<![CDATA[ABSTRAKPada tanggal 17 Januari 2012, Mahkamah Konstitusi sebagai lembaga yang berwenang melakukan uji formil dan materiil terhadap UUD 1945, telah melakukan Uji Materiil Konstitusionalitas Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Di dalam amar putusannya yang tertuang di dalam Putusan Nomor 27/PUUIX/2011, Mahkamah Konstitusi menyatakan bahwa Pasal 65 ayat (7) dan Pasal 66 ayat (2) huruf b UU Nomor 13 Tahun 2003 tentang Ketenagakerjaan adalah tidak konstitusional bersyarat (conditionally unconstitutional). Apabila makna putusan itu kemudian ditelaah secara a quo, maka secara tidak langsung Mahkamah Konstitusi menerapkan konsep ilmu hukum pembangunan ekonomi dalam upaya pencegahan eksploitasi pekerja outsourcing, sehingga terciptalah keadilan dalam hubungan ekonomi.Kata kunci: pekerja alih daya, tidak konstitusional bersyarat.ABSTRACTOn 17 January 2012, the Constitutional Court, as an institution authorized to perform formal and substantive review on the 1945 Constitution of the Republic of Indonesia, has done Judicial Constitutional Review on Law Number 13 of 2003 concerning Labours. In the verdict of the Decision Number 27/PUU-IX/2011, the Constitutional Court stated that Article 65, paragraph 7, and Article 66 paragraph 2 letter b of Law Number 13 of 2003 concerning Labours is conditionally unconstitutional. If the verdict is explored and interpreted in a quo, then it implies that the Constitutional Court has applied the concept of Laws on Economic Development in efforts to prevent the exploitation of outsourced labours and thus create justice in economic relations.
