Paradigm Shift in the Implementation of the Law of the Sea in Indonesia Purwaka, Tommy Hendra

Abstract

Indonesia has experienced four times paradigm shift in the implementation of the law of the sea since it declared its archipelagic state principle in 1957 through the 1957 Djuanda declaration up to now. The shifting of paradigms can be viewed as a progressive development on the implementation of the law of the sea in Indonesia. The first paradigm was ocean space paradigm which was clearly shown in the 1957 Djuanda declaration and along the way of the diplomacy efforts of Indonesia in the first (1958), the second (1960) and the third (1982) UNCLOS. The first paradigm showed how Indonesian people viewed ocean space of Indonesian archipelago as an integral part of national territory of Indonesia. The ocean space of Indonesian archipelago, however, should be filled with development activities as the implementation of the law of the sea. This has raised ocean development paradigm in 1985 as the second paradigm. Problems and constraints of ocean development faced by government of Indonesia which consists of central government, provincial government, regency government and municipal government have led to the maritime continent paradigm as the third paradigm in 1990s. The third paradigm viewed the ocean and land space of Indonesian archipelago as a continent. By thinking so, maritime jurisdictional problems raised by the involvement of central, provincial, regency and municipal governments in Indonesia’s ocean development will be able to be solved. As a matter of fact, the appearance of the third paradigm has complicated efforts of government in socializing the implementation of the law of the sea to all government levels and to Indonesian people. For this reason, government of Indonesia in the year of 2000 formulated national ocean policy. This policy combined ocean space, ocean development and maritime continent paradigms which can be viewed as the fourth paradigm. The fourth paradigm then can be named as ocean policy paradigm.

Abstract

Everyone has the right to have access to sufficient, safe and physically accessible water for personal and domestic use. River is one of the water resources, which is highly necessary for the people who live in close contact with it. In the past few years there have been several law cases of water pollution in some Indonesian rivers caused by textile factories, who had been releasing untreated wastewater into the river. The wastewater had become harmful to humans and river life mostly due to toxic synthetic dyes chemicals used in textile production. This research aims to provide the reasons to apply ecolabel scheme on the textile/textile products in regards to sustainable development especially the Sustainable Development Goal (SDG) number 12: Sustainable Consumption and Production, which requires that people urgently reduce ecological footprint by changing the way they produce and consume goods and resources. This is a qualitative juridical normative study with statute approach, historical approach and philosophical approach, conducted by using secondary data and are collected by using the method of literature review. According to this research, ecolabel scheme on textile/textile product is relevant to support sustainable consumption and production pattern in Indonesia because it is a way to protect and preserve the environment especially river water in accordance with the international environmental laws regarding sustainable development, Indonesian legislation regarding sustainable development, and Dignified Justice (a justice concept based on Pancasila, the Five Principles of Indonesian State).

Abstract

Minimnya kewenangan pemerintah daerah dalam mengelola danau perkotaan menyebabkan permasalahan, salah satunya adalah penurunan kualitas danau perkotaan. Dalam hal ini, ketidakjelasan batasan kewenangan pengelolaan danau perkotaan antara pemerintah pusat, provinsi dengan pemerintah kota/kabupaten adalah salah satu permasalahan penting yang harus segera diselesaikan. Penelitian dilakukan dengan kajian pustaka dan desk study terhadap berbagai kebijakan pemerintah dengan kondisi yang ada saat ini. Hasil penelitian menunjukkan bahwa wujud pengaturan hukum di Indonesia dibagi menjadi 3 (tiga) bagian yaitu regulasi, peraturan kebijakan, dan kebijakan. Berpedoman pada peraturan yang telah diklasifikasikan, maka dibutuhkan unit satuan kerja yang dapat merealisasikan atau melaksanakan peraturan-peraturan tersebut agar memberikan manfaat bagi masyarakat. Kesimpulannya adalah rencana pembangunan berkelanjutan dalam perlindungan dan pengelolaan danau perkotaan dapat dilakukan melalui pengembangan pengaturan hukum, penaatan dan penegakan hukum termasuk instrumen alternatif, serta upaya rehabilitasi lingkungan.

Abstract

Law in general is understood as regulations formed by authority to regulate community and its activities for the purpose of creating public order and justice. The law is enforced by legal apparatus by applying compliance and coercive measures. In addition, understanding on law can also be obtained by the use of several different approaches in viewing the law, such as from political, economic, social and cultural approaches. By so doing, understanding on law can be enriched and improved for the benefit of law enforcement and compliance.Keywords: Approaches, Understanding, Law
