Abstract

The purpose is achieved in this research are: to know the mechanism of the occurrence of a credit agreement in the German Fiducia between Guarantees the lender with the leasing in the state law enforcement to know Grail in the event of a transfer of the object of the fiduciary guarantee in the region Police Resort of Kudus. To know the constraints in the legal enforcement of the related existence of a Fiduciary guarantee redirects object at Police Resort, and the solution for consumers.This research is the legal research approach or using Empirical Juridical also called as the Juridical Sociological. This research is descriptive analytical research as specified.Research results in the agreement between the creditors and the debtor financing mutual committing yourself, before making the deal, leasing the breathtaking debtor must meet the obligation to pay installments on a timely basis in accordance with the quantity and the date of the has been agreed, then release the rights and obligations not to a make problem. In terms of collateral object is the object of fiduciary transferred to third parties apply the principle creditors can still execute the collateral objects. Abstract

Problems in this study: (1) How is the implementation of activities in the District Land Office PTSL Kendal? (2) How the Government's policy to accelerate the legal certainty Landrights through PTSL ?. The method used in this research is the method of approach to socio-legal research, consisting of socio research and legal research. The results of this study are: (1) Implementation PTSL in Kendal District Land Office begins by planning activities PTSL by the Head of the Kendal District Land Office with pre inventory candidate and potential participants. (2) Government policy in speeding up the legal certainty of land rights through PTSL is based in Kendal land that already has a certificate covering an area of 13834.46 hectares.Suggestions in this study is consistent with the objectives of land registration is to provide certainty and legal protection to the rights holder, to reduce the escalation of disputes continues to grow, it is time for a land registration system through PTSL changed to positive land registration system.Keywords : Government Policy; Legal Certainty of Land Rights; PTSL.

Abstract

This study aims to determine how is the implementation of the action by infringing traffic by a speeding ticket in the jurisdiction of Police in Semarang; How can the impact of infringing on a traffic enforcement with a ticket to the number of traffic accidents in the jurisdiction of Police in Semarang; and What constraints in action by infringing traffic by a speeding ticket in the jurisdiction of Semarang Police and how the solutions to overcome them.The method used by the author in this study is juridical empirical or sociological jurisdiction. Specifications of research used is descriptive analyticalBased on research conducted can be concluded that 1) Implementation of Traffic Violations Enforcement accordance with Government Regulation on Infringement Ticketing Act No. 80 Of 2012 on Procedures for  Vehicle Inspection and Enforcement Violations On the Road Traffic and Transportation Article 3, which reads  Vehicle Inspection; 2) The results in January to September 2018 is known that the impact of a speeding ticket to a very significant definitely one transport accident means the higher the number the lower the accident rate speeding ticket, speeding ticket conversely the lower the number the higher the number of accidents; and 3) Constraints in the prosecution of traffic violations by a speeding ticket in the jurisdiction of Semarang Police isThe lack of legal awareness in the society, lack of ability by the Police Authority problematic legislation, the lack of infrastructure to supportKeywords: Impact; Infringement; Traffic; Infringement Ticketing; Accident.
