Abstract

Sanctions for violating personal data are contained in Article 48 paragraph 2, which contains: (1) Any person who meets the elements as referred to in Article 32 paragraph 1 shall be sentenced to a maximum imprisonment of 8 years and / or a maximum fine of two billion rupiah. (2) every person who fulfills the elements as meant in Article 32 paragraph 2 is imprisonment for a maximum of 9 years and / or a maximum fine of three billion rupiah. (3) Every person who fulfills the elements as referred to in Article 32 paragraph 3 shall be sentenced to a maximum imprisonment of 10 years and / or a maximum fine of five billion rupiah. The application of criminal sanctions against perpetrators of criminal defamation of customers must actually be reactive to an act, so the focus of criminal sanctions is focused on a person's wrongdoing through the imposition of suffering (so that the person concerned becomes a deterrent). Apart from being aimed at imposing suffering on the perpetrator, criminal sanctions are also a form of condemnation of the perpetrator's actions.This research uses a typology of sociological legal research or what is also called non-doctrinal legal research, which deals more specifically with legal effectiveness. In this study the authors use the nature of descriptive research, because the author describes how Law Enforcement Against Technology-Based Lending and Borrowing Services Companies That Spread Personal Data of Debtors Who Violate Article 32 of Law Number 19 Year 2016 Regarding Information and Electronic Transactions at Polda Riau. The results of the research conducted by the author are, firstly, the implementation of law enforcement on technology-based lending and borrowing services can be more assertive, and the police should also accept all reports from victims while the report has the potential to violate applicable laws and regulations regardless of whether there are still debts, so that people also feel protected by law enforcement officials, and similar incidents will not happen again.Keywords: Fintech – Personal Data – Electronic Transactions

Abstract

Protection of human rights is a form of service that must be carried out by law enforcement officials or security forces to provide a sense of security, both physically and mentally, to victims from threats, harassment, terror and violence from any party. People with mental disorders who are shackled need special protection and handling from the government to protect their rights as humans. The government must ensure that all people with mental disorders are not shackled and cared for properly without discrimination.The purpose of this research is to find out how the juridical analysis of legal protection for victims of confinement of persons with mental disorders in the perspective of Indonesian criminal law and to find out the ideal arrangements related to legal protection for victims of confinement of persons with mental disorders in the perspective of Indonesian criminal law. The research method used in this thesis uses normative legal research methods, namely legal research that examines statutory regulations and legal principles.From the research, there are two main points that can be concluded. First, the juridical analysis of legal protection for victims of shackling of people with mental disorders in the perspective of Indonesian criminal law, namely the incompatibility between one law and another makes the government appear unfair in providing protection to victims of a criminal act of shackling. The law on mental health seems weak and even does not provide special protection to victims of shackling, there is no state interference in protecting their rights. Second, the ideal is very much in accordance with what is aspired or dreamed of or desired. The ideal arrangement must be in accordance with the aspirations of the state, namely to provide protection in accordance with what the community wants, however, the regulations related to the protection of victims of confinement are still not perfect in providing protection to them. Author's suggestion, First, given the poor conditions experienced by victims of shackling, special protection is needed for victims of criminal acts of confinement of people with mental disorders through a clearer legislation.Keywords : Victims, Shackles, People with Mental Disorders

Abstract

Indonesian Criminal Law only recognizes two types of crimes, namely basic crimes andadditional crimes. Chemical castration is included in additional penalties in Indonesia which areregulated in Law Number 17 of 2016 concerning Stipulation of Government Regulations in Lieu ofLaw Number 23 of 2002 concerning Child Protection which provides weighting and additionalcriminal penalties for perpetrators of sexual violence against children as regulated in article 81paragraph 7 that "The perpetrators as intended in paragraphs (4) and (5) may be subject to chemicalcastration and the installation of electronic detectors. For example, the case of Muhammad Aris (21years) sexually abused 9 children in Modjokerto. Chemical castration has not been carried out becauseof rejection from the National Human Rights Commission (Komnas HAM) expressing its disapprovalbecause it is contrary to human rights as written in the 1945 Constitution of the Republic of IndonesiaArticle 28G paragraph 2 which reads "Everyone has the right to free from torture and treatmentdegrading human dignity ”. The purpose of this study is to determine additional criminal regulationsfor chemical castration in several countries, to find out additional criminal penalties for chemicalcastration in the perspective of human rights in Indonesia, and to find out normative alternativesolutions to the problem of chemical castration in Indonesia which are regulated in GovernmentRegulation Number 70 of 2020 concerning Tata How to Perform Chemical Castration.In this study the author focuses on normative legal research on comparison of law with thedata sources used are secondary data and data collection techniques for normative legal research usethe literature review method and use descriptive analysis which provides a description of the object ofresearch based on data obtained from the subject under study.From the research results, it can be concluded that there are several countries in the world thathave imposed chemical castration punishment but in practice it is still not effective. The imposition ofadditional chemical castration punishment aims to reduce the number of sexual crimes and provide adeterrent effect on perpetrators of sexual crimes against children. However, it is contrary to humanrights as written in the 1945 Constitution Article 28G paragraph 2. By providing additionalpunishment for chemical castration, imposing maximum imprisonment, fines and rehabilitation as wellas providing counseling guidance while in a correctional institution and conducting supervision whenthe convict is free. The author's suggestion is to all countries in the world that have imposed physicaland chemical castration penalties to be more selective in diagnosing what crimes the castrationpunishment can apply to. Also, law enforcers in imposing castration penalties should consider theperpetrators' human rights more and implement alternative solutions that have been made.Keywords: Additional Crime-Chemical Castration-Human Rights

Abstract

Bagi pelaku usaha mikro kecil dan menengah (UMKM) untuk memulai usahanya perlu memikirkan perlindungan Hak Kekayaan Intelektual (selanjutnya disebut HKI). Jikalau, para pelaku usaha mikro kecil dan menengah (UMKM) tidak memikirkan perlindungan HKI, maka karya para pelaku usaha dapat mudah terjadi pelanggaran HKI. Oleh karena itu, pada masa awal memulai bisnisnya, mereka seharusnya sudah memberikan perlindungan HKI-nya, sebab HKI sejatinya dapat menjadi aset berharga yang bisa menyelamatkan perusahaan di masamasa sulit. HKI sejatinya adalah hak yang muncul dari hasil oleh pikir atau kreasi manusia yang pada akhirnya menghasilkan suatu produk atau proses yang berguna bagi manusia. Dalam dunia bisnis, HKI bisa menjadi elemen penting karena dapat memberikan keunggulan berkompetisi ketika bermain di pasar yang dibidik bagi pemiliknya. Bahkan, tak menutup kemungkinan pula HKI ini dapat menjadi pemicu untuk memunculkan berbagai inovasi baru bagi pelaku usaha mikro kecil dan menengah (UMKM) yang pada akhirnya dapat menguntungkan publik juga para pelaku usaha itu sendiri, misalnya dalam menghadapi perdagangan bebas ASEAN. Tujuan dilaksanakan kegiatan pengabdian masyarakat ini adalah sosialisasi aspek HKI bagi para pelaku UMKM di Kabupaten Kampar. Metode penerapan yang dipilih adalah sosialisasi atau desiminasi ilmu pengetahuan, dalam hal ini adalah penyebaran informasi tentang HKI dan tata cara pendaftaran HKI. Dari kegiatan pengabdian ini, pelaku usaha UMKM di Kabupaten Kampar menyadari penting aspek HKI untuk kemajuan usaha.
