Abstract

In this article, the underlying approach that has been used to formulate the post-Soeharto's territorial reform that produced decentralization laws and regulations is critically reviewed. The so-called Public Administration School or "PAS" that is rooted on the formal-legal paradigm and adopted by the discipline of law and political sciences has dominated the thinking behind the formulation of the decentralization and regional autonomy laws. The legal drafter of the decentralization laws in Indonesia are strongly influenced by the PAS approach and have crafted a national law that is generally lack of comprehensive understanding on the dynamics and processes at the society level. The PAS approach is failed in their attempt to incorporating various dimensions that are not only formatted but also contextualized the society. The critical implications that are mostly beyond the imagination of the experts that belong to the PAS approach is the fact that the news have created many loopholes for political elites to easily manipulating the existing regulations for their short term goal to capture the regional political positions and economic benefits. Two case studies of "pemekaran wilayah" in Central and Southeast Sulawesi provinces are presented to show the actual processes in which “pemekaran” become an arena for the local elites to contest for power and economic resources. A more comprehensive approach that is able to incorporating social, economic and ecological dimensions is needed to avoid the flaws, hypocrisy and manipulation by the political elites, as we have noticed in the implementation of the current decentralization laws and government regulations.

Abstract

Salah satu hasil dari reformasi politik setelah lengser keprabonnya Suharto pada tanggal 23 Mei 1998 adalah keterbukaan untuk membicarakan berbagai hal yang oleh Orde Baru dianggap tabu. Sebagai sebuah rezim otoriter yang berkuasa lebih dari 30 tahun (1967-1998) tidak sedikit tabu yang berhasil diciptakan. Berbagai tabu itu diciptakan sebagai bagian dari cara pemerintah Orde Baru menjamin kestabilan kekuasaan yang terpusat di tangan sang penguasa tunggal, Presiden Suharto. Adalah sebuah tabu untuk membicarakan secara terbuka tentang suku bangsa, agama apalagi tentang federalisme. Oleh Orde Baru hal-hal itu perlu ditutup dari pembicaraan publik karena bisa mengancam persatuan bangsa dan membahayakan kesatuan negara. Persatuan bangsa dan kesatuan negara seolah-olah raison d’etre adanya Orde baru, padahal keduanya sekedar alat legitimasi kekuasaan belaka.

Abstract

This article reviews the recent discourse on forced migration in Southeast Asia. In the aftermath of the Cold War era, movements of people have entering a new predicament. The interstate wars have produced displaced populations that many have spill into the neighboring countries or oscillating within border areas. In these new political circumstances, studies on population movement shall move beyond the conventional theoretical framework, derives from the modernization theories. The increasing magnitude of forced displacement, in many instances resulted from the state's failures in resolving political conflicts, critically challenges the conventional study on migration in which politics and security, often neglected. From a narrow academic perspective, displaced people is divided into three broad groups, based on the major cause of displacement: violent conflicts, development and natural disasters. In Southeast Asia, internal conflict that produced internally displaced population and refugees that fill or cross the state borders, is often resulted from elite's conflict or conflict between different factions in the national government, that in turn produce tensions in the society at the grassroots levels. This article argues that the need for a new perspective beyond Eurocentric framework is needed to analyze unfolding events related to migration-development-security nexus in Southeast Asia. The failure of existing international refugee regime to contain the critical issues and the refugee crises in the region mirror the failure of regional cooperation in Southeast Asia to develop a viable regional framework to tackle the problem of refugee and the displaced population.Keywords: Political conflict, force migration, regional framework
