Direct Pilkada as a democratic event often presents problematic regional heads, be it the head of the corruption suspect who was re-elected or the regional head who only won because of his high level of popularity but lack of quality. In the end, many problems in the regions are often not resolved. Regional autonomy, which is expected to be able to produce more developed and quality regions, is collided with the reality and the will of the people who still do not clearly understand the meaning of direct democracy itself. The concept of an asymmetric regional head election system is one solution to overcome this problem. Currently, the asymmetrical system for regional head elections is already in operation, however, it is only applied to a number of regions with special labels. Asymmetrical implementation of Pilkada needs to be applied to all regions in Indonesia. As an indicator in the asymmetric concept, stability in economic growth before the implementation of regional elections or the democracy index can be used to measure the quality of democracy in a region. The research method in this article is normative juridical. The conclusion in this article is that an asymmetrical regional head election system needs to be done to create a more effective regional government.

Era disrupsi atau era serba teknologi merupakan era yang merubah kehidupan manusia menjadi serba digital. Pemerintah sebagai pelaksana organ negara dituntut untuk memberikan kepastian hukum manakala terjadi perubahan pada sejumlah aspek yang disebabkan perubahan teknologi. Namun, peraturan perundang-undangan yang diterbitkan oleh Pemerintah kerap kali bertentangan dengan Undang-Undang lainya, hal itu disebabkan proses pembentukan Undang-Undang yang tercantum dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan memerlukan waktu yang lama, padahal masyarakat menginginkan kepastian hukum yang segera. Oleh karena itulah penyederhanaan pembentukan peraturan Undang-Undang sangat diperlukan di era revolusi industri 4.0. Rumusan masalah dalam penelitian ini adalah bagaimanakah penyederhanaan proses pembentukan Undang-Undang sebagai upaya pemenuhan kebutuhan masyarakat atas hukum di era disrupsi. Tujuan dari penelitian ini adalah untuk menganalisis penyederhanaan proses pembentukan Undang-Undang sebagai upaya pemenuhan kebutuhan masyarakat atas hukum di era disrupsi. Metode penelitian dalam artikel ini adalah yuridis normatif. Hasil penelitian ini menjelasakan bahwa penyederhanaan pembentukan Undang-Undang perlu untuk dilakukan dengan cara perubahan pada sejumlah Pasal dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentuka Peraturan Perundang-undangan.

Pelaksanaan Pemilu serentak yang dilakukan pada tahun 2019 berpotensi untuk melanggar sejumlah hak konstitusional baik itu hak warga negara ataupun partai politik. Hak yang dilanggar adalah hak yang terkait dengan hak untuk mengusung calon presiden bagi partai politik baru dan hak untuk menentukan calon presiden yang berkontestasi bagi pemilih. Kebingungan ini disebabkan Putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 tidak menyebutkan secara detil mekanisme pelaksanaan pemilu secara serentak. Kondisi itu menyebabkan pembuat Undang-Undang berinisiatif mengkombinasikan pemilu serentak dengan ambang batas pencalonan presiden (Presidential Threshold), tetapi penerapan kombinasi antara pemilu serentak dan ambang batas pencalonan presiden berpotensi untuk melanggar hak konstitusional warga negara dan partai politik baru. Artikel ini mencoba untuk melihat seberapa banyak jumlah warga negara yang berpotensi untuk dilanggar hak konstitusionalnya dengan adanya ketentuan ini dan bagaimana hak konstitusi tersebut dilanggar dengan kedok kebijakan hukum terbuka (Open Legal Policy).

This paper aims to examine the phenomenon of the decline of voters in Islamic ideology in Indonesia. Indonesian history notes that Islamic Political Parties have triumphed in political circles with their ability to impose fierce debates against nationalist groups and religions other than Islam when discussing constitutional changes. The endless debate then forced President Soekarno to issue a presidential decree. The sweet history of Islamic Political Parties began to decline when the regime of the New Order government fused authoritatively and caused no more unity of opinion in the Islamic party. At present, Islamic ideology political parties also have a tendency to turn to the Cacth All Party, which is considered more profitable and provides wider opportunities to gain power. This paper aims to prove the changing behavior of voters of Islamic political parties in the history of Indonesia's political configuration.

The decision of Indonesian Constitutional Court No. 100/PUU-XII/2015 legitimizing single candidate give solution for democracy deadlock in some regions.Based on that decision, The Election Commission make a regulation giving alternative for some regions having only one candidate for choosing the picture of candidate against empty box.These battle in the beginning seems not fair because of political intention, empty box has no resources to compete with candidate. But, in the local election 2018, in some regions, empty box success to gain more voters than his rival. Winning of empty box in contestation of democracy became a proof that people feel tired because the system of regeneration in political parties not running well, other proof that single candidate that bring up by all political parties not always supported by voters. In the Indonesia constitutional law, the phenomenon of empty box surely implicate tomany problems. This writing will try to see this phenomenon and its implication according to Indonesian constitutional law.

Pancasila and Islam are two ideologies that are often seen as different. This can be seen from the history of the Indonesian state administration where it is recorded that Pancasila was used as a tool for the Government to dissolve organizations and parties with Islamic nuances, namely Masyumi and HTI. The contradiction was caused by the Government placing Pancasila as part of legal norms, not values. Even though the consequence of placing Pancasila as a legal norm should be that there should also be an agency authorized to conduct trials. However, unlike other legal norms, there is no single institution that has the authority to test Pancasila. In addition, according to experts, Pancasila is a building of values which is the way of life of the Indonesian people. The research method in this article is normative juridical. The result states that Pancasila should be positioned as a value, not as a legal norm.
