<![CDATA[ABSTRAKPenelitian ini bertujuan untuk mengetahui pertimbangan Hakim Pengadilan Militer II-11 Yogyakarta dalam menjatuhi hukuman terhadap Terdakwa tindak pidana Desersi. Jenis penelitian adalah penelitian Hukum normatif dengan sumber bahan yang digunakan yaitu bahan hukum primer dan sekunder. Teknik pengumpulan bahan hukum dilakukan dengan studi pustaka, menggunakan pendekatan kasus dan analisis bahan hukum dengan metode silogisme dan interpretasi dengan pola berfikir deduktif. Berdasarkan hasil penelitian diketahui persidangan tindak pidana Desersi yang diputus oleh Pengadilan Militer II-11 Yogyakarta dengan Nomor putusan 24-K/PM II-11/AD/IV/2018 atas nama Terdakwa Sumardi berpangkat Serda NRP. 638139 yang dalam putusannya Terdakwa dijatuhi hukuman pidana pokok penjara 1 (satu) tahun dan pidana tambahan pemecatan dari Dinas Militer telah sesuai dengan Pasal 87 KUHPM terkait tindak pidana Desersi. Kesesuaian itu dibuktikan dengan adanya 2 (dua) alat bukti berupa keterangan Saksi dan alat bukti surat berupa 18 (delapan belas) lembar absensi atas nama Terdakwa dari bulan Oktober sampai Nopember.Kata Kunci: Pengadilan Militer; Pertimbangan Hakim Militer; Tindak Pidana Desersi. ABSTRACTThis research aims to review the consideration of Judges of the II-11 Military Court in Yogyakarta in giving sentences to the Defendant of the Desertion criminal act. This type of research is normative legal research with the source of primary and secondary legal materials. The technique of collecting legal materials is conducted by literature study, using a case approach and analysis of legal materials with syllogism and interpretation methods with deductive thinking patterns. Based on the research results, it is identified that the Desertion criminal act decided by the Yogyakarta Military Court II-11 with Decision Number 24-K/PMII-11/AD/IV/2018 on behalf of the Defendant Sumardi as Serda NRP. 638139 where the Defendant was sentenced to 1 (one) year in prison and an additional criminal termination from the Military Service in accordance with Article 87 of the Criminal Procedure Code relating to the crime of desertion. This conformity is proved by the existence of 2 (two) pieces of evidence in the form of witness statements and letter evidence in the form of 18 (eighteen) absences on behalf of the Defendant from October to November.Keyword: Military Court; The Consideration of MilitaryJudges; The Crime of Desertion.]]>
