Abstract

Artikel ini berupaya mengupas pemikiran progresif yang dikembangkan oleh Abdullah Saeed serta implikasinya terhadap metodologi fiqh Islam. Studi ini menggunakan metode kualitatif jenis studi pustaka. Melalui gagasan context-based ijtihad Abdullah Saeed berupaya menjelaskan bahwa masalah-masalah hukum harus dengan konteks sejarah turunnya hukum itu kemudian dihubungkan dengan konteks yang terjadi pada saat ini dengan mengacu pada kemaslahatan umum dari maqashid syariah. Melalui metode ijtihad tadi, Saeed berkeyakinan bahwa ayat haramnya Riba bukan bersifat qati karena ditinjau dari sosio historis turunnya ayat-ayat riba, kemudian Saeed juga menganggap riddah adalah dosa individu seseorang kepada Tuhannya, maka tidak boleh dihukum dengan hukum jinayat

Abstract

Data from the West Java Women's and Child Empowerment (P2TP2A) Integrated Service Center counselor, shows that the number of domestic violence (KDRT) in West Java is still high. In one year P2TP2A can handle more than 100 cases. that number could be more because until now there are still many victims of domestic violence who do not dare to report. This is a concern of the community and the regional government of West Java, so the problem is how to protect victims of domestic violence in Garut. This writing study uses literature studies that emphasize data collection through searching / reviewing books related to research. The data analysis method used is a descriptive-analytical method by collecting and compiling data, then analysis and interpretation of the data are sought. Violence against women and children victims of domestic violence in Garut Regency over the past five years as many as 430 cases including 2014 violence against women, 46 cases, in 2015 there were 31 cases, in 2016 there were 37 cases, in 2017 there were 30 cases and in 2018 as many as 17 cases. This shows that the amount of violence against women has decreased from year to year. Garut Regency protects women and children who are victims of violence by fulfilling the rights of women and children victims of violence and discrimination starting from prevention efforts, social services, and rehabilitation. All protection aims to protect women and provide security in the fulfillment of their rights by providing consistent and systematic attention aimed at achieving gender equality.

Abstract

Zakat collection agencies in Indonesia and Malaysia face operational deficits due to limitations on the rights of zakat collectors, even though zakat collection continues to increase. This study aims to compare MUI Fatwa No. 8 of 2011 and the Federal Territory Mufti’s Irsyad al-Fatwa No. 168 of 2022 regarding the limitations on the rights of zakat collectors. Using a normative qualitative approach with descriptive-analytical methods and literature review, the analysis is framed by the theories of Maqasid al-Sharia and Maslahah Mursalah. The results show that the MUI Fatwa emphasizes flexibility without fixed limits to adapt to operational contexts, while the Irsyad Fatwa strictly limits the fee to 1/8 to uphold the trust in accordance with the Shafi’i school of thought. These differing approaches impact operational efficiency and public trust: flexibility enhances efficiency but requires strict oversight, while rigid restrictions build trust but hinder institutional performance. This study enriches the discussion on contemporary fiqh muamalah and offers policy recommendations for sustainable zakat management.
