Abstract

This study aims to determine the protection of child labor in Indonesia, especially the rules that protect child labor both in industrial areas and on entertainment such as artist child and the like. The research method used is legal research with statutory approach approach (analytical approach) which is analyzed with qualitative analysis. The results of the study show that child labor has gained enough protection from Indonesian legislation. Such protection is both at the level of the country's basic laws (contitutions) and the Law, as well as on derivative regulations issued by the central government, ministers, and local governments. Keywords: Labor Law, Child Labor, Child Protection

Abstract

AbstractBuilding function feasibility certificate is a certificate that is regulated by the regional government except for special function buildings by the government to declare the proper functioning of a building both administratively and technically, before its utilization. The research method used is normative legal research using a practical legal approach. The results of the study indicate that the building-worthy certificate or the term SLF has a legal basis in its arrangement. SLF is based on Law Number 26 of 2007 concerning Spatial Planning, Law Number 25 of 2009 concerning Public Services and Law Number 1 of 2011 concerning Housing and Settlement Areas. Keywords: Function Worthy Certificate (SLF), Law, Building, Work AccidentAbstrakSertifikat laik fungsi gedung merupakan sertifikat yang ditertibkan oleh pemerintah daerah kecuali untuk bangunan fungsi khusus oleh pemerintah untuk menyatakan kelaikan fungsi suatu bangunan gedung baik secara administratif maupun teknis, sebelum pemanfaatannya. Metode penelitian yang digunakan adalah penelitian hukum normatif menggunakan pendekatan praktis hukum. Hasil penelitian menujukan bahwa Sertifikat laik fungsi gedung atau dengan istilah SLF memiliki landasan hukum dalam pengaturannya. SLF bedasarkan pada Undang-Undang Republik Indonesia Nomor 28 Tahun 2002 Tentang Bangunan Gedung, Undang-undang Nomor 26 tahun 2007 tentang Penataan Ruang, Undang-undang Nomor 25 tahun 2009 tentang Pelayanan Publik  dan Undang-undang Nomor 1 tahun 2011 tentang Perumahan dan Kawasan Permukiman. Kata kunci: Sertifikat layak fungsi (SLF), hukum, Bagunan, Gedung, Kecelakaan kerja

Abstract

 Social policies designed to protect female workers that worked at night and promote equality in the workplace have a controversial effect on labor market outcomes. Restrictions on working hours and pregnancy benefits stipulated in applicable laws help protect the responsibilities of women workers who work at night for their families and ensure their physical security, but this regulation can raise doubts about the safety of women working at night. Protection of female workers has been regulated in the Law Number 13 of 2003 concerning Manpower and Decree of the Minister of Manpower and Transmigration Article 76. In addition, the regulation is also regulated in the Transmigration of the Republic of Indonesia No. Kep 224 / Men / 2003 regulates the obligations of employers who employ female workers or laborers, where the application process is carried out directly by the employer through a work agreement between employers and workers which is then supervised by the authorized agency. Keywords: Legal Protection, Women, Working at Night   Abstrak Kebijakan sosial yang dirancang untuk melindungi pekerja perempuan yang bekerja di malam hari dan mempromosikan kesetaraan di tempat kerja memiliki efek kontroversial pada hasil pasar kerja. Pembatasan jam kerja dan tunjangan kehamilan yang diatur dalam undang-undang yang berlaku membantu melindungi tanggung jawab pekerja perempuan yang bekerja di malam hari terhadap keluarganya dan memastikan keamanan fisik mereka, tetapi peraturan ini dapat menimbulkan keraguan terhadap keamanan perempuan yang bekerja pada malam hari. Perlindungan terhadap tenagakerja perempuan telah diatur dalam undang-undang yakni Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan dan Keputusan Menteri Tenaga Kerja Pasal 76. Selain itu, pengaturannya diatur juga dalam Transmigrasi RI No.Kep 224/Men/2003 mengatur kewajiban pengusaha yang memperkerjakan pekerja atau buruh perempuan, dimana proses penerapanya dilakukan langsung oleh pengusaha lewat perjanjian kerja antara pengusaha dengan tenaga kerja yang kemudian diawasi oleh instansi yang berwenang. Kata Kunci : Perlindungan Hukum, Perempuan, Bekerja di Malam Hari
