Abstract

The development of human civilization, among others supported by the occurrence of the Cognitive and Science revolution. Humans have a new ability to pass on information in greater quantity about the world around them, including social relations. Limited liability company and human rights. As a result, collaboration can be established between people who do not know each other in very large numbers. Rapid social innovation. One of the interesting advances in technological innovation is the advent of internet technology. The internet changes the way people do business, socialize, share information and even change behavior and life between individuals / groups. With internet technology, it is possible to communicate without limitation of distance and time. Business start-ups emerged around 1998-2000, facing the beginning of the global economic crisis. Initially, this business was only a business for services and products that many people needed. However, since the dot-com era skyrocketed, business start-ups have become increasingly popular. No wonder the start-up business tends to be known as a business that smells of technology, sites, and the internet. Some tips for start-up businesses, what aspects need to be considered from the beginning to the start of the business. Among them are forming a CV or PT, protecting the company's brand, raising funds / capital, Special Licenses Related to Electronic Transactions and paying attention and reporting annual taxes. But more specifically, there are also a number of obstacles that must be regulated and watched out for by startups, namely the technology used, the HR that runs always innovative and can read the market well, manage the business / object being run, leadership and business management, and the necessity pay Taxation. In addition, business people or businesses should pay attention to the legal aspects of Law Number 40 of 2007 and the Republic of Indonesia Presidential Regulation of 2014 concerning Limited Liability Companies (PT). Also the Civil Code, especially Law Number 11 Year 2008 and amendment Number 19 of 2016 concerning Information and Electronic Transactions. Also the Consumer Protection Act. So, it would not hurt to try to start a business by utilizing social media technology that is owned (FB, WA, Line, etc.). However, for start-up businesses, they should pay attention to aspects such as products and brands to be marketed, and good business management and to learn and pay attention to the rules of electronic use and its legal aspects.

Abstract

The need for some funds often sought by way of debts with collateral in the form of Certificate of Property Rights. Lenders give receivable amount of money and the debtor receives the money as a debt to be paid to ensure the certificate with the approval of the National Land Agency (BPN) local. Certificate of Property Rights examined by BPN and certainly not in a state of conflict and or controlled by others. With the approval of the Certificate Properties BPN on a piece of land can be used as an object of mortgage. But in practice, it turns out there is a case stating that there has been falsification of certificates Proprietary used as places Encumbrance causing losses for owners of valid Certificate of Property Rights. Forgery that is the starting point disputes that serve Certificate Object Properties Mortgage. The dispute is to be resolved.

Abstract

The mining divestment policy has 3 main key components. First, how much is thedivestment amount. Second, who can buy divested shares. Third, how much is the saleprice of the divested shares. The first element, the divestment requires that everyforeign-owned mining company divest a portion of the increased shares to thegovernment, BUMN or national private sector. (Government Regulation Number 1of 2017, concerning Amendments to Government Regulation Number 23 of 2010,concerning the Implementation of Mineral and Coal Mining Business Activities).The second element, regarding the divestment rules, determines who can buy(Permen ESDM No. 9 of 2017, concerning Procedures for Stock Divestment andMechanism for Determining the Price of Divestment Shares in Minerba MiningBusiness Activities).While the third element is the rule that determines the stock pricewhen it is sold, the share price offered to the Government is determined throughnegotiation. (Government Regulation No. 23 of 2010, concerning theImplementation of Mineral and Coal Mining Business Activities).Industrialdevelopments in the country are still difficult to do, including mining. According toArchandra Tahar, Deputy Minister of Energy and Mineral Resources (ESDM) thereare at least three factors inhibiting the development of the mining sector in Indonesia.These three factors are the problem of banking, technology and political interestrates.

Abstract

In Indonesia, according to information from Deputi Bidang Pembiayaan Kementerian Perumahan Rakyat, there are millions of people who do not own their own home. The problem that frequently encountered is the problem of lack of funds. Distribution of the mortgages loan had not yet reached the low-income people. The potential distribution of mortgages loan for low-income people reached 34 million people. However, opportunities for low-income people to have decent housing was constrained by the government with the issuance of Undang-Undang Nomor 1 Tahun 2011 on Housing and Settlement Region set a minimum floor area of 36m2 house (square meters). With that restriction the price of the house would become increasingly unaffordable for the low-income people. Constraints are contained in Article 22 paragraph (3). Abstract

The presence of data innovation in the current era of globalization has progressed rapidly. This development can be seen from the proliferation of electronic commerce (e-commerce) in the trade, government, health, education, and mobile internet sectors. Personal Data is certain individual data that must be treated, then stored and kept true for all important data and must be kept confidential. Also, everyone has the option of obtaining legal guarantees against protection and mediation relating to individual matters. The development of information technology indirectly changes the mindset, including territorial boundaries, time, logic of thinking, work patterns, to manual behavior towards digital demands. The era of digitalization so far has not been able to provide definite legal protection. This is indicated by the rise of leaks because they have reaped logical consequences in the form of technologybased crimes because the existence of a computerized or digitized system has not been able to be prevented properly. This article uses normative juridical research methods, namely library research related to applicable laws and regulations, legal principles and relevant library sources. Everyone has the right to guarantee the protection of personal data. The ratification of the Personal Data Protection Bill into a law and the establishment of an independent institution must be carried out immediately so that the public feels more secure about their right to privacy. In addition, the lawsuit mechanism against the acquisition of personal data without the consent of the relevant parties can be made clearer along with the compensationprocess.

Abstract

Building the character of millennials in the era of revolution 5.0 in filling independence is an obligation as a large-populated country such as the Unitary State of the Republic of Indonesia. In facing it, it is necessary to prepare a resilient and characterful generation facing the challenges in revolution 5.0, which is growing at this time, namely applying Pancasila values for the younger generation that can be implemented in the right momentum. In reality, some young people are now damaged by morals because of various things that affect them. Influences include the adverse effects of globalization, friends, increasingly sophisticated electronic media, drugs, liquor, and other harmful things. This research aims to direct the younger generation in building the nation. Research methods using literature studies are data collection techniques by conducting study studies of books, literature, and others. The results of this research confirm that the younger generation at the time of revolution 5.0 still needs direction and understanding in the life of the nation and state. The conclusion is that the younger generation, as the holder of the leadership relay, needs to be equipped with a national character with Pancasila spirit. So that the relay of the continuity of the nation to be maintained by the republic will be the unity and unity of the country and the realization of our national goals.

Abstract

Information technology has a very important role, both now and in the future. In reality, although there are a number of laws and regulations that prohibit hate speech in public spaces, there are still few people who realize that this act is a violation of the law, not only the perpetrators but also the victims and even the officers. This journal aims to find out the implementation of Law No.19 of 2016 concerning Information and Electronic Transactions in the development of criminal crimes that occur in Indonesia, especially in cybercrimes. The author intends to directly describe social phenomena based on indicators whether or not the phenomenon under study regarding the implementation of the Law on Information and Electronic Transactions and Pancasila regarding law enforcement related to cybercime in Indonesia is currently happening. Therefore, it is the joint responsibility of the government, law enforcement officers/Polri and TNI as well as all elements of society to combat the turmoil of cyber crime, SARA, etc., based on relevant legal materials, namely primary legal materials, secondary legal materials and tertiary legal materials. The basis for law enforcement that can answer the demands of society must be responsive law, otherwise the law will lose its spirit. Morals and justice are the spirit of the law. Legal reform must look back at the solidity of morality that lives, grows and develops in society. Against this note, the author views that the choice of revision of the Law on Information Electronic and Transactions does not have to come from the DPR. The President as one of the law-forming institutions, based on the provisions of Article 5 paragraph (1) of the 1945 Constitution of the Republic of Indonesia is also authorized to propose revisions to the Law Information and Electronic Transactions which urgently needs to be carried out.

Abstract

Melonjaknya harga minyak goreng di Indonesia tidak lepas dari meingkatnya harga Crude Palm Oil(CPO) atau minyak mentah dunia. Situasi itulah yang mendorong meningkatnya ekspor CPO Indonesia ke pasar internasional sehingga memicu terjadinya kelangkaan minyak goreng di pasar dalam negeri. Pemerintah akhirnya mengeluarkan kebijakan pelarangan ekspor CPO terhitung sejak 28 April 2022. Namun tidak lama kemudian yakni tepatnya pada tanggal 23 Mei 2022, larangan ekspor CPO telah dicabut kembali seiring dengan kembali melimpahnya pasokan minyak goreng di dalam negeri, terjadinya penurunan harga minyak goreng serta pertimbangan banyaknya pekerja yang terlibat dan bekerja pada industri kelapa sawit. Metode penelitian yuridis normatif dipergunakan dalam penelitian ini, yakni menempatkan hukum sebagai sebuah bangunan norma. Penelitian ini bersumber dari dokumen kepustakaan. Kesimpulan yang dapat diambil yakni dalam situasi problematis, pemerintah setidaknya mampu mengendalikan dengan menciptakan stake holder berpihak positif terhadap terpenuhinya kebutuhan secara umum di masyarakat, terutama guna menstabilkan harga dan kelangkaan minyak di pasaran.
