Abstract

Hukum yang berlaku dalam masyarakat, pada dasarnya berasal dari masyarakat itu sendiri agar terciptanya keamanan, keselamatan dan secara sengaja pula dibebankan kepadanya, agar masalah/konflik kesehatan serta keselamatan dapat diminimalisirkan. Metode dalam tulisan ini menggunakan metode penelitian hukum normative. Hukum yang diterapkan selalu memperhatikan kaidah yuridis, kaidah filosofis, kaidah sosiologi sehingga tidak bertentangan dengan nilai-nilai yang hidup dalam masyarakat. Hukum yang dibuat dalam masyarakat mempunyai tujuan untuk menciptakan perdamaian, ketentraman, dan ketertiban dalam masyarakat serta memberikan kepastian hukum. Tujuan hukum dapat dirasakan secara komprehensif dalam masyarakat, jika hukum itu dapat berfungsi dalam masyarakat. Dengan demikian hukum dan masyarakat mempunyai korelasi yang sangat signifikan. Masyarakat tanpa hukum, maka akan terjadi kacau balau serta terjadi tindakan yang sewenang-wenang, begitu pula sebaliknya hukum tanpa ada masyarakat, maka hukum itu tidak berarti sama sekali. Bukan negara yang membatasi, tapi COVID-19 yang sulit dilihat dengan mata melukiskan derita kita yang diterjang tiga krisis: medis (epidemi itu sendiri), ekonomi (yang terpukul keras apapun dampak epidemi) dan psikologis.

Abstract

The Corruption Eradication Commission was formed with the main mission of carrying out prevention and law enforcement in eradicating corruption. The Chairperson of the Corruption Eradication Commission (KPK) is the spearhead in tackling corruption in Indonesia. In fact, political transactions in the election of the Corruption Eradication Commission (KPK) leader may be eliminated, so candidates with high integrity can be eliminated. The method in this paper uses the normative legal writing method because it examines the laws and regulations, literature, and journals relating to the material examined, which consists of the type of data obtained in this study is secondary data that is data obtained from library research and documentation , which is the result of research and processing of others, which are already available in the form of literature or documentation. The development of technology is now increasingly rapid where everything is completely digital, this era of sophisticated even even corruption can be digital, therefore the ability of the Corruption Eradication Commission (KPK) must be upgraded according to the times to be able to detect and solve corruption cases that are increasingly complicated transactions

Abstract

A group of people who have the same feelings in a group, living in one place due to genealogy or geological factors is a Customary Law Community. the rules regarding rights and obligations on material and immaterial goods are already owned in their own customary law. the normative legal writing method because it examines statutory regulations, literature, and journals and papers related to the material under study, which consists of the types of data obtained in this study are secondary data, namely data obtained from library research and documentation, which is the results of research and processing of others, which are already available in literature or documentation. Protection for indigenous peoples as regulated in Article 28I paragraph (3) as well as in Article 18 B (2) of the 1945 Constitution and operational regulations are very necessary so that Indonesian legal order can be implemented properly. This problem is because the amendments to the 1945 Constitution at that time were laden with the interests of the administrators at that time. On the other hand, the state also recognizes and respects the rights of indigenous peoples, as well as on the other hand, they are required to fulfill the requirements to realize their rights.
