Abstract

Contract of sale t is the most commonly used agreement in the business world. The agreement is basically expected to take place fairly, well and proportionally as agreed between the parties. However, in reality, especially for commercial contracts, the fulfillment of contracts is not always smooth, the delays that occur are not only due to delays from one party, but also due to the intentional actions of the other party who have defaulted beforehand. Exceptio non adimpleti contractus is a form of denial of allegations of default. This research is used to find out how to regulate exceptio non adimpleti contractus in Indonesian regulations and what are the legal consequences of implementing exceptio non adimpleti contractus in buying and selling cases. In this study the type of research used is normative juridical research, while the issues discussed, raised and described in this study focus on the application of rules or norms in positive law. Based on the research results, the principle of Exceptio non adimpleti contractus has been regulated in Book III Article 1478 of the Civil Code and Jurisprudence such as the decision of the Supreme Court Number 156 K/SIP/1955. The legal consequence of the application of exceptio non adimpleti contractus is that the claim made by the plaintiff is threatened not to be continued because it is contrary to the principles and rules of the applicable civil procedure so that the lawsuit is not perfect

Abstract

In 2019 Indonesia was hit by Covid-19 which caused many activities to be limited to crowding, both schools, offices and worship activities so that each of us is required to continue to adapt to existing conditions, one of which is worshiping by singing spiritual songs virtually. Where nowadays singing or using songs virtually can be categorized as copyright infringement, as in the case between IUP and the church regarding spiritual songs sung via youtube streaming which is considered as the use of IUP's creations and the church is obliged to pay the investment value for the song. which is used as royalty payments, in this study it is expected to be able to answer the problem with the Library method by looking at the legislation and other legal materials, so that we can answer the problem of using a work that can be categorized as a copyright infringer if it meets several elements and can be subject to royalties with the provisions which is regulated in law number 28 of 2014. So that it can create maximum legal protection for copyright.

Abstract

This research was conducted by looking at the phenomenon that occurred in Muarabaru Village, Cilamaya Wetan District, Karawang Regency where illegal land management occurred by the local community. This study uses a qualitative method with an empirical juridical approach by observing phenomena that occur in the field. The issues raised are how the legal concept of land ownership and control arises in Muarabaru Village, Karawang Regency and how legal protection for land ownership and control status arises in Muarabaru Village, Karawang Regency. This research resulted in findings in the form of raised land which is land that occurs as a result of erosion processes on the coast and management must be carried out by the state or government, even the government has the right to take back illegal management by the community, deviations occurred in Muarabaru Village where the previous village head had issued A village letter that grants land management permits to the community arises and this clearly violates the law.

Abstract

Pasar tradisional merupakan suatu pusat perbelanjaan yang dimana bertemunya para penjual dengan para pembeli yang melakukan transaksi jual beli yang berbentuk barang maupun jasa. Penataan pasar sangatlah penting bagi keberlangsungan aktivitas yang dilakukan oleh semua manusia. Di Indonesia masih banyak pasar yang belum tertata rapih dan tidak sesuai dengan amanat undang-undang dan perda setempat, termasuk di daerah Kabupaten Karawang, Pasar Tradisional Rengasdengklok merupakan salah satu pusat perbelanjaan yang lumayan besar yang sampai saat ini belum tertata rapih. Keadaan itu sangan mengganggu aktivitas pengguna jalan raya karena di sepanjang jalan Rengasdengklok banyak pedagang yang berdagang hampir menggunakan sebagian badan jalan. Oleh sebab itu, menjadi tanggung jawab pemerintah daerah atau pengelola pasar untuk memastikan bahwa pasar diatur sedemikian rupa sesuai dengan Peraturan Bupati Karawang No. 75 tahun 2012, yang berkaitan dengan peraturan dan ketentuan untuk pasar konvensional, mal, dan toko kontemporer, dan juga mengacu pada Peraturan Daerah Kabupaten Karawang No. 6 tahun 2011. Kata kunci: Pasar, Pemerintah, Relokasi.
