Abstract

Mahkamah Agung sebagai penyelenggara peradilan tertingi di Indonesia telah menggagas beberapa metode untuk mempersingkat proses penyelesaian sengketa di pengadilan namun dapat memberikan hasil yang lebih optimal. Salah satu gagasan yang cukup progresif antara lain dengan mengoptimalkan lembaga mediasi pada perkara-perkara perdata. Pengadilan Agama telah menerapkan mediasi pada setiap perkara yang yang bersifat contensius, tidak terkecuali perkara perceraian. Meskipun ketentuan tentang mediasi telah diatur, dalam kenyataan dilapangan belum berjalan dengan maksimal, pelaksanaan upaya perdamaian melalui mediasi hanya berupa formalitas di persidangan jika mediasi tidak dilaksanakan dengan iktikad baik, maka gugatan dinyatakan tidak dapat diterima oleh Hakim Pemeriksa Perkara. Hal ini dikarenakan tujuan mediasi adalah untuk mencapai kata sepakat kedua belah pihak antara suami dan istri dengan berpedoman pada tujuan perkawinan yaitu terciptanya keluarga sakinah mawaddah wa rahmah, selain terhindar dari perceraian yang merupakan perbuatan yang di bolehkan namun dibenci Allah SWT. Agar proses mediasi lebih optimal dan berhasil menemukan kata mufakat dan berdamai, hakim mediator Pengadilan Agama melakukan upaya-upaya agar mediasi berhasil. Keberhasilan mediasi dapat dilihat dari efektifitas pelaksanaan mediasi yang bertumpu pada upaya dan profesionalitas hakim mediator dalam melaksanakan proses mediasi (keahlian di bidang hukum formil dan hukum materil, dan juga keahlian di bidang psikologi), Mediasi dilakukan diruangan tertutup agar tidak diketahui oleh orang lain, melakukan kaukus, Memberikan solusi bagi permasalahan yang mereka hadapi dan Hakim mediator harus tampil sebagai sosok teman dan sosok penengah yang tidak berpihak pada salah satu pihak.

Abstract

This paper examines the involvement of women in corruption in Indonesia. Today people who commit corruption no longer recognize gender. The perpetratorsare of corruption are no longer men, but also the perpetrators are women. The number is not as much as men, but the number is increasing from year to year, with various professionals backgrounds. Even sadly, women are objects of gratification to facilitate affairs. Based on this, by researching normative law, and using a statutory approach as well as a conceptual approach. The results of the study indicate that women who occupy strategic positions are able to be a balancer because women have more sensitive to taste, refinement of mind, and can play a central role with its natural nature. Corruption is an immoral act that is used to carry out actions with institutional integrity standards. Increased involvement of women not as victims of corruption but as agents of change involved is very important to solve problems. But on the other hand, it is known that the factors that cause corruption can be seen from factors that come from within the perpetrators of corruption, but can also come from outside the perpetrators. Prevention of corruption can be done by means of the extent to which anti-corruption values can be internalized within oneself and changes through an integral approach to fighting corruption.
