Abstract

Yang menjadi tujuan jangka panjang dari penelitian ini adalah: (1).Untuk menemukan tingkat permasalahan dari Implementasi UU No 21 Tahun 2001 tentang Otonomi Khusus bagi Provinsi Papua terhadap peningkatan Kesejahteraan masyarakat di Kampung Bumi Mulia Distrik Wanggar Kabupaten Nabire. (2). Memberikan solusi pemecahan permasalahannya kepada pemerintah melalui kegiatan seminar hasil penelitian, dan dipublikasikan melalui jurnal.

Abstract

Orderly and disciplined work and service is everyone's dream, including village officials, of good and correct service. This article is the result of a literature and empirical study adapted to developments in employee disciplinary law. The purpose of this writing is simply to provide an overview of information about the legal discipline of government agencies in carrying out their duties and responsibilities to improve performance in services to the community. This research uses a literature review and empirical study approach. Discipline of Wanggarsari village officials to improve performance in accordance with Law Number 9 of 2015 as a result of amendments to Law Number 23 of 2014 concerning regional government and Law No. 30 of 2014 concerning Government Administration has not been implemented optimally, because work is not disciplined, not in accordance with the accuracy of completing tasks and so on, so that performance improvements have not been achieved according to expectations, both community expectations and the expectations of the law. The performance of Wanggarsari village officials will improve if Wanggarsari village officials in Wanggar District are aware of and practice work discipline continuously in accordance with applicable laws and regulations.

Abstract

The aim of this research is to find and provide suggestions for the role of leadership in improving performance in the Nabire district DPRD office. The approach method is analytical descriptive, with the main problem being the role of the Regional People's Representative Council (DPRD) of Nabire district and the extent of the performance of the members of the Regional People's Representative Council (DPRD) of Nabire district. The results of the research show that the work of the leadership of the Nabire Regency DPRD has not been maximized, which in the future requires increased knowledge and skills so that service to the community will be good.

Abstract

Tulisan ini merupakan hasil kajian pustaka dan empiris yang disesuaikan dengan perkembangan hukum kedisiplinan pegawai. Tujuan penulisannya ini adalah memberikan gambaran informasi tentang hukum disiplin apartur pemerintahan dalam melaksanakan tugas dan tanggungjawabnya untuk peningkatan kinerja dalam pelayanan kepada masyarakat. Dalam penelitian ini menggunakan pendekatan perundang-undangan dan empiran atau kasus. Disiplin aparat kampung Wanggarsari untuk meningkatan kinerja sesuai UU Nomor 9 tahun 2015 dari hasil perubahan UU Nomor 23 Tahun 2014 tentang pemerintahan daerah belum maksimal dilaksankan, karena kerja tidak disiplin, tidak sesuai dengan ketepatan penyelesaan tugas dan lain-lain sehingga peningkatan kinerja juga belum dicapai sesuai harapan, baik harapan masyarakat maupun harapan undang- undang. Kinerja aparat kampung Wanggarsari akan meningkat baik apabila Pegawai Aparat Kampung Wanggarsari menyadari dan mempraktikkan disiplin kerja secara kontinyu sesuai peraturan perundang—undangan yang berlaku.

Abstract

Tujuan dari penulisan artikel ini adalah untuk memberikan suatu gambaran bahwa pada hakekatnya pengakuan dan perlindungan atas hak ulayat masyarkat hukum adat asli Papua itu menjadi penting dan urgen. Dalam penelitian ini tipe penelitian yang penulis gunakan adalah penelitian campuran yakni penelitian normatif-empiris dengan pendekatan Yuridis sosiologis dan cultural dengan menggunakan bahan hukum utama adalah kajian pustaka dengan pengumpulan data bahan hukum primer dan data sumber sekunder dengan tetap dihubungkan dengan realitas hidup masyarakat hukum adat Papua. Berdasarkan hasil penelitian penulusuran didaptkan bahwa pada hakikatnya pengakuan dan perlindungan hukum atas hak ulayat mayarakat adat itu menjadi penting dalam berbagai literatur baik dalam konstitusi, UU dan peraturan hukum teknis yang dibuat oleh pemerintah termasuk dalam UU Otonomi Khusus Papua namun dalam kenyataannya terdapat penguasaan tanah-tanah ulayat oleh negara dan mengabaikan kepentingan hak ulayat masyarakat sebagai pemilik yang sulit di hindarkan. Untuk itu regulasi peratutan perundang-undangan yang sudah dibuat oleh pemerintah atas hak ulayat tersebut agar dilaksanakan maksimal sesuai maksud dan tujuannnya tanpa mengorbankan kepentingan pemilik hak ulayat yaitu masyarakat hukum adat di Papua. Dengan begitu konflik antara pemerintah dengan masyarakat dan masyarakat dengan para pengusaha sedapat mungkin dihindari demi kelancaran pemenuhan hak dasar masyarakat adat dan pembangunan sesuai tujuan negara bagi seluruah rakyat.

Abstract

If we glance at the theory Montesqeuie Trias Politica, the Act established powers that be in the hands of the legislature. Delivery is based on fhilosophy that the legislature is an institution in which representatives of the people of Oran is a collection of those options that carry out the mandate of the people who choose it. While eksekutuf as the executor of what the will of the people under the law of products made by legislatures. Power to form the Law in Indonesia after the 1945 amandemn reflect Montesqeuie theory but not entirely in the hands of the legislature can be said even with the power between the parliament and the president which, according to opinion of the writer is still to be debated again in the future.

Abstract

This writing aims to provide an understanding that academic texts are the door or window, the breath, the direction for the formation of regional regulations. For this purpose, the researcher uses the normative legal research method and the sociological legal research method, namely a research based on legal sciences, especially constitutional law, which is not only a normative issue but also includes socio-empirical issues, in accordance with phenomena and realities that developed in Nabire-Central Papuan society. In an effort to collect data researchers based on primary data sources and secondary data sources. Based on these data, the authors analyzed using qualitative methods. Based on the research, the results show that there is a lack of regional regulations that begin with the formation of Academic texts which are a participatory form of the community starting from planning, forming, implementing, monitoring and evaluating so that the community is apathetic and accepts every regional regulation as it is established by the regional government. and the Nabire district parliament. For this reason, it is important for the formation of a regional regulation that an academic text is first formed which is then inseparable from the regional regulation. As a mirror academic texts will be effective for regional regulations in their formation. The effectiveness of the enactment of regional regulations is highly dependent on the degree to which the public accepts the enactment of regional regulations. In order for academic papers to become the basic idea of general merit or shared expectations and to be effective, starting from the planning process, the community must be involved so that it does not become a problem, and is accepted by the community in its implementation in the future.

Abstract

The writing of this article is to understand Papuan people and their culture starting from the form of race, hair, skin, population distribution, customs manifested in the marriage system. This research method is socio-ethnographic, namely to provide an illustration that Papuans have one identity and a structured culture that is different, although not all of them with other ethnic groups in Indonesia. Based on the results of the study, it was found that race, hair, skin and the type or pattern of leadership as well as the existing marriage system were increasingly changing following the flow of globalization. Not all aspects of Papuan identity should change, some have to be authenticated and therefore traditional leaders need to play a maximum role in caring for, maintaining so that the values and aesthetics of cultural life can be seen and preserved.

Abstract

Purpose: This study reassesses the implementation of the 1962 New York Agreement in West Papua by examining its compliance with international treaty obligations and the principle of self-determination within the framework of international law. It aims to evaluate whether the Agreement was executed in accordance with its normative commitments and to identify the legal implications arising from its implementation. Research Design and Methodology: This research employs a normative-doctrinal legal approach supported by historical and juridical analysis. Primary legal materials include the 1962 New York Agreement, United Nations General Assembly Resolution 2504 (XXIV) of 1969, and the Vienna Convention on the Law of Treaties (1969). These sources are complemented by scholarly articles, official United Nations reports, and archival records. The study utilizes textual, contextual, and teleological interpretations to assess treaty performance, the principle of good faith, and compliance with international legal standards. Findings and Discussion: The findings reveal a significant gap between the normative commitments of the New York Agreement and its practical implementation. Although the Agreement formally guaranteed the right to self-determination, the 1969 Act of Free Choice did not fully conform to internationally accepted standards, particularly regarding popular participation, procedural legitimacy, and genuine expression of political will. The consultative voting mechanism, limited involvement of indigenous Papuans, and Cold War geopolitical pressures influenced the process. Furthermore, United Nations General Assembly Resolution 2504 (XXIV) merely acknowledged the outcome without explicitly endorsing its conformity with democratic self-determination, thereby raising enduring questions concerning treaty compliance and legal legitimacy. Implications: This study contributes to international legal scholarship by offering a doctrinal reassessment of treaty compliance and self-determination in decolonization processes. It underscores the importance of good faith, transparency, and adherence to international legal norms, while providing theoretical insights and practical recommendations for strengthening the legitimacy, accountability, and interpretative integrity of international agreements.
