Abstract

During the pandemic of Covid-19, cases of domestic violence (KDRT) in Indonesia increased. This is because the people experience stress during the pandemic. The stress arises due to the implementation of Large-Scale Social Restrictions (PSBB) set by the Government.  In the PSBB period, all normal activities were disrupted, and even affected the economic situation of the community. Accordingly, the researcher discusses the following research problem: The form of legal protection for victims of domestic violence during the Covid-19 pandemic and the factors influence the increase in domestic violence during the pandemic of covid-19. This study employed normative juridical approach. The legal materials in this study were derived from statutory regulations, books, other scientific works, or dictionaries. In conclusion, to impose Large-Scale Social Restrictions (PSBB), the Regional Government needs to review the impact of PSBB on the family. Accordingly, this research is expected to provide an understanding to the public relates to the form of legal protection for everyone who experiences domestic violence during the pandemic. This is stipulated in Law No.23 of 2004 concerning the elimination of domestic violence and the factors influence the domestic violance

Abstract

 Globalization is something that cannot be avoided by humans in the world, including Indonesia. It can be said that because in fact, people's life in Indonesia has entered the digital era. This is due to technological advances and the use of the internet that make it easier for people to carry out their activities in any field. However, it is likely that a problem or dispute will occur due to the legal relationship that occurs online. With the existence of these disputes, the number of disputes that must be resolved becomes large and still must obtain a good resolution legally as well as face-to-face between the parties and the third party or the judge. Given the increasingly sophisticated technology, it does not rule out that technology or social media can be used to resolve a dispute or what is often referred to as Online Dispute Resolution (ODR) and online arbitration is included in it. Online arbitration was indeed carried out during the current Covid-19 pandemic. Therefore, the author wants to examine how certainty or legal basis and how to proceed online arbitration

Abstract

This research aims to know and understand the form of default by the seller to the buyer in the online buying and selling contract, as well as to know and describe the legal protection for buyers in the event that the seller defaults on the online buying and selling contract. type of normative juridical research with a statute approach and conceptual approach Data collection from secondary materials is carried out by library method and analyzed using qualitative methods. The result of this research is the occurrence of default by the seller to the buyer in the online sale and purchase contract due to the non-fulfillment of obligations by the seller, causing losses to the buyer. The seller breaks the promise as written in the contract. The seller's right is to receive payment according to the agreed price and time, while the seller's obligation is to deliver goods or services according to the agreement. The forms of default in online buying and selling agreements, viewed from the seller's side, include sending goods but not in accordance with what has been agreed upon and the absence of accountability. The form of prevention taken is what has actually been regulated in the UU-ITE, KHUPer, PP and other laws and regulations as a form of legal protection for consumers. As a form of understanding and knowing the legal protection of consumers who default on transaction users through online media focuses on legal settlements against default of transaction users through online media.
