Abstract

Massive demonstrations that occurred since 2010 in several Arab countries (Arab Spring) sparked the attention of the UN Security Council to undertake humanitarian intervention, including in Libya which started in February 2011 with the use of armed force undertaken by NATO and some other big countries. Humanitarian intervention is a recommendation of the UN Security Council Resolution 1973 of 2011, under Chapter VII of the UN Charter, 1945. In doing humanitarian intervention, state and international organizations must have the recommendation of the UN Security Council, but the Security Council should also get legitimacy from the international community. Humanitarian intervention is also required to have humanitarian objectives to protect human rights. In this paper discusses the legitimacy given by the international community to the humanitarian intervention of the UN Security Council on Libya.

Abstract

Massive demonstrations in several Arab countries lead to a civil war among the citizens. This is of special concern to the United Nations as the global nature of international organizations to participate in the intervention of the conflict accompanied by making resolutions. These cases are suing back the legitimacy of international law, especially international organizations like the UN. In this study describes about the legitimacy of the UN Security Council resolutions, and thenapply it to analyze the conflict in Darfur. The UN is an international organization which is the subject of public international law, so that the resulting public policy becomes legally binding for member states based on the collective legitimation. In the application of collective legitimation is in practice often does not correspond to the value of morality and even a lot of opposition as in the case of the conflict in Darfur whose governments openly reject the contents of the resolution issued by the United Nations.

Abstract

Tulisan ini membahas tentang interrelasi dan interkoneksi antara hermeneutika sebagai metode penafsiran dalam Al-Quran dan ushul fiqh sebagai metode berfikir dalam tradisi Islam, yang dimulai dengan pengenalan tentang hermeneutika dan sekilas tentang beberapa alirannya. Kemudian tulisan ini dilanjutkan dengan membahas tentang ushul fiqh dan bagaimana pertalian (interrelasi) dan hubungan (interkoneksi) antara hermeneutika dan ushul fiqh beserta analisa tentang relasi dan koneksi antara keduanya. Hermeneutika dan ushul fiqh memiliki keterkaitan mengingat hermenutika bisa dijadikan sebagai salah satu metode dalam ushul fiqh yaitu metode al-Mathur dan al-Rayu yang menggunakan akal.
