Abstract

This paper describes the problems and challenges as the effects of legal transplantation. As a policy alternative, legal transplantation is an appropriate short-term solution to immediately produce a new legal formulation. This study focuses on analyzing the characters of legal transplant in Vietnam which reflects the competition in local domestic conditions. This doctrinal legal research uses both conceptual and historical approach. The conceptual approach refers to the issue of legal transplantation while the historical approach refers to the historical course of law in Vietnam. Conclusively, in Vietnam's experience, the results of a legal transplant did not take place smoothly and immediately. The footprint of the legal transition and the combination of traditional order with the influence of colonial inheritance law causes the transplantation effect to not immediately contribute to positive conditions for legal development. Apart from the rigid communist system, which accommodates a market-friendly liberal economic system, the need for regulation in accordance with the development of contemporary social relations arises. However, party interference, including in controlling judges and courts, causes mixed forms of legal transplantation that have no equivalent in the mainstream legal system. Transplanted law in Vietnam does not only present a new face to the law and court system, but also influences the challenges of future development so that the transplantation effect can contribute to positive steps for legal reform.

Abstract

This paper aims to describe socio-juridically the performance of courts in authoritarian circles of power. The court is increasingly demanded attention by academics of constitutional law, along with the expectation of a role in the presence of power. Courts, of course by involving judicial apparatus, especially judges, are controlled by the executive but are able to negotiate their functions to support the government. Courts can provide legitimacy both internally and externally as well as being an effective tool for maintaining power. On this side, every regime of power has an interest of the court. Therefore, the idealita of the court then also related with independence, which is not only for the rule of law, constitutionality and human rights, but also in relation to globalization, free and efficient economic activities. If the judges are independent, they are basically protected from undue influence from those who can damage their impartiality. With variations that are not the same, but working in the same circle of power, courts in Singapore and Pakistan confirm these matters. Abstrak Tulisan ini bertujuan untuk mendeskripsikan secara sosio yuridis kinerja pengadilan dalam lingkaran kekuasaan yang otoritarian. Pengadilan semakin dituntut perhatiannya oleh akademisi hukum tata negara, seiring harapan akan peran di hadapan kekuasaan. Pengadilan, tentu saja dengan melibatkan aparatur peradilan, terutama hakim, dikendalikan eksekutif akan tetapi mampu menempatkan negosiasi fungsi mereka untuk mendukung pemerintah. Pengadilan bisa memberikan legitimasi secara internal maupun eksternal sekaligus menjadi alat efektif untuk mempertahankan kekuasaan. Pada sisi ini, setiap rezim kekuasaan berkepentingan dengan pengadilan. Oleh sebab itu, idealita pengadilan kemudian juga berurusan dengan independensi, yang tidak hanya untuk supremasi hukum, konstitusionalitas, dan hak asasi manusia, tetapi juga dalam kaitannya dengan globalisasi, kegiatan ekonomi yang bebas, dan efisien. Jika hakim independen, mereka pada dasarnya dilindungi dari pengaruh yang tidak semestinya dari pihak-pihak yang dapat merusak ketidakberpihakan mereka. Dengan variasi yang tidak sama, namun bekerja dalam lingkaran kekuasaan yang sama, pengadilan di Singapura dan Pakistan memberikan konfirmasi atas hal-hal tersebut.

Abstract

This study aims to analyze the structural, institutional, and regulatory challenges in recognizing Indigenous Law Communities (Masyarakat Hukum Adat/MHA) in Indonesia, with a particular focus on the strategic yet ambiguous role of provincial governments. Despite the legal mandate for decentralization, the dual function of governors as regional heads and central government representatives has not been supported by a clear legal framework to facilitate cross-district recognition of MHA. Using a qualitative approach, the study employs document analysis of legal texts, regional regulations, and case studies, supported by secondary data from institutional reports and scholarly publications. The findings reveal three major issues: first, the absence of a legal mandate for governors to coordinate inter-district recognition processes; second, regulatory conflicts between provincial and district-level authorities, especially when indigenous territories cross administrative boundaries; and thrid the lack of harmonization between regional customary regulations and national laws. These obstacles have resulted in legal uncertainty, fragmented policy implementation, and continued marginalization of indigenous communities. This research contributes to the discourse on multilevel governance by emphasizing the overlooked role of governors in indigenous rights recognition. It also identifies practical entry points for policy reform, such as enhancing judicial review mechanisms, formalizing adat institutions, and improving spatial data integration across ministries. The originality of this study lies in shifting the analytical lens from district-level actors to the provincial level, proposing a coordinated, vertically and horizontally integrated governance framework for sustainable recognition of indigenous communities in Indonesia.

Abstract

This study examines the any quality policy in government paddy procurement as a state response to the need to maintain national rice availability, while raising concerns regarding the protection of food quality as an integral component of the right to food. The core issue lies in the tension between flexibility in absorbing paddy from farmers and the state’s legal obligation to provide food that is safe, suitable, and of adequate quality in accordance with the relevant regulatory framework. The research employs a doctrinal method using primary and secondary legal materials, combined with statutory, conceptual, and comparative approaches that include policy practices in India, China, and Thailand, in order to assess the alignment of the policy with the principles of the right to food and proportionality. The findings indicate that the any quality policy can meet constitutional obligations only when supported by adequate quality control mechanisms. Price instruments such as rafaksi are insufficient to preserve quality and therefore must be complemented by strengthened post harvest facilities, technical standards for drying and sorting, consistent quality monitoring, and enhanced administrative capacity at both national and regional levels. The study concludes that an integrated policy design linking price instruments with technical instruments is essential to ensure that the state can effectively safeguard food quality and fully uphold the right to food.

Abstract

Penelitian ini bertujuan untuk mengkaji peran Pemerintah Kabupaten Karanganyar dalam pengelolaan aset guna meningkatkan sistem pelayanan publik dan hambatan yang dihadapi beserta solusinya. Penelitian ini merupakan penelitian hukum empiris atau non-doktrinal dengan menggunakan sifat penelitian deskriptif. Jenis data yang digunakan adalah sumber data primer dan sumber data sekunder. Pengumpulan data primer dilakukan dengan mengumpulakn data secara langsung di Wilayah Pemerintahan Daerah Kabupaten Karanganyar. Sumber data sekunder yang digunakan dalam penelitian ini antara lain meliputi buku-buku teks, artikel ilmiah, jurnal hukum yang berkaitan dengan permasalahan yang diteliti. Teknik pengumpulan data dengan melakukan wawancara dan studi kepustakaan. Penelitian ini terfokus pada peran Pemerintah Daerah dalam upaya meningkatkan sistem pelayanan publik melalui optimalisasi pengelolaan aset. Keberhasilan pengelolaan aset dapat membuka peluang untuk meningkatkan transparansi serta meningkatkan kualitas layanan publik. Hasil dari penelitian ini bahwa peran Pemerintah Kabupaten Karanganyar dalam pengelolaan aset guna meningkatkan sistem pelayanan publik sudah berjalan dengan baik. Peran yang telah dijalankan yakni, perencanaan strategis, transparansi dan akuntabilitas, pengembangan aset, pemeliharan dan pemanfaatan aset, menyusun kebijakan aset, serta kolaborasi dan konsultasi. Hambatan yang dihadapi yakni Pertama, seoramg Aparatur Sipil Negara (ASN) tidak memiliki keahlian khusus sebagai interpreneur. Kedua, calon penyewa tidak mudah untuk mendapatkan informasi terkait dengan tanah yang akan di sewakan. Ketiga, tim pengelola masih terhambat dalam mengetahui status tanah.

Abstract

This article examines the constitutional regulation of the right to food in Indonesia and Brazil by situating food as an economic, social, and cultural right inseparable from human dignity, survival, and welfare. Central issue is the contrast between Indonesia’s implicit constitutional model, in which the right to food is derived from the rights to life, decent livelihood, and physical and spiritual welfare under the 1945 Constitution, and Brazil’s explicit model, which incorporates food as a social right under Article 6 of the 1988 Federal Constitution after Constitutional Amendment No. 64 of 2010. This study employs normative legal research through statutory, case, comparative, and conceptual approaches. The analysis shows that both states embrace a welfare-state orientation and recognize the protection, promotion, and fulfilment of human rights as a constitutional responsibility of the state. However, Brazil’s explicit formulation provides a stronger basis for justiciability and direct constitutional enforcement, as illustrated by ADPF 709 concerning the Yanomami Indigenous community. By contrast, Indonesia’s implicit formulation allows broader constitutional interpretation and policy flexibility, yet weakens the enforceability of the right to food because the issue is often treated as administrative policy rather than a directly claimable constitutional right. The article argues that Indonesia needs a clearer constitutional or judicial construction of the right to food, supported by minimum standards, complaint mechanisms, and institutional accountability. Such reform is necessary to ensure that access to adequate, safe, and nutritious food is protected not merely as a policy objective, but as an enforceable constitutional entitlement for vulnerable groups.

Abstract

The amendments to the 1945 Constitution of the Republic of Indonesia not only restructured the distribution of state power but also reconstructed the national representation system into a pseudo-bicameral model. This model convenes the House of Representatives (DPR) and the Regional Representative Council (DPD) within a single forum, namely the People's Consultative Assembly (MPR), characterized by an asymmetrical distribution of authority. Theoretically, this institutional design presents significant challenges within the framework of representative constitutionalism and deliberative democracy, particularly concerning the quality of territorial representation and the scope of constitutional deliberation. This study aims to analyze the construction of the DPR-DPD relationship within the pseudo-bicameral system and its implications for the deliberative function, the appointment to constitutional offices, and constitutional amendments. Employing a normative legal research methodology, this study utilizes statute, conceptual, and historical approaches. The findings reveal that the dominance of the DPR and the constrained authority of the DPD have resulted in the reduction of the MPR's deliberative function and the erosion of the equilibrium among representative elements. This asymmetric structure generates a tension between the principle of constitutional supremacy and the imperative for inclusive democratic legitimacy. Consequently, strengthening the role of the DPD through a limited constitutional amendment or the reconstruction of the MPR's internal mechanisms constitutes a normative prerequisite for establishing a more deliberative and constitutionally robust representation system.

Abstract

Penelitian ini memiliki tujuan untuk mengetahui mengenai independensi Komisi Pemberantasan Tindak Pidana Korupsi (KPK) pasca perubahan undang-undang KPK. Penelitian ini adalah penelitian hukum normatif yang memiliki sifat penelitian preskriptif dan terapan. Jenis data yang digunakan adalah data sekunder meliputi bahan hukum primer, sekunder, dan tersier. Teknik pengumpulan data dalam penelitian ini adalah studi kepustakaan atau studi dokumen. Instrumen penelitian berupa Undang-Undang Nomor 19 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi (KPK) beserta perubahannya. Hasil penelitian menunjukkan bahwa perubahan terakhir UU KPK telah mempengaruhi independensi KPK dalam hal perekrutan penyidik, pelaksanaan proses penyidikan, dimana hal ini mencederai tujuan awal dibentuknya lembaga anti korupsi yang independen.
