Abstract

State need expense to construction and welfare their people, for that the state revenue are needed. In Islamic law there are revenue that can be done through alms and taxes. But in the tax collection implementation, Islamic law had been giving a clear guidance either for Muslims or non Muslims. According to the scholars, the tax collection are allowed of it fulfill three criteria, that is: (1) taxes because to fund expenditure that are really needed to realized Maqasid Syariah; (2) the tax burden should not be to stiff to everyone capable to pay; (3) tax funds that has been collected are spent honestly for a good cause. There is a responsibility for Muslims to pay taxes if the treasury fund need it or empty. Those responsibilities are as a devotion to ulil amri, as stated in An-Nisa letter verse 59, which means: “O believer, obey Allah and obey his Prophets and ulil amri amongst you. Then if you different in opinions about something, then give him him back to Allah (Al quran) and Prophet (his Sunnah), if you truly faithful to Allah and for the next day. Abstract

State-acceptance is very required to improve the people prosperity. There is an acceptance might be done in Islam either by tithe or tax. However, in theimplementation of taxation, Islam Law has given clear guidance through it collection either by Moslem or Non-Moslem. There is an obligation for Moslem to pay for tax if a pay office is requiring it. The obligation as observance toward ulil amri, as called within the holy book of An-Nisa verse 59, is that means: “The faithful be obedient to Allah and it prophets and ulil amri between you are. Then if you different in opinion about something else, so please bring it back to Allah (Al Quran) and Prophet (Sunah), if you really faith to Allah and afterwards. That is more prominent (to you) and gives better result.

Abstract

The community has an important role in enforcing environmental law; therefore, the community needs to be invited to continue to monitor and report various forms of violations of the environment and existing natural resources. The community has rights and obligations in the enforcement and management of the domain. This is because a party is affected in the development process, which often involves environmental sustainability. Related to this, problems arise, what is the role of the community in enforcing environmental law, as well as the obstacles faced in enforcing environmental law. It is necessary to have consistency from various parties related to environmental law enforcement, starting from laws and regulations, implementing officials, and community participation to answer these problems. The normative juridical research approach, descriptive-analytical research specifications, data collection through secondary data in the form of library research and documentation studies, and qualitative analysis methods. One of the emphases made by the community in enforcing environmental law is through environmental organizations, namely through lawsuits in court and with the right to sue, that in the context of implementing ecological management responsibilities by the pattern of partnerships, environmental organizations, the filing of the lawsuit is in the interest of function and preservation. Environment. It should be realized that enforcing the environmental law is not easy, so there are often obstacles, for example, rules that have not been maximally implemented, law enforcement officers who have not been able to have good insight and understanding to solve environmental problems, as well as from public awareness that is still lacking to care about the environment itself and is indifferent, when violations occur.

Abstract

Forest and land fires are hot topics discussed in both the mass media and electronic media. Forest and land fires have a huge impact on the economy and public health. Another impact of forest fires is the loss of various ecosystem benefits contained in the forest, flora and fauna, as well as other potentials contained therein, including biodiversity. The purposes of this paper are: (1) to identify and describe the strategies implemented by the government in an effort to reduce the occurrence of forest and land fires; (2) to know and describe the law enforcement carried out in dealing with forest fires. The results that can be obtained are the strategies that can be used to overcome forest and land fires carried out by the government are: by providing education to the public about the impacts that can be caused by forest and land fires, as well as providing infrastructure assistance in overcoming forest and land fires. Meanwhile, law enforcement against companies or corporations that carry out forest and land fires is still considered very weak and has not run optimally in accordance with the wishes of the law itself. The conclusion is that although the government has taken steps to deal with forest fires, if no action is taken to give sanctions to the perpetrators of forest and land burning, then everything will not work, especially for forest and land burning carried out by companies or corporations.

Abstract

Masalah pembangunan tidak lepas dari permasalahan lingkungan hidup untuk itu perlu adanya penanganan yang serius. Masalah lingkungan hidup negara berkembangan berbeda dengan masalah lingkungan hidup yang dialami negara maju. Masalah lingkungan hidup yang dialami negara berkembang adalah keterbelakanang atau kemiskinan, sedangkan lingkungan hidup yang dihadapai oleh negera maju adalah polusi yang bisa merusak lingkungan hidup. Peran serta masyarakat secara horisontal akan melibatkan masyarakat secara kolektif untuk mempengaruhi keputusan-keputusan kebijaksanaan. Sedangkan peran serta masyarakat secara vertikal akan mencakup segala kesempatan ketika anggota masyarakat mengembangkan hubungan tertentu dengan kelompok elit dan pejabat, sedangkan hubugnan tersebut saling bermanfaat bagi kedua belah pihak. Khusus dalam usaha pelestarian lingkungan peran serta masyarakat, baik perorangan maupun kelompok sangat dibutuhkan. Untuk itu pemerintah telah memberi landasan hukum terhadap peran serta masarakat dalam usaha pelestarian lingkungan.

Abstract

Museum sebagai sarana untuk melestarikan benda-benda cagar budaya perlu diperkenalkan kepada masyarakat dan museum juga sebagai sarana untuk mengenalkan peristiwa peradaban budaya suatu bangsa kepada masyarakat. Tujuan pendirian museum menurut Pasal 2 Peraturan Pemerintah Republik Indonesia Nomor 20 Tahun 2015 tentang Museum, adalah: mempunyai tugas pengkajian, pendidikan, dan kesenangan.Metodologi penelitian ini menggunakan pendekatan yuridis normatif dan lokasi penelitian ada di Museum Jawa Tengah Ranggawarsita Kota Semarang. Tujuan dari penelitian ini adalah untuk memperkenalkan kepada masyarakat tentang benda-benda cagar budaya sebagai koleksi yang ditinggalkan oleh orang-orang dulu serta untuk bahan edukasi bagi masyarakat yang berkaitan dengan peninggalan kebudayaan zaman dulu. Hasil penelitian yang diperoleh adalah Museum Jawa Tengah Ranggawarsita sebagai salah satu museum yang dimiliki oleh negara, menyajikan berbagai macam koleksi benda-benda cagar budaya yang ada di Jawa Tengah. dengan jumlah koleksi sebanyak 59.802 buah, yang di bagi menjadi 10 katagori, yaitu: numismatika/heraldika sebanyak 44.966 benda, ethnografika sebanyak 6.810 benda, keramologika sebanyak 1.200 benda, arkelologika sebanyak 5.211 benda, biologika sebanyak 620 benda, seni rupa sebanyak 397 benda, historika sebanyak 318 benda, geologika sebanyak 201, filologika sebanyak 37 benda, dan teknologika sebanyak 42 benda.

Abstract

The Citarum river problem has been trying to be resolved for a long time. However, this problem is complicated to address because the community is often not involved, even though the community is one of the main components of environmental conservation. This research then looks at how community participation in the Citarum Harum program is viewed from a legal perspective. This study uses a qualitative approach. The data used in this research is secondary data that comes from different research results and studies, as well as laws that still have relevance to the contents of this research. The results of this study then found that community participation helped implement the Citarum Harum program. As viewed from the legal aspect, community participation is in line with Law No. 32 of 2009 concerning the Protection and Management of the Environment and Presidential Regulation Number 15 of 2018 concerning the Acceleration of Control of Pollution and Damage to the Citarum River Basin.

Abstract

Public services in the legal aid field for underprivileged people facing legal problems is a constitutional obligation based on the 1945 Constitution. Through legal instruments and regulations within the scope of the linkages of laws and regulations, it is perceived that they are complete, significantly as imperatively regulated in Law Number 25 of 2009 concerning Public Services and Law Number 16 of 2011 concerning Legal Aid. Regulatory arrangements related to public services in the legal aid field are regulated within the scope of the authority of the Menkumham through National Legal Development Agency (BPHN). Procedures for filing legal aid. Institutions that are given the authority to provide legal assistance on condition that they have been accredited by the Ministry of Law and Human Rights, criteria that have the right to obtain legal aid services. In this study, researchers have taken a normative juridical approach by describing procedures for providing public services in the field of legal aid and the instruments and regulations that cover them or regulate them to fulfill the principles of legal certainty, legal justice, and legal benefits for underprivileged people who face law problem.
