Abstract

Abstrak Diversi ini sendiri sangat erat kaitannya dengan tujuan konsep restoratife justice, konsep restorative justice ini sendiri menekankan kepada pemulihan kembali seperti pada keadaan yang semula dan bukanlah sebuah pembalasan. Hal ini sangat berkaitan sekali dengan konsep diversi yang dimana konsep diversi ini yang berusaha mengalihkan segala proses penyelesaian perkara pidana yang dilakukan oleh anak ke luar pengadilan formal, sebagai upaya pengalihan kembali bagi seorang anak pelaku tindak pidana terhadap korban dan masyarakat dan bukan dengan sebuah pembalasan.Kata kunci: anak, penyelesaian perkara, diversi, tindak pidana Abstract Diversion itself is very closely related to the goal of the concept of restorative justice, the concept of restorative justice itself emphasizes the recovery as in the original state and is not a retaliation. This is very much related to the diversion concept in which this diversion concept tries to divert all the settlement of criminal cases committed by the child out of the formal court, as an attempt to transfer back to a child the perpetrator of a crime against the victim and the community and not a retaliation.Keywords: child, case settlement, diversion, criminal act
