Abstract

Criminal systems that are restorative Justice must be the priority of the judge in making decisions. Placing a child in prison is always the last choice and with the shortest possible period of time. Placing children in institutions that have social benefits and functions as well as improvements for children, Children have the potential for growth in the future, so that children should be given guidance, care, education, and protection, as well as skills, both physically, mentally, and socially . Therefore a child who commits a crime is required by a child-only court. The child punishment system must pay attention to the interests of the child and in accordance with the standards of value and treatment of a number of national and international instruments. Diversion and the concept of Restorative justice need to be taken into consideration in handling child cases. This concept involves all parties in order to improve children's morale so that they do not repeat their actions anymore, and children do not feel like a prisoner that affects the child's mental development.

Abstract

By Law Number 1 of 1974, a valid marriage is a marriage that is carried out based on religion and belief. The Petitioners in the Itsbat case No.55/Pdt.P/PA.PO/2021 applied the determination of their marriage in 1994. This study aimed to determine the validity of the substitute nasab guardian in the applicants' marriage. The result of this study is a juridical analysis of the consideration of the Panel of Judges which ignores the existence of a substitute nasab guardian without the permission of the Religious Court in case No. 55/Pdt.P/PA.PO/2021 is valid. Based on the principle of civil procedural law, the judge is passive, which means that the judge may not make a decision beyond what the petitioners demand. The maqashid sharia analysis of the consideration of the Panel of Judges who ignores the existence of a substitute nasab guardian without the permission of the Religious Courts in case No.55/Pdt.P/PA.PO/2021 is by the Hifzh An-Nasl principle, which protects the descendants of the applicants' marriages to get legal protection when something unexpected happens. Sesuai dengan Undang-Undang Nomor 1 Tahun 1974, Perkawinan yang sah adalah perkawinan yang dilaksanakan berdasarkan agama dan kepercayaannya. Para Pemohon dalam perkara Itsbat No.55/Pdt.P/PA.PO/2021 mengajukan permohonan penetapan perkawinan mereka yang telah terjadi pada tahun 1994 Tujuan dari penelitian ini adalah mengenatahui keabsahan wali nasab pengganti pada perkawinan para pemohon. Hasil dari penelitian ini adalah analisis yuridis terhadap pertimbangan Majelis Hakim yang mengabaikan adanya wali nasab pengganti tanpa izin Pengadilan Agama pada perkara No.55/Pdt.P/PA.PO/2021 adalah sah. Berdasarkan asas hukum acara perdata yaitu hakim bersifat pasif, yang berarti bahwa hakim tidak boleh menjatuhkan putusan melebihi yang dituntut para pemohon. Analisis maqashid syariah terhadap pertimbangan Majelis Hakim yang mengabaikan adanya wali nasab pengganti tanpa Izin Pengadilan Agama pada perkara No.55/Pdt.P/PA.PO/2021 sesuai dengan asas Hifzh An-Nasl yakni menjaga keturunan hasil perkawinan para pemohon agar mendapat perlindungan hukum ketika suatu saat terjadi hal-hal yang tidak diinginkan.
