Abstract

Abstract: Bank Syariah Mandiri is a state bank who first introduced a system of sharia. In a way, this bank was applying one system of cooperation with customers called muḍārabah. The systems of muḍārabah are also applicated in the Bank Syariah Mandiri Branch Palu, which was established in 2003. This study discusses the theory and application of muḍārabah system in Bank Syariah Mandiri Branch Palu. The results showed that the application of muḍārabah system in Bank Syariah Mandiri Branch Palu has not been fully realized purely in accordance with the theoretical foundation of muḍārabah system suggested by experts, despite the commitment of Bank Syariah Mandiri Branch Palu to customers has increased significantly.Kata Kunci: aplikasi, sistem muḍārabah, Bank Syarih Mandiri.

Abstract

Sharia banks in conducting business activities must be based on sharia principles. Based on the mandate of Law Number. 21 of 2008 concerning Islamic Banking and BI Regulation Number. 6/24 / PBI / 2004 that the DSN has the duty and authority to stipulate fatwas regarding products and services in the business activities of Banks which carry out business activities based on Sharia principles. To ensure that the deposit products at Bank Muamalat comply with the standards set by the DSN, a research was conducted at Bank Muamalat Indonesia, the Palu branch. Deposit products at the Palu branch of Bank Muamalat Indonesia use the Mudharabah Mutlaqah contract, where BMIs are given freedom in managing customer funds. Then it is reviewed on the rules of the DSN-MUI Fatwa Number. 03 / DSN-MUI / IV / 2000 based on the 6-point provision that must be implemented to achieve sharia principles. In its implementation, the mudharabah time deposit product run by Bank Muamalat Indonesia, Palu branch has met these provisions. so theproduct of mudharabah time deposits or deposits in the Palu branch of Bank Muamalat Indonesia is in accordance with the fatwa.

Abstract

The establishment of Financial Service Authority (FSA) is a mandate of Law No 21 Year 2011 about Financial Service Authority. FSA is a state institution that is responsible for supervising finance such as bank or non-bank financial service institution, videlicet insurance company, finance company, pension funds and capital markets. This research studies FSA in Central Sulawesi province which has stints as commanded by constitution. It is then able to be seen from the number of public complaints handled since in this province is formed at 1st January 2014. Central Sulawesi FSA Office obtained 70 cases from financial service industry costumers as well as sufficient incentive to introduce micro-finance institutions to disseminate Act No. 1 of 2013 on Micro Financial Institutions (MFIs) as an institution in the community economic development efforts. Moreover, the leader of FSA Office Central Sulawesi keeps making serious efforts to strengthen the institution in order to improve and amplify FSA Office’s oversight function hence it embraces conventional bank, Islamic bank and non-bank financial institution besides continues to encourage the establishment of novel offices by facilitating license (inter alia, opening one door service). This studies also discovers some matters faced by FSA Office Center Sulawesi these days; the quantity and quality of human resources.

Abstract

BNI Syariah is one of Indonesia's national sharia banks. In its operations, BNI Syariah implements several contracts, namely the Mudharabah Contract, the Wadiah Contract, and the Ijarah Contract. This study is focused on the discussion of the Ijarah Contract by taking BNI Syariah Branch Palu, Central Sulawesi as the research object. Islamic banking has good prospects. This is supported by two factors, they are the population which is predominantly Muslim and the strong support of the Government. But at the same time, there are number of challenges faced by this type of banking. The aspects of funding and the quality of Human Resources (HR) are two elements that are often referred to the serious problems faced by Islamic banking, especially when compared to conventional banking. Another factor is that Islamic banking has not had a clear business model scheme yet. Moreover, Islamic banking products are still not fully understood by a larger public. In other words, citizens who truly understand the principles and products of Islamic banking are still very limited. In relation to the operations of the BNI Syariah Bank Branch Palu, there are two segments that are practiced in the bank intermediation. Those two segments are the consumptive segment and the productive segment. Both of these segments face the same problem in their implementation, it is socialization. This study found that there was a correlation between the lack of socialization and the low interest of the people in Palu regarding the Ijarah product. In other words, lack of socialization has caused BNI Syariah Branch Palu products to be widely unknown to the public.
