Abstract

Historically, efforts to reform Family Law in parts of the Islamic world began to be realized in the late 19th century AD. The reality of Islamic legal reforms carried out in Islamic countries in North Africa, the Middle East, Central Asia, and Southeast Asia gave rise to unprecedented changes in the last century. These changes occur both in the justice system and in the system applied. Changes to family law were first carried out by Turkey, then followed by Lebanon in 1919, Jordan in 1951, and Syria in 1953. Muslim countries in the world, in their context with the renewal of family law, are divided into three categories. First, an Islamic state that does not carry out any renewal and still enforces family law as stipulated in the books of fiqh. Secondly, an Islamic state that has completely abandoned Islamic family law and adopted European civil law. Third, countries that are trying to enforce Islamic family law but after making reforms here and there. This paper tries to discuss one of the reforms carried out by one Muslim country, namely Turkey, which is related to the reformation (reform) of family law that starts from the history of reform, legislation, renewal, and legal material. The author chose Turkey because it is the first Muslim country to make changes to family law.

Abstract

Marriage is something sacred in human life, which aims to form a happy, safe, comfortable and full of harmony family between husband, wife, and children. It has become the nature of man to preserve and preserve something of value he possesses, moreover it is a part of him, namely children. In looking after and choosing children, one of the effective ways is to provide education. Education in the family not only begins when a child is born but since the child is in the womb, even when someone chooses a partner. The family is the first place for children to interact and learn. From the process of interaction, he gained many things that can shape his character and personality. In this case, the first education that must be taught to a child is Islamic religious education. The success or failure of Islamic education in the family has implications for national security. Because of the elements of the forming of the State, one of them is the population (society) consists of families. With the Islamic education that is taught, instilled in a family, it is hoped to be able to form a family that is safe, peaceful, comfortable, and devoted to Allah s.w.t. As contained in the Qur’an about the importance of caring for and family from hellfire by providing education to families in surah at-Tahrim verse 6. This paper will discuss some of the factors that describe and answer issues such as how is the education of Islam in the family perspective of surah at-Tahrim verse 6, how is the contextualization of Islamic religious education in the family, and how national resilience is based on family education. This is important to discuss because a weak child (knowledge and material) will be able to affect the harmony of a family. Abstract

Democracy is a government of the people, by the people and for the people. The popularity of the democratic system is arguably at its peak. This is proven by the many uses of the democratic system in modern countries in the world. Indonesia as a country that runs a democratic system does not give authority to the authorities to monopolize votes in an election. Because security and freedom for every citizen, free to choose as a representation of the sovereignty of the people. But on the side that democracy often happens is seen as freedom so that there are some elements mixing elements in democracy that actually damage democracy itself. Call it when campaigning for a candidate to hate speech, insult, and berate other candidates so that damage the good name in the eyes of the community. As reported in Detik.com in 2016, the National Police stated that there were 2,018 cases of hate speech that occurred. Then it increased by 44.99% in 2017 to 3,325 cases. Furthermore, in 2018 reported in January 2019 there were 3,884 cases of hate speech that occurred. This proves that in campaigning the candidates cannot be said to campaign peacefully, fairly and competitively. Whereas Allah s.w.t. It has been said in Surah al-Hujurat verse 11. Based on the description above the writer is interested in discussing and studying more about the campaign in the Elections in Indonesia and campaigning peacefully perspective of Surah al-Hujurat verse 11. This is important to discuss given the rampant hate speech cases that conducted by candidates in campaigning. This study aims to contribute knowledge to the candidates so that in campaigning, they do not utter hate speech, insult, and berate other candidates.
