Abstract

AbstrakIslam sebagai agama memiliki aturan-aturan yang harus dilaksanakan oleh umatnya yang selanjutnya disebut sebagai hukum Islam. Keberadaan hukum Islam di Indonesia telah dilaksanakan seiring masuknya agama Islam itu tersendiri. Bahkan sebelum pihak kolonial Belanda datang menjajah wilayah Nusantara, hukum Islam telah dilaksanakan secara menyeluruh (kāffah) dalam berbagai aspeknya dan telah menjadi sumber hukum bagi kerajaan-kerajaan Islam di Nusantara. Datangnya Belanda ke wilayah Nusantara dengan menerapkan politik hukumnya yaitu teori receptie. Teori receptie yang merupakan gagasan dari Snouck Hurgonje memberikan implikasi besar terhadap hukum Islam yang selama ini telah diamalkan oleh umat Islam, dan pengaruhnya masih dapat dirasakan pasca kemerdekaan Indonesia.Kata Kunci: Hukum Islam, Politik Hukum, dan Teori Receptie AbstractIslam as a religion has rules that must be implemented by its people, hereinafter referred to as Islamic law. The existence of Islamic law in Indonesia has been implemented as the entry of Islam is separate. Even before the Dutch colonial colonists came to occupy the archipelago, Islamic law has been implemented thoroughly (kāffah) in various aspects and has become a source of law for the Islamic kingdoms in the archipelago. The arrival of the Netherlands into the archipelago by applying its legal policy of receptie theory. Receptie theory which is the idea of Snouck Hurgonje has major implications for Islamic law which has been practiced by Muslims, and its influence can still be felt after Indonesian independence.Keywords: Islamic Law, Political Law, and Receptie Theory

Abstract

AbstrakTalfīq dalam khazanah hukum Islam mulai populer pada periode ulama muta’akhirin. Kemunculannya dilatar belakangi ketika mewabahnya sikap taqlid dalam madzhab yang melanda oleh umat Islam. Istilah talfīq dalam madzhab menjadi perhatian serius Ibrahim Hosen, seorang pakar Ushul Fiqh dan Fiqh dari Indonesia. Dalam  Penelitian ini, penulis berusaha menelusuri pemikiran Ibrahim Hosen dalam masalah talfīq, baik berkaitan dengan biografinya, maupun landasan pemikirannya. Dari hasil penelitian penulis sendiri, Ibrahim Hosen lebih cenderung membolehkan talfīq, karena sejalan dengan prinsip agama Islam, yang memberikan kemudahan bagi umatnya. Akan tetapi pengamalan talfīq itu sendiri tidaklah bersifat mutlak, talfīq dapat dilakukan apabila situasi dan kondisi yang tidak memungkinkan (dharurat). Kata Kunci: talfīq, Madzhab, dan Ibrahim Hosen   AbstractTalfīq in the treasury of Islamic law began to popular in the period ulama muta'akhirin. The term talfīq in the madhhab became a serious concern Ibrahim Hosen, an expert of Ushul Fiqh and Fiqh from Indonesia. In this study, the author tries to trace the thought of Ibrahim Hosen in the matter talfīq, both related to biography, as well as the basis of his thinking. From the results of the authors own research, Ibrahim Hosen more likely to allow talfīq, because in line with the principle of Islam, which provides convenience for its people. However, the exercise of talfīq itself is not absolute, talfīq can be done if situations and conditions are not possible (dharurat). Keywords: talfīq, Madzhab, and Ibrahim Hosen

Abstract

This study analyzes Al-Mawardi’s concept of leadership as presented in Al-Ahkam al-Sultaniyyah and evaluates its relevance to Indonesia’s democratic system. Al-Mawardi emphasizes that a leader must possess justice, wisdom, courage, and a strong sense of responsibility in carrying out leadership duties. He also highlights the importance of law enforcement, public welfare, and the appointment of competent officials as the foundation of a stable government. This research employs a library research method with a qualitative descriptive approach. The primary source is Al-Mawardi’s work, analyzed alongside relevant literature on fiqh siyasah and Indonesia’s governance system. The findings indicate that several of Al-Mawardi’s leadership principles, such as justice, public welfare, and the supremacy of law, align with the values of Pancasila and the principles of democracy in Indonesia. However, fundamental differences exist in the selection mechanism of leaders, the authority of institutions involved, and the process of dismissing a head of state. Al-Mawardi’s concept prioritizes legitimacy based on religious and individual expertise, whereas Indonesia’s democratic system emphasizes public participation and structured institutions. In conclusion, Al-Mawardi’s thoughts remain relevant as a conceptual reference for developing leadership that upholds justice and prioritizes public interest. However, their application in a modern democratic system requires reinterpretation to align with Indonesia’s evolving political and legal dynamics.
