Abstract

Pasal 53 ayat (1) KHI : “Seorang wanita hamil di luar nikah, dapat dikawinkan dengan pria yang menghamilinya.” Secara gramatikal adanya Pasal 53 ayat (1) KHI bila ditafsirkan akan berdampak bahwa lelaki yang bukan menghamili wanita yang telah hamil di luar nikah juga dapat menikahi wanita yang hamil tersebut. Hal ini berdasarkan kata “dapat” dalam bunyi Pasal 53 ayat (1) KHI. Oleh sebab itu lelaki yang bukan bapak si anak tersebut, konsekuensi hukumnya terhadap hubung an  keperdataan  anak  berdasarkan  bunyi  Pasal  53  ayat  (1) KHI,  terikat  secara  hukum  dan  memiliki  hubungan  keperdataan dengan  anak  tersebut  secara  langsung,  akibat  perkawinan  ibunya, walau pun lelaki tersebut bukan bapak biologis dari si anak tersebut. Berdasarkan uraian di atas dan adanya putusan Mahkamah Konstitusi Nomor  46/PUU-VIII/2010  tentang  dihapusnya  Pasal  43  ayat  (1) UU Perkawinan dan adanya Pasal 53 ayat (1) KHI telah membuka angin  baru  bagi  pengakuan  keperdataan  anak  hasil  perkawinan  di bawah tangan dan hasil perkawinan wanita hamil dengan lelaki yang tidak menghamilinya.

Abstract

This study aims to compare the concept of property rights in the perspectives of Islam, capitalism, and socialism in order to understand the fundamental differences and their implications in the economic and legal systems. The method used is normative juridical research with a comparative law approach. Data were obtained through a literature study that included religious literature, economic theory, and related regulations. The results showed that in Islam, property rights are individual but limited by social interests and justice. Capitalism emphasizes private ownership without significant restrictions, while socialism emphasizes collective ownership for the sake of social equality. This comparison reveals that the Islamic system offers a balance between individual ownership and the public interest, in contrast to the extreme approaches of capitalism and socialism. Therefore, the concept of property rights in Islam has the potential to become a fairer alternative model for resource management.

Abstract

This study aims to analyze the concept of investment in the Islamic perspective and the principles that distinguish it from conventional investment. The method used is qualitative with a normative-descriptive approach, through a literature review of Islamic law, fatwas from scholars, and sharia investment regulations. The results show that investment in Islam must be based on the principles of fairness, transparency, and freedom from the elements of usury, uncertainty, and chance. Investment instruments that are sharia-compliant include sharia stocks, sukuk, and mudharabah, which emphasize the fair distribution of risk and profit. This study emphasizes that sharia-based investment is not only oriented towards financial gain, but also pays attention to the ethical aspects and the interests of the community, thus creating a more stable and equitable economic system.
