<![CDATA[ABSTRACTJustice is the ultimate purpose of law. According to progressive law perspective, the judges must extensively try to understand all aspect of the environmental law. It is very poor if the verdict by judges only based on formal rules or laws. The result of this formal procedural is to realized a legal justice or procedural justice. But it is not enough because the effects of unlawful action to society must be calculated. Through this analysis, the author wants to stresess that substantial justice is more important than procedural or legalistic justice, because substantial justice meet the demand of society as the subject of law or rules. The right of healthy environment is a part of human rights. This is the merit of progressive law theory. Berkaitan dengan pandangan hukum progresif, hakim harus lebih ektensif untuk memahami berbagai aspek dalam hukum lingkungan, bukan sebaliknya sehingga putusan hakim tidak hanya berdasarkan hukum formal saja. Prosedur formal hanya akan menghasilkan keadilan hukum atau keadilan prosedural saja, namun tidak akan cukup efektif di masyarakat sehingga kebijakan ini harus dikaji ulang. Dalam kajian ini, penulis ingin menekankan keadilan substantif lebih penting dibandingkan keadilan legalistik karena keadilan substantif lebih dibutuhkan oleh masyarakat. Dalam kasus hukum lingkungan terdapat hak lingkungan yang sehat sebagai bagian dari HAM.
