Abstract

This study compares three formal criminal laws on the corruption act to show the importance of due process model for wiretapping/lawful interception in Indonesia. Investigators of Indonesian Corruption Eradication Commission (KPK) assume that the implementation of wiretapping based on the due process model decelerate the performance and independence of corruption eradication. The problem particularly happens on the execution of caught in the act operation. This study covers the design of wiretapping on corruption case linked with the due process model as an effort to guarantee the right of privacy. Firstly, legislators accentuated an effective corruption eradication, which highlights the implementation of the crime control model. Secondly, the latest amendment to the Law on Corruption Eradication Commission of Indonesia alters wiretapping to become a procedural activity for stronger synergy among the law enforcement institutions. The regulation of wiretapping as a method to reveal corruption case in Indonesia does not adhere to the due process model entirely. The wiretapping still tends to deal with stages of preliminary-investigation, investigation, prosecution, and the execution of internal approval process. From Crime Control Model to Due Process Model: Studi Kritis Pengaturan Penyadapan oleh Komisi Tindak Pidana Korupsi Republik Indonesia AbstrakHasil penelitian atas tiga undang-undang hukum pidana formil terkait tindak pidana korupsi di Indonesia menunjukkan pentingnya model due process dalam penyadapan. Penyidik Komisi Pemberantasan Korupsi Republik Indonesia memandang pelaksanaan penyadapan berdasarkan model due process memperlambat kinerja dan independensi penegakan korupsi terutama dilakukannya Operasi Tangkap Tangan. Artikel ini membahas rancang bangun penyadapan pada tindak pidana korupsi dikaitkan dengan model due process sebagai upaya menjamin hak asasi manusia, secara khusus hak privasi. Pertama, awalnya pembentuk undang-undang lebih menekankan pemberantasan tindak pidana korupsi secara efektif sehingga menunjukkan penerapan model pengawasan tindak pidana.  Kedua, UU KPK RI  mengubah penyadapan lebih prosedural dengan harapan menguatkan sinergitas antar lembaga penegak hukum. Pengaturan penyadapan atas tindak pidana korupsi di Indonesia masih belum sepenuhnya memberlakukan model due process. Penyadapan masih bersifat sektoral dengan mencakup tahap penyelidikan, penyidikan dan penuntutan serta menjalankan proses perijinan secara internal. Kata kunci: korupsi, model due process, model pengawasan tindak pidana.DOI: https://doi.org/10.22304/pjih.v7n3.a7

Abstract

The right of education for citizens has been fulfilled diversely following the government policies. This study aimed to emphasize the importance of the education right and the imposition of criminal sanctions in order to protect the right of education during the Covid-19 Pandemic particularly in Indonesia, Japan and Australia. Normative juridical research methods described that government policies as outlined in the legislation constantly followed by criminal sanctions. The concept of education right was understood in a different way during the Covid-19 pandemic, as one of the derogable-right or adapted human right. For its fulfillment, some education right uses criminal sanctions as a primum remidium, an ultimum remidium, or does not impose criminal sanctions at all. The right of education still reman as a very important human right even during the pandemic period

Abstract

Dokter bukan hanya dibutuhkan ketika sakit, namun ketika sehat pun dokter sebenarnya diperlukan untuk mencegah penyakit atau menjaga dan meningkatkan kesehatan fisik maupun psikis dari pasiennya. Hubungan dokter-pasien adalah hubungan kepercayaan, jadi tanpa rasa percaya diantara keduanya, pengobatan tidak mungkin dilakukan dengan baik. Hubungan hukum antara dokter dan pasien adalah hubungan terapeutik. Hubungan hukum ini bersumber pada kepercayaan pasien terhadap dokter, sehingga pasien bersedia memberikan persetujuan tindakan medik (informed consent), yaitu suatu persetujuan pasien untuk menerima upaya medis yang akan dilakukan terhadapnya. Segala macam perawatan pasien yang dilakukan oleh dokter diperlukan persetujuan tindakan medik dari pasien, baik itu berbentuk lisan, isyarat maupun tertulis. Di dalam Hukum Pidana, apapun yang akan dilakukan oleh seseorang maka memerlukan suatu bukti pendukung sebagai bentuk pembenaran dari apa yang dilakukannya agar tidak mendapatkan permasalahan.Kata-Kunci: Informed consent, hukum pidana, dokter, pasien Doctors not only needed when sick, but even when healthy doctors are actually needed to prevent disease or maintain and improve the physical and psychological health of their patients. The doctor-patient relationship is a relationship of trust, so without trust between the two, treatment is impossible. The legal relationship between doctor and patient is a therapeutic relationship. This legal relationship is based on the patient's trust in the doctor, so that the patient is willing to give informed consent, which is the patient's consent to accept the medical treatment that will be carried out on him. All kinds of patient care carried out by doctors require the approval of medical actions from the patient, whether in the form of oral, sign or written. In Criminal Law, whatever a person will do, it requires supporting evidence as a form of justification for what he did so as not to get into trouble.Keywords: Informed consent, criminal law, doctor, patient

Abstract

This study aims to analyze the legality of the policy to postpone village head elections in Sampang Regency from a legal perspective, particularly based on Law Number 6 of 2014 concerning Villages. The background of this research is the phenomenon of repeated delays in Pilkades, which has triggered political disputes and legal uncertainty at the village level. This research employs a normative legal method using a statutory approach and a conceptual approach, with qualitative analysis based on library research. The results show that the legal framework governing Pilkades emphasizes the obligation to conduct elections periodically as a manifestation of local democracy and legal certainty. However, the postponement policy implemented in Sampang Regency lacks a clear legal basis and potentially contradicts the principles of legality and legal certainty. Furthermore, prolonged delays have significant legal and democratic implications, including weakened legitimacy of acting village heads and disruption of village autonomy. In conclusion, the postponement of Pilkades in Sampang Regency requires serious evaluation to ensure alignment with the principles of the rule of law and good governance. Therefore, regulatory clarity and strong governmental commitment are necessary to ensure timely implementation of village head elections and to protect the democratic rights of village communities.

Abstract

This article analyzes the role of the state and the effectiveness of national legal politics in ensuring data security and the privacy rights of citizens in the era of digital globalization. The research employs a normative juridical method using statutory, conceptual, and doctrinal approaches, supplemented by an empirical literature review on data breach incidents in Indonesia. Philosophically, personal data protection is grounded in the values of humanity and justice embodied in Pancasila, and constitutes an integral part of human rights as guaranteed by the 1945 Constitution of the Republic of Indonesia. Juridically, the enactment of Law Number 27 of 2022 concerning Personal Data Protection marks a significant milestone in developing secure and accountable data governance. The findings reveal that the implementation of this regulation remains weak, as evidenced by the absence of an independent data protection authority, the lack of comprehensive implementing regulations, poor inter-agency coordination, and low public literacy regarding digital security. From the perspective of legal politics, the state's response to digital security challenges tends to be reactive and has yet to become fully progressive in accordance with technological advancements. This article asserts that the state must function not only as a regulator but also as a facilitator and protector by strengthening the legal framework, enhancing cyber resilience, establishing an independent data protection authority, and promoting international collaboration. Through a progressive and responsive legal approach, the state can safeguard privacy rights while upholding digital sovereignty amid the rapid expansion of global digitalization.
