<![CDATA[ABSTRACTThis article is to learn about some problems in a decision delivered by Lhoksukon Distric Court, i.e. whether it was ruled on the bases of the right application of both procedural and material law as well as the honor of human right principles. Such an analysis of the court decision is very intriguing since the defendant was dubbed as a rebellion from the GAM in Aceh restive Province. The panel of judges sent the defendant to prison for 2.5 years although prosecutor could not provide ample evidence to prove his guilt. The Author seem court decisions in this case still promotes the the authority and powers so taht a fair and transparant trial has not been seen Keywords: material law, rebellion, human right principles. ABSTRAKArtikel ini mengkaji beberapa persoalan dalam putusan Pengadilan Negeri Lhoksukon, apakah sudah menerapkan dasar hukum antara hukum materiil dan prosedural dalam menerapkan prinsip hak asasi manusia. Analisa terhadap putusan ini sangat memikat sejak terdakwa yang dianggap sebagai pemberontak Gerakan Aceh Merdeka (GAM) di propinsi daerah khusus Aceh. Majelis hakim memutus yang bersangkutan di penjara selama 2,5 tahun meskipun jaksa penuntut tidak memiliki bukti yang cukup untuk membuktikannya bersalah. Menurut penulis, Keputusan pengadilan dalam kasus ini masih menunjukkan kekuasaan dan kewenangan dengan mengabaikan prinsip transparansi peradilan.Keyword : Hukum materiil, pemberontak, prinsip hak asasi manusia]]>
