<![CDATA[ABSTRAKPenelitian ini bertujuan agar dapat mengetahui kesesuaian pertimbangan Hakim dengan ketentuan Pasal 183 jo Pasal 193 Ayat (1) KUHAP mengenai hadirnya saksi verbalisan dalam sidang tindak pidana narkotika. Metode yang digunakan dalam penelitian hukum ini ialah normatif yang bersifat preskriptif dan terapan. Pengumpulan bahan hukum dengan studi pustaka bersumber bahan hukum primer dan sekunder. Teknik analisis bahan hukum menggunakan metode deduktif silogisme, menggunakan premis mayor dan premis minor dari kedua premis tersebut kemudian diambil konklusi. Hasil penelian adalah keterangan Saksi Verbalisan dipertimbangkan hakim sebagai alat bukti ptunjuk dalam menjatuhkan putusan telah sesuai dengan ketentuan Pasal 183 Jo Pasal 193 Ayat (1) KUHAP dengan diperolehnya lebih dari dua alat bukti yang sah dan meyakinkan sehingga para Terdakwa terbukti bersalah melakukan tindak pidana narkotika dan dipidana penjara masing-masing selama 6 tahun dan denda Rp.1.000.000.000,-subsidair pidana penjara selama 6 (enam) bulan.Kata Kunci: Saksi Verbalisan, Pertimbangan Hakim, Narkotika ABSTRACT The purpose of thi study was determine the suitability of the Judges' considerations with the provisions of Article 183 Jo Article 193 Paragraph (1) of the Criminal Procedure Code regarding verbal witnesses in narcotics crime trials. The method used in this legal research is prescriptive and applied normative. Collection of legal materials with literature study sourced from primary and secondary legal materials. Legal material analysis technique uses the syllogistic deductive method, using the major premise and the minor premise of the two premises then conclusions are taken. The result of the study is that the statements of the Verbalisan Witness were considered by the judge in passing the verdict in accordance with the provisions of Article 183 Jo Article 193 Paragraph (1) of the Criminal Procedure Code by obtaining more than two valid and convincing evidences so that the Defendants were proven guilty of committing narcotics and being sentenced to prison respectively. each for 6 years and a fine of Rp. 1,000,000,000, -subsidair imprisonment for 6 (six) months.Keywords: Verbal Witness, Consideration of Judges, Narcotics]]>
