Abstract

This paper examines Constitutional Court’s authority to review ratification acts according to UUD 1945. The problems of Constitutional Court’s authority to review ratification acts could be analyzed in Constitutional Court’s decisions on Ratification of ASEAN Charter. Although Constitutional Court has authority to review the ratification acts as seen in Constitutional Court’s decisions, there is no clear rules in Constitution which regulates any legal position and legal form of ratification acts and international treaties. The lack of clarity in the rules may cause problems concerning on the clarity of the Constitutional Court’s authority to review ratification acts in future. This paper is a literature research and it aims to find that the Constitutional Court has the authority to review ratification acts according to UUD 1945, but it does not have authority to review the substance and content of international treaties which are contained in the annex of ratification acts. The authority to review ratification acts is limited in determining the constitutionality of ratification of an international agreement through the ratification acts.

Abstract

This research discusses the effect of shifting the function and the state of the Village Consultative Body according to Law No. 6 of 2014 on Village. The study particularly took an observation in Kunjang Village. The used method in this paper is normative research which applies legislation approach and historical approach. The final conclusion resulted by this research is the shift of function and the state of the Village Consultative Body had influenced the state of the Village Consultative Body Kunjang. First, the state of the Village Consultative Body Kunjang is no longer an element of village administration and as a "partner" of the headman. Second, the monitoring function becomes the only main function of the state of the Village Consultative Body Kunjang, whereas the legislative function becomes the duty of the Kunjang Village Government, stressing that the legislative function is not part of the main duty and responsibility of the Village Consultative Body Kunjang.

Abstract

After the amendment, the constitutionality of human rights was realized in chapter X article 28A-28J, which shows that Indonesia is increasingly upholding human rights values with the transformation of these rights in the constitution. However, this is still debatable about the provision of non-derogable rights (Article 28I) and human rights limitation (Article 28J). Human rights that could be limited is human right which is categorized in derogable right. The problem is the failure to distinguish between human rights which its implementation could be limited and vice versa. This condition is exacerbated by systematic and conceptual errors in chapter X of the 1945 Constitution, which can cause problems in applying the provision of human rights restrictions, and in implementing the interpretation of the human rights restrictions by Constitutional Court. This paper used normative legal research with literature research. This paper find that that the implementation of human rights limitation in Indonesia has not been in accordance with the theories and principles of human rights law and is carried beyond the supposed.

Abstract

Dalam struktur kenegaraan, partai politik dan organisasi sayap partai politik memiliki hubungan yang tidak dapat dipisahkan. Tulisan ini membahas dua pokok permasalahan. Pertama, bagaimana eksistensi dan peranan organisasi sayap partai politik dalam struktur kepartaian, termasuk permasalahan yang muncul akibat hubungan antara partai politik dengan sayap partai politik tersebut. Kedua, bagaimana pertanggungjawaban pelanggaran pemilu dan pertanggungjawaban hukum organisasi sayap partai politik kepada partai politik. Kesimpulan dari tulisan ini adalah pertama, perlu dilakukan perubahan terhadap partai politik sebagai induk dari sayap partai politik agar eksistensi dan peran sayap partai politik yang ideal dapat diwujudkan. Kedua, partai politik dapat membubarkan sayap partai politik apabila anggota sayap partai politik melakukan pelanggaran pemilu ataupun pelanggaran hukum lain, namun sayap partai politik tidak dapat dimintakan pertanggungjawaban secara hukum seperti halnya partai politik karena belum adanya pengaturan dan status hukum yang jelas tentang organisasi sayap partai politik.

Abstract

Purpose: The issue of the limited amendment to the 1945 Constitution (UUD 1945) was rolling again during the unfinished pandemic in Indonesia. The idea to carry out the limited amendment to the 1945 Constitution on a limited basis was in line with the issue of extending the Presidential term to three terms and the issue of adding the authority of the MPR to form the Basic Principles of State Policy (PPHN). Conceptually, it is possible to amend the 1945 Constitution as the constitution of the State of Indonesia. However, the problem that arises is whether the amendment to the 1945 Constitution is something that is very important and urgent to be carried out at this time, especially when Indonesia is still in a pandemic condition? To answer these problems, this study intends to explain the concept of amendments to the 1945 Constitution and analyze the urgency of implementing the amendments to the 1945 Constitution during this pandemic. Method: This paper uses library method with secondary data in the form of library materials as the main data. Result: The results of the study, there is no important and urgent matters for the implementation of the fifth amendment to the 1945 Constitution during a pandemic, so that the fifth amendment to the 1945 Constitution, especially during the pandemic, is not appropriate to be implemented. Limitations: The limitation of this paper is that it only focuses on the urgency of limited amendments during the pandemic with two main issues. Contribution: The expected contribution of this paper is to provide a legal review of the issue of the limited amendment of the 1945 Constitution during the pandemic.
