Abstract

The social reality of society always suggests differences, especially differences in the ability of financial or economic. There are high-income earners who are often known as rich, and there are also those who have low income who are known as poor or underprivileged. As a response to this reality, this paper specifically tries to offer a solution in the form of a buying and selling transaction model that is easily accessible to the underprivileged, to fulfill household needs. With the descriptive analysis method, this paper found a solution in the form of a mindring through the process of verification of Muamalat Fiqh, to measure the ability of these solutions practiced by the community. The results of this study indicate that selling and buying with mindring models provide solutions for people who are less able to fulfill household needs. In addition to the elements of the existing convenience, mindring offers as a solution is also due to ability in Muamalat Fiqh, as long as the practice does not violate the terms defined by Islamic law.

Abstract

Percakapan tentang fikih selama ini cenderung bertumpu pada ibadah-ibadah ritualistik yang menekankan pada relasi vertikal daripada horizontal. Akibatnya, fikih menjadi sedemikian monoton dan terkesan tidak memiliki keterkaitan khusus dengan kepentingan sosial-ekonomi. Penyempitan atas makna fikih inilah, antara lain, yang menjadi kegelisahan Sahal Mahfudh dalam menggagas konsep fikih di luar mainstream pandangan orang, ialah “Fikih Sosial”. Berdasarkan alasan tersebut, tulisan ini mengulas konstruksi Fikih Sosial Sahal Mahfudh serta bagaimana relevansinya dengan konsep ekonomi syariah. Jenis penelitian ini adalah library research, menggunakan pendekatan deskriptif-analitik dengan metode komparasi atau perbandingan. Penelitian ini menyimpulkan, bahwa gagasan fikih sosial menempatkan dimensi sosial-ekonomi pada posisi sentral sebagai lahan garapannya. Bagi Sahal Mahfudh, kemaslahatan, keadilan dan kesejahteraan adalah cita-cita ideal Islam yang harus terwujud dalam aktivitas ekonomi. Sahal Mahfudh memang tidak banyak menyinggung term "ekonomi syariah" dengan segala derivasinya dalam gagasan fikih sosial, namun nilai-nilai dasar ekonomi syariah sebagaimana yang dirumuskan oleh ekonom dan cendekiawan muslim praktis terejawantah dalam aksi-aksi sosialnya yang nyata. Di sini letak relevansi keduanya berada. Fikih sosial patut dijadikan bahan refleksi bersama, bahwa ekonomi syariah tidak akan dapat mewujudkan kemaslahatan tanpa aksi-aksi sosial yang konkret.

Abstract

Islamic banks in carrying out their financial activities use contracts in classical muamalat fiqh, including mudharabah contracts. The mudharabah contract which initially only brought together two parties, namely the owner of capital and the manager of capital, has now undergone a change in practice in Islamic banks. Mudharabah contracts in Islamic banks currently involve three parties, the owners of capital, the bank and the borrower of capital. This pattern of contracts involving three parties is called multilevel mudharabah. Based on these reasons, this study will discuss what and how the implementation of multilevel mudharabah in Islamic commercial banks. This research is a research qualitative with a juridical-normative approach. This study concludes that multilevel mudharabah is a form of mudharabah that occurs between three parties. The first party is the shahibul maal, the second party is the intermediate mudharib, and the third party is the final mudharib. In this contract, the bank has a dual role, namely as mudharib as well as shahibul mal. As mudharib, the bank manages the funds deposited by the depositor to seek profit. Meanwhile, as shahibul mal, the bank distributes these funds to mudharib for further management. If you look at the above understanding of the practice of this multilevel mudharabah contract, namely, when the depositor or shaahibul mal saves their funds with a mudharabah contract with a sharia bank, this practice refers to the mudharabah mutlaqah principle, there are no restrictions for banks in using the funds raised.
