Abstract

Mantan suami wajib memberi mut’ah, nafkah, maskan, kiswah kepada mantan istri selama dalam masaiddah jika terjadi cerai talak (Pasal 149 huruf a dan b KHI), kecuali bila istrinyanusyuz. Namun, perkara Nomor 0168/Pdt.G/2012/PA.Sbt, suami tidak melaksanakan pembayaran nafkah iddah tersebut. Yang menjadi permasalahan adalah: Upaya yang dapat dilakukan termohon apabila suami tidak melaksanakan pembayaraan nafkah iddah dalam perkara Nomor:0168/Pdt.G/2012/PA.Sbt; Prosedur pelaksanaan putusan hakim tentang nafkah iddah di Pengadilan Agama. Tujuan penelitian ini untuk mengetahui upaya yang dapat dilakukan termohon apabila suami tidak melaksanakan pembayaran nafkah iddah ,juga untuk mengetahui prosedur pelaksanaan putusan hakim tentang nafkah iddah di Pengadilan Agama. Dalam hal ini data maupun informasi bersumber dari Pengadilan Agama. Dari data-data yang telah diperoleh, dapat disimpulkan bahwa upaya yang dapat dilakukan oleh termohon apabila suami tidak melaksanakan pembayaran nafkah iddah adalah dengan cara melakukan upaya permohonan eksekusi. Prosedur pelaksanaan putusan hakim tentang nafkah iddah diPengadilan Agama akan melalui beberapa tahapan, yaitu: Permohonan eksekusi, membayar biaya eksekusi, anmaning, penetapan sita eksekusi, penetapan perintah eksekusi, pengumuman lelang, permintaan lelang, pendaftaran permintaan lelang, penetapan hari lelang, penetapan syarat lelang dan floorprice, tata cara penawaran, pembeli lelang dan menentukan pemenang, pembayaran harga lelang barang hasil sita eksekusi nafkah iddah.

Abstract

Online gambling is a gambling game that is widespread among all levels of society. In this research, the impact that occurs due to husbands who are online gambling addicts leads to divorce. This case was determined by the Stabat Religious Court with case number 1519/Pdt.G/2023/PA.Stb. There are two points that are the main focus of this issue, with the aim of finding out the impact of online gambling on the divorce rate in Langkat district and then the decision of the Stabat Religious Court regarding divorce due to online gambling. This study uses a qualitative method. Data analysis using descriptive methods. This type of research is research using a normative legal approach method that examines literature studies, namely research on secondary data. Data collection techniques using interviews and documentation. The conclusion of this research is that the wife's petition for divorce was granted by the panel of judges at the Stabat Religious Court and charged all court costs to the Petitioner.

Abstract

The guardian of the lineage is a role that must be present in a marriage to act as a marriage guardian in marrying off one's daughter. This research discusses marriage annulment due to the marriage guardian not being the biological father with the aim and purpose of this research being to find out about legal tolerance in decisions from the perspective of Islamic law and Indonesian law, and to explain the position of the guardian in the Marriage Law. In this research the author uses normative research which is qualitative in nature, namely research which is descriptive in nature and tends to use analysis whose objects are legal principles, laws, rules, court decisions and doctrine. As well as using a research approach with library research (Library) and field research with data collection techniques. This research concludes that a marriage is invalid if it is carried out by someone who is not a guardian of the lineage or a guardian judge if there is a guardian of the lineage. So if that happens the marriage will be canceled. In the view of Islamic law, canceling a marriage is fasakh, which means broken. The marriage was damaged because of a defect in the marriage process. In Decision Number 1784/Pdt.G/2023/PA.Mdn, it was found that the plaintiff's marriage guardian was his adoptive father, which in Islamic law states that the person who has the right to be the marriage guardian is the nasab guardian. His adoptive father admitted to the KUA that it was true that he was the biological father of the plaintiff and that he did not know the law that if a marriage is not with the guardian of one's lineage, the marriage is annulled because there is a legal defect in it. The judge's decision in this case was correct, because the defendants consisted of the husband, the chairman of the KUA, and witnesses to all the truth that happened. As stated in Article 1925 of the Civil Code: "A confession given before a judge is perfect evidence against the person who gave it, either personally or through someone who is given special authority for that purpose."

Abstract

One negative form of social interaction between students is bullying. Bullying is considered inappropriate or deviant behavior because it has serious consequences. The purpose of this research is to explore bullying behavior among students, its psychological effects on the victims, the psychological effects on the perpetrators, and the perspective of the MUI (Indonesian Ulema Council) Langkat on bullying behavior at MIN 5 Langkat. This study uses a qualitative research method, which is descriptive and analytical, with data in the form of words, sentences, diagrams, or images rather than statistical numbers. The data collection techniques used are observation, interviews, and documentation. The data analysis technique involves analyzing the data simultaneously during the data collection process. The research results show that: first, the most common forms of bullying at MIN 5 Langkat are verbal and physical bullying. Second, the psychological effects on victims of bullying include disruptions in learning, social interactions, and personal development. Victims of bullying become fearful, withdrawn, lack enthusiasm for school, suffer from low self-confidence, have difficulty concentrating, and experience a decline in academic performance. Third, the psychological effects on perpetrators of bullying at MIN 5 Langkat impact their academic performance and social relationships. Fourth, MUI Langkat's view of bullying behavior at MIN 5 Langkat, namely that bullying behavior at MIN 5 Langkat is still in the mild category, but in Islam it does not allow and does not tolerate bullying behavior, therefore MUI Langkat hopes that the madrasah will take several actions to reduce bullying behavior. even to the point where it no longer exists at MIN 5 Langkat.

Abstract

Fasting during Ramadan is an obligation for every Muslim/Muslimah who is mature, wise, clean from menstruation and after childbirth for women, and who does not have a valid excuse, such as: travelers and sick. Meanwhile, menstruation is a natural process that occurs in every woman. With the current breakthroughs in medical science, drugs have emerged that can delay menstruation experienced by women, making it possible to carry out Ramadan fasting without obstacles. This type of research is library research (library research) with a historical approach. The data collection method is by means of literature study, in which in this section the author will collect MUI fatwas and fiqh books on the topic being researched. Then read and trace the legal istinbath method. The results of the study show that the negative impact of this drug affects the body's work system, so its use in an inappropriate place is not recommended. While the positive impact on health, the authors assume there is no. Because, this drug aims to block the natural cycle that occurs in women. Then the use of drugs that are not on target or used in the long term or made from inappropriate ingredients, will certainly have implications for the body. Meanwhile, Nash has not yet regulated the legal status of delaying menstruation. So ijtihad is needed in this case by looking at the benefits. If you delay your menstrual period using drugs, you will examine the side effects. If it causes harm to the body, it is better to avoid it. However, if it does not cause harm then it is permissible. As stated in the MUI fatwa No. 2 of 1979

Abstract

Keluarga yang harmonis adalah keluarga yang bahagia, sejahtera, dan humanis. Agar terciptanya keluarga yang diimpikan tersebut perlu dilakukan pembinaan terhadap individu keluarga. Pembinaan rumah tangga ini dimaksudkan agar pasangan suami istri bisa terhindar dari perselisihan yang berujung pada perceraian. Syekh Abdul Halim Hasan sebagai ulama tafsir nusantara memberikan konsep pembinaan rumah tangga dalam karyanya Tafsir Ahkam. Rumusan masalah penelitian ini adalah pertama, Apa faktor perselisihan dalam rumah tangga? Kedua, Bagaimana konsep pembinaan rumah tangga menurut Syekh Abdul Halim Hasan dalam Kitab Tafsir Ahkam? Metode penelitian ini menggunakan penelitian kepustakaan (library reseach) yang sifatnya kualitatif analitik melalui pendekatan historical approach (pendekatan sejarah). adalah penelitian yang digunakan dalam pengkajian pendapat seorang tokoh. Yaitu, pertama, studi literatur dan kedua, menelusuri karya-karya orang lain mengenai tokoh yang bersangkutan atau mengenai topik yang akan diteliti. Hasil penelitian skripsi ini adalah pertama Faktor-faktor perselisihan pada rumah tangga dapat disebabkan beberapa faktor, yaitu; komunikasi yang buruk antara suami/istri dalam rumah tangga, keegoisan dari suami/ istri yang seharusnya saling pengertian dan saling memahami antara satu dengan lainnya, kondisi perekonomian yang serba kekurangan, pemahaman/pendidikan suami atau istri yang rendah, kesibukan suami/istri, gangguan dari pihak ketiga, keterbatasan waktu, budaya yang bisu dalam rumah tangga, terjadi perang dingin dalam berkeluarga, adanya gangguan pihak ketiga, perselingkuhan, minimnya kepercayaan pasangan, kesibukan pasangan dalam menjalankan aktifitas, kriteria yang tidak sesuai, kekerasan dalam rumah tangga, dan masalah seksualitas. Kedua: Syekh Abdul Halim Hasan menguraikan beberapa hal sebagai konsep membina keluarga dalam kitab Tafsir Ahkam, di antaranya; suami adalah seorang pemimpin dalam keluarga, pilihlah pasangan yang seagama, penuhi hak dan kewajiban suami istri, dan memperlakukan istri dengan cara yang baik dan bijaksana.
