Abstract

ABSTRAKPenelitian ini mengkaji permasalahan mengenai argumentasi hakim dalam menjatuhkan pidana yang lebih ringan terhadap penolakan alasan permohonan kasasi Penuntut Umum dan Terdakwa dalam perkara mengajak anak bersetubuh berdasarkan Pasal 253 KUHAP. Penelitian ini merupakan penelitian hukum normatif. Teknik pengumpulan bahan hukum dalam penelitian ini adalah studi kasus. Bahan hukum yang diperoleh kemudian diolah menggunakan metode silogisme deduktif. Pasal 253 ayat (1) KUHAP menentukan alasan kasasi yang diperbolehkan, sehingga argumentasi hakim dalam menolak alasan permohonan kasasi didasarkan ketentuan tersebut.Kata Kunci: Kasasi, Perlindungan Anak, Argumentasi Hukum ABSTRACTThis study examines the problems regarding the arguments of judges in imposing lighter sentences on the refusal of reasons for the appeal of the Public Prosecutor and the Defendant in the case of inviting children to intercourse under Article 253 of the Criminal Procedure Code. This research is normative legal research. The legal material collection technique in this study is a case study. Legal materials obtained are then processed using deductive syllogism methods. Article 253 paragraph (1) of the Criminal Procedure Code determines the reason for the cassation that is permissible, so that the judge's argument in rejecting the reason for the appeal is based on that provision.Keywords: Cassation, Child Protection, Legal Argument
