Abstract

This study aimed to understand the obligations of Indonesia according to International Covenant on Civil and Political Rights regarding violence acts toward transgender community in Indonesia. This study uses the normative method with conceptual and statute approach. Legal materials are collected through library study and analyzed through deductive method. The study shows that as a member of ICCPR, Indonesia has yet to fully perform its obligation to respect, protect, and fulfill transgender rights especially regarding violence. In respecting transgender rights, Indonesia allows change of sex, however there are still problematic regulations that are often used to justify violence towards transgender. Regulations that are meant to preventively protect transgender do not have any provisions that prohibits gender-based violence and law enforcement seems absent in punishing the perpetrators. Remedial measure has been provided with complaint mechanism through Indonesia’s National Human Rights Commission.The fulfillment of transgender rights have been shown by adding transgender issues as one of priorities of Indonesia’s National Human Rights Commission.

Abstract

The main issue in this research is about climate change phenomenon that causes several bad impacts to small island countries which also be known as Small Island Developing States (SIDS). According to those characteristics, SIDS countries is the most vulnerable parties of the climate change impacts. Therefore, several mitigation acts needed for reducing climate change impacts. International Climate Change Law has ruled mitigation acts in several law instruments, such as United Nations Framework Convention on Climate Change (UNFCCC) 1992, Kyoto Protocol 1997, and Paris Agreement 2015. Pacific and Caribbean SIDS has choosen renewable energy deployment as a part of its national mitigation, because they highly depended on the use of fossil fuels which is considered as climate change contributor for power generation. Pacific and Caribbean SIDS have taken mitigation measures based on renewable energy and already achieved its output, but there are still barriers such as low funding, lack of national law instruments that support its mitigation measures, and technical problems including the lack of technologies and human resources. So, SIDS should take several measures to eliminate these barriers for achieving the main purposes of climate change mitigation optimally.

Abstract

Penelitian hukum ini bertujuan untuk memahami dan menganalisis mengenai penegakan hukum terhadap kasus IUU Fishing yang dilakukan terhadap kapal KM BD 95599 TS di Laut Natuna sesuai dengan hukum internasional dan hukum nasional. Jenis penelitian hukum ini adalah penelitian normatif yang bersifat preskriptif guna menemukan dan merumuskan argumentasi hukum, melalui analisa pokok permasalahan dalam kaitannya dengan penegakan hukum pada ZEEI yang dilakukan Indonesia terhadap kapal asing yang melakukan IUU Fishing. Penelitian hukum ini menelaah bahan kepustakaan dengan mengumpulkan serta mempelajari bahan hukum primer dan sekunder. Hasil dari penelitian hukum ini menunjukan bahwa Kapal KM BD 95599 TS yang ditangkap oleh Kapal Pengawas Perikanan ORCA 02 dibawah kendali Kementerian Kelautan dan Perikanan terbukti telah melakukan tindak pidana IUU Fishing di wilayah ZEEI. Proses penegakan terhadap Kapal KM BD 95599 TS beserta nahkoda dan awak kapal KM BD 95599 TS sudah sesuai dengan ketentuan yang ada dalam hukum internasional dan hukum nasional, penegakan hukum hanya terbatas pada pemberian sanksi pidana denda tanpa adanya pidana penjara.

Abstract

This study aims to determine the legal significance of the establishment of Indonesian Sea and Coast Guard, analyze threats in Indonesian waters, overlapping law enforcement and maritime security in Indonesia and conventions issued by the International Maritime Organization relating to marine safety. This research is a normative  legal research that is prescriptive. Types and sources of materials used in this research is the primary legal materials and secondary legal materials. The data collection techniques by means of literature. While the analysis uses legal interpretation. Based on the conclusions generated discussion needs to establish Indonesian Sea and Coast Guard to conduct maritime security and implement IMO conventions concerning maritime safety and the safety of shipping.The establishment of Indonesian Sea and Coast Guard can be effective tools for implementation of IMO convention relating to marine safety.
