abstract

The decree of the MPR was reviewed based on the theory of Von Stufentbau De Rechtsordnung (Theory of Hans Nawiasky) not including legislation but included in the category of Staatsgrundgesetz (Basic / State Rules) which is the basis for the formation of more laws and regulations low. If the MPR decree is classified into a type of legislation then it is the same as placing it too low because the MPR Decree is included in the Staatgrundgesetz category (Basic Rules / Principles of the State and He provisions of the People's Consultative Assembly in terms of constitutional practices in Indonesia remain included in the type and hierarchy of laws and regulations as referred to in Article 7 paragraph (1) of Law Number 12 Year 2011 concerning the Establishment of Legislation for reasons of practicality in constitutional practice even though the theory and juridical consequences (amendments to the 1945 Constitution specifically regarding the authority of the MPR) do not allow for the inclusion of the MPR Decree as a type of legislation. Because in theory the position of the MPR Decree is higher and is not a statutory regulation but constitutes the Basic Rules / Principles of the State and a juridical consequence that the MPR does not have the authority to set out the Broad Outlines and Guidelines of the State but only has the authority to amend and stipulate laws the state of 1945

Abstract

The rights of Persons with Disabilities obtain legal guarantees both in the Convention on the Rights of Persons with Disabilities (CRPD) and Constitution of the Republic of Indonesia 1945. With the ratification of CRPD by Indonesia through the Law of the Republic of Indonesia Number 19 Year 2011 on The Ratification of the Convention on the Rights of Persons with Disabilities, then all legal products relating to the rights of persons with disabilities, especially in this research, emphasize in the education sector in Yogyakarta city must be based on the provisions in the Constitution of the Republic of Indonesia 1945 and the CRPD. The purpose of this research  is to know, understand, review and analyze the strengthening of the rights of people with disabilities in the education sector in Yogyakarta City based on the Constitution of the Republic of Indonesia 1945 and CRPD. This research also aims to know, understand , reviewing and analyzing the juridical constraints faced in the context of strengthening the rights of people with disabilities in the city of Yogyakarta.The type of research used is normative juridical research that is focused to study the application of rules or norms in positive law. The approach method used in this research is statute approach, Analytical Approach, and Case approach. As a follow-up to the ratification of CRPD and also the mandate of the Constitution of the Republic of Indonesia 1945 in particular with regard to the rights of persons with disabilities in the field of education, it is necessary to implement an implementing regulation at the local level of Yogyakarta City to carry out the mandate of the  Constitution of the Republic of Indonesia 1945 and the CRPD. Abstract

Regional contributions through the use of co-branding are one of the solutions in advancing economic growth and increasing the competitiveness of regional superior products. Co-branding is a marketing strategy that is used together on one product or service. Broadly speaking, the common goal of branding is to increase the value of brand equity by increasing the strength of product brands in the regions to collaborate. Daerah Istimewa Yogyakarta (DIY) is the province that has 100% Jogya, Yogyakarta, and Yogyakarta traditions and has used co-branding in order to improve the competitiveness of its regional products.This research aims to find out, understand, study, and analyze the use of co-branding in order to improve the competitiveness of regional superior products. This research also tries to study, discuss, study and analyze ideal arrangement about the use of co-branding on regional superior products. This research was conducted using the type of normative juridical research, namely research focused on studying the application of rules or norms in positive law. The research approach used is the statutory approach, the conceptual approach, and the case approach. This research emphasizes the importance of using co-branding on regional superior products in order to increase the competitiveness of regional products and economic growth in each region that is stable and sustainable. Keywords : regional superior products, brand, co branding

Abstract

Abortion is regulated internationally especially in the ICCPR, CEDAW and ICESCR. Indonesia also regulates abortion based on Law No. 1 of 2023 concerning the Criminal Code, Law No. 17 of 2023 concerning Health, Government Regulation No. 61 of 2014 concerning Reproductive Health, and Regulation of Minister of Health No. 3 of 2016.  The practice of safe abortion services until now is difficult for victims of sexual violence to access, in practice there are still many obstacles from a systematic and structural perspective when victims want to access legal abortions This research aims to examine the regulations in national law and international law related to providing legal and safe access to abortion for women and the implementation of providing legal and safe access to abortion in Indonesia.This research uses normative juridical with statute approach, and case approach. This research contains the legality of abortion in national law and international law and the obstacles faced in providing access to legal and safe abortion. Indonesia has ratified CEDAW, ICCPR and ICESCR regarding providing access to legal, safe and effective abortion in order to realize equality in health services, so the state must take firm actions in order to realize the legal and safe abortion services needed by women and girls.
