Abstract

The legal basis for the implementation of the Pilkades simultaneously in 2019 refers to Perbup Number 27 of 2019 established on May 15, 2019. However, the Perbup does not apply after the birth of Perbup Number 39 of 2019 which was ratified on June 21, 2019. The Perbup is a derivative of the Regional Regulation (Perda ) Number 8 of 2014 concerning Guidelines for Nominating, Election, Appointment, Appointment and Dismissal of Village Heads. The birth of Perbup, which became the legal basis for the election of village heads simultaneously, caused a lot of polemic at the village level. The polemic was born because in the Decree regulates scoring for villages with more than five candidates.

Abstract

One of the hotbeds flowering of law is the problem of social life and contemporary issues. To open the horizons of academics and practitioners need to be confronted with the problem of social life and contemporary issues. They dituntutberfikir hard to assess, understand, look for the solution of social problems in your life. What is the meaning of a person’s faith if it is not susceptible to a question of life and the nation’s neighbors. Yet according to the true religion there is a very strong linkage which can not be disconnected between spiritual intelligence with social intelligence. To understand the teachings of the first through the text, because the text are the symbols and values, and then needed a contextual understanding, and komperhensip because the law there are born and live in a vacuum. In addition, people who practice have never been aware of a law without knowing their mashlahah behind. Contextual understanding to be assessed holistically, through the paradigm of social-humanities with an effort to combine form Multiperspective paradigms and theories of contemporary scientific and attention to the elements of the legal, philosophical, the psychological, sociological, cultural and anthropological. Such an approach is necessary and should be appreciated by academics.

Abstract

Esesensi Maqashid as-Syari’ah adalah mencapai, menjamin, dan melestarikan kemaslahantan bagi umat manusia, khususnya umat Islam. Untuk itu, dicanangkanlah tiga sekala prioritas yang berbeda tetapi saling melengkapi yaitu; adh-Dharuriyyat, al-Hajiyyat, dan at-Tahsinat. Adh-Dharuriyyat tujuan-tujuan primer didefinisakan sebagai tujuan yang harus ada, yang ketiadaannya akan berakibat menghancurkan kehidupan secara total. Ada lima kepentingan yang harus dilindungi; agama, jiwa, akal, harta, dan keturunan. Untuk menyelamatkan agama, Islam mewajibkan ibadah, sekaligus melarang hal-hal yang merusaknya. Untuk menyelamatkan jiwa, Islam mewajibkan umat manusia untuk makan sesuai dengan kebutuhan. Untuk menyelamatkan akal, Islam mewajibkan antara lain pendidikan sekaligus melarang hal-hal yang merusak akal seperti minuman keras. Untuk menyelamatkan harta, Islam mewajibkan antara lain hukum-hukum mu’amalah sekaligus melarang langkah-langkah yang akan merusaknya seperti pencurian dan perampokan. Untuk menyelamatkan keturunan, Islam mengatur pernikahan dan melarang pernikahan.
