Abstract

The characteristics of Islamic financing must follow the governingQur’anic verses and the Hadis of the Prophet Muhammad Puh. Thismeans that the epistemology derives from the Tauhidi Principle,being different from the one of the conventional economy andbanking that is deriving from the western culture and purely rationalthinking. Their basic and main principles are for the creation ofboth, the individual and collective well being of the society,consisting of Tauhidi Principle, vicegerency, justice, and materialand spiritual balances. These principles can be fulfilled by adheringto the Qur’anic stipulations, ie, emphasizing on trade and doing noribawi transactions (QS. 2: 275), and working on cooperative basis(QS. 5: 2). These stipulations bring about a deep and widesignificance and implication.For creating the collective well being of the society, Islamicfinancing can only be implemented by using the existing contracts,without riba, non gharar, non maysir, aiming on non ribawi workresults, common profit, using quasi equity and not purely moneyloan, risk sharing concept, being trustworthy, and keeping promisesreligiously. Consequently, money is put in its basic function that isas a medium of exchange and as a measure of the counter valuebeing goods, services, and productive business in the real sector ofthe economy.

Abstract

This study aims(1) to know customer financing areconsider want-not want and capable-incapable on Unit UsahaSyariah PT. Bank Tabungan Negara (2) to know the criteria ofthe restructuring which occur on Unit Usaha Syariah PT. BankTabungan Negara, and (3) to ensure that the criteria that havea positive impact on improving the financing portfolio on UnitUsaha Syariah PT. Bank Tabungan Negara. To achieve theseobjectives, the author uses qualitative research methodology inthis is field research. Sources of data obtained directly from thestudy site on Unit Usaha Syariah PT. Bank Tabungan Negara fromdocuments relating to the cases studied. In addition, the dataobtained from direct interviews with Departement HeadRestructuring and Recovery Collection and Workout ShariaDivision dan Restructuring and Recovery Collection and WorkoutOfficer Sharia Division. After the data were completely collected,the author analyzed the data by descriptive analysis, using thedeductive analysis method, in which a specific conclusion is madefrom general data that have been collected. After conducting theresearch, it is concluded that (1) Bank in determining thecustomers want-not want is from the response of the customerafter receiving first to third a warning letter, while in determiningthe customer is capable-incapable were determined by theaccuracy of the promise to pay the arrears that have been agreed.(2) There are 5 (five) criteria restructuring on UUS BTN ie: hospitalfees, education fees of children, fixed income but needs increase,layoffs but had returned to work, and a decrease in revenues. Thewhole reason is temporary, kasuistis, and the positive reasons thatthese criteria may be considered for approval. (3) When measuredfor one year from the restructuring provision, criteria ofrestructuring customers collectibility are still acceptable orhighest Dalam Perhatian Khsusus (DPK) so that said effective.

Abstract

Penelitian ini bertujuan untuk mengetahui danmenjelaskan pandangan Ekonomi Islam terhadap sistempengupahan pada PT. Samuderanayaka Grahaunggul.Menggunakan metodologi penelitian kualitatif dalam penelitianyang bersifat lapangan (field research) ini. Sumber datadiperoleh langsung dari lokasi penelitian yang bertempat dikantor pusat PT. Samuderanayaka Grahaunggul melaluidokumen yang berkaitan dengan permasalahan yang diteliti.Selain itu, data juga didapat melalui wawancara dengan GeneralManager perusahaan tersebutdan Manager Accounting FinanceOfficer. Setelah terkumpul dengan lengkap kemudian dianalisissecara deskriftif dimana data- data umum yang telahdikumpulkan ditarik kesimpulan secara khusus. Hasil penelitianini menunjukkan bahwa Secara umum ketentuan pengupahanperusahaan outsourcing yang diberlakukan PT. Sangu terhadaptenaga kerja outsourcing nya telah memenuhi aspek-aspekSyariah Islam, antara lain di tinjau dari perjanjian kerjanya.Karena masalah upah diputuskan oleh mereka yangmengadakan perjanjian kerja. Dalam melaksanakan perjanjiankerja, PT.Sangu memberikan kejelasan kepada tenaga kerjaoutsourcing baik dari aspek bentuk dan jenis kerjanya, masakerjanya, maupun upah yang diberikan. Sebagaimana Islamsangat menekankan dalam hal pengupahan harus dengan rasakeadilan dan tidak ada unsur kedzaliman.

Abstract

This study begins to approach the issue by applying the agency theory, moral hazards theory, and stakeholder theory, as well as the “Adverse Selection” theory by Stiglitz and weiss (1981) and “Bad Management” by Berger and Young (1997). The last two theories mainly refer to the processing part of the matter to start with, but the last one uses a concept where it is the management (of abank) that must be questioned how efficient they do their job. Management is a wide concept, and such as, which managerial factors that could affect the creation of NPL/NPF must be detailed. This study could be breakdown the three group attributes above to constitute eleven factors, i.e. credit knowledge and skills, integrity and professionalism, spirituality level, moral leadership, corporate culture, hard budget policy, reward and penalty system, credit culture, reputation checking, due diligence and care, and supervision or audit. Further this study hypothesizes that these eleven factors could affect the creation of NPL/NPF, and the creation of NPF is lower inIslamic bank than that of NPL in conventional bank, because the application of those factors is hypothesized stronger or better in the first type of bank by its management than in the second, due to its philosophy and the laws that govern. A research has been completed, employing statistical variance and F test on the data gathered from all the 28 islamics bank/banking units in existence, and 28 conventional banks. The study has concluded that all the eleven factors of the internal management can influence the creation of NPL/NPF in both banks. The study further proves that these factors, independently or as the combination of all, are applied better in Islamic bank than in conventional bank, due to the fact that the syariah concept itself not only applied in conducting the business, but also used as a moral reference in dayly working environment. As a result, theaverage level of NPF is lower in bank syariah than NPL level of conventional bank under study.
