Abstract

The word manasik in several Qur’anic verses and hadith shows the importance of the perfection of the Hajj. Classical Muslim scholars do not discuss specifically about manasik, but nowadays the manasik (hajj rituals) training for prospective pilgrims has been coordinated by government. This requires new ijtihad for the legality of Hajj ritual training, especially among Acehnese scholars. This research examines how the position of manasik is within the scope of the Hajj rules; how the Aceh Ulamas view and consider the manasik training as a requirement of Hajj. This study uses a qualitative method. The results of the study indicate that the position of manasik training within the scope of the Hajj rule is as an observance and knowledge of the procedures for performing the Hajj. Learning Hajj rituals includes an observance and it is obligatory for people who do not understand it such as conditions, requirements and things that are not permitted during Hajj. Acehnese Ulama are of the view that the Hajj manasik training cannot be used as a requirement of Hajj, but there are also those who argue that in the present conditions the manasik training can be used as a requirement of the Hajj and it can even become mandatory. The existence of differences of opinion in carrying out ijtihad is caused by legal basis considerations and the logic used.

Abstract

Mahram in Islamic law is a necessity for women seeking traveler with reachingdistance masafah Qasar, though many occur polimik and debate on the issue, but the Islamic lawexists to balance the life of mankind in general especially those of Muslims. The problem in thispaper is How the concept of mahram according to Islamic law? How intent mahram in the bookof hadith al-Muwata 'Imam Malik? Mahram in Islamic law are those forbidden to marry awoman either nasab, musaharah or rida '(suckling). Mahram in the book of al-Muwata 'ImamMalik are the ones that have been mentioned in the Koran and Hadith dimena they can maintainand preserve women from the threat that the bus makes these women are not at ease, comfortableand peaceful so that if women who travel or other sebaginya unaccompanied by mahramnya thedevil and the devil upon him, the quality of the chains and Matan hadith of Abu Hurairah thathas takhrijed by Imam Malik is Sahih.

Abstract

Kekerasan adalah sebuah upaya tindakan yang menimbulkan penderitaan baik secara fisik atau mental yang ingin dilakukan atau sedang dilakukan oleh seseorang terhadap orang lain baik secara individu atau kelompok, terhadap orang lemah atau kuat apakah laki-laki atau perempuan.Perilaku atau tindak kekerasan dalam rumah tangga sebagai fakta sosial bukanlah perkara baru dari perspektif sosiologis masyarakat. Persoalan ini sudah terjadi sejak lama dan masih berlanjut hingga kini. Kekerasan dalam rumah tangga sebagaimana dimaksudkan adalah setiap perbuatan terhadap seseorang terutama perempuan, yang berakibat timbulnya kesengsaraan atau penderitaan secara fisik, seksual, psikologis, dan atau penelantaran rumah tangga (anak) termasuk ancaman untuk melakukan perbuatan, pemaksaan, atau perampasan kemerdekaan secara melawan hukum dalam lingkup rumah tangga.Selain itu, kekerasan dalam rumah tangga (KDRT) merupakan fakta sosial yang bersifat universal karena dapat terjadi dalam sebuah rumah tangga tanpa pembedaan budaya, agama, suku bangsa, dan umur pelaku maupun korbannya. Karena itu, ia dapat terjadi dalam rumah tangga keluarga sederhana, miskin dan terkebelakang maupun rumah tangga keluarga kaya, terdidik, terkenal, dan terpandang. Tindak kekerasan ini dapat dilakukan oleh suami atau istri terhadap pasangan masing-masing, atau terhadap anak-anak, anggota keluarga yang lain, digampong Hagu Barat Laut Kecamatan Banda Sakti Kota Lhokseumawe yang berpenduduk ± 6500 orang yang terdiri dari 62% Perempuan dan 38% laki-laki, memiliki 2184 Kepala Keluarga (KK) hampir manyoritas berpropesi sebagai nelayan karena secara giografis memang gampong Hagu Barat Laut letaknya di bibir pantai Utara Kota Lhokseumawe, dalam mendampingi masyarakat gampong kami mengedepankan diskusi atau Musyawarah secara persuasif, kemudian preventif dan sangat jarang kami mengarahkan kasus kekerasan tersebut dilakukan secara refresif yang artinya berhadapan dengan pengadilan, setiap ada kasus kami pertama berdiskusi dan kompromi dengan bahasa lain bermusyawarah dengan bapak Keucyik yaitu bapak Hendra Saputra ST, kemudian Tgk Imum Syik yaitu tengku Sulaiman H. Daud dan Tgk Zulfikar selaku Imam Gampong Hagu Barat Laut. Perlunya keterlibatan semua pihak untuk meminimalisirkan KDRT digampong Hagu Barat Laut.
