Abstract

This study departs from a compilation of women-themed hadiths that were interpreted progresively by Faqihuddin in his book “60 Hadis Hak-Hak Perempuan Dalam Islam:Teks dan Interpretasi”. Another starting used to study this topic is because women-themed hadiths tend to affrim men’s superiority over women. Of the sixty hadith that have been interpreted, the researcher only chose a few hadiths, which are categorized in four major themes; the principle of male and female relations, women’s dignity, women’s choices and rights, and the relations of husband and wife. This study tries to learn and analyze how Faqihuddin applies the theory of qira’ah mubadalah (reading reciprocally) to these selected hadiths. The approach of this study are conceptual approach and content analysis approach. This study finds that qira’ah mubadalah is a progressive interpretation theory that relies on two things, the universal value of Islam and the substantial understanding of a text. Dialecting both things will be able to produce interpretations that carry the value of equality holistically. In the application level, Faqihuddin has internalized Islamic universalism in facilitating the substance of the text. When interpreting the hadith, Faqihuddin uses three types of interpretation; grammatical interpretation, historical interpretation and sociological interpretation. The first two types of interpretations are used to find the main text; the ground idea of the text. Meanwhile, sociological interpretations are used to reduce main thoughts and expand the meaning egalitarian. Kajian ini berangkat dari kompilasi hadis-hadis bertema perempuan yang diinterpretasikan secara progresif oleh Abdul Kodir dalam bukunya 60 Hadis Hak-Hak Perempuan Dalam Islam:Teks dan Interpretasi. Titik tolak lain yang digunakan untuk mengkaji topik ini adalah karena hadis-hadis bertema perempuan cenderungmeneguhkan superioritas laki-laki atas perempuan. Dari enam puluh hadis pilihan yang telah diinterpretasikan, peneliti hanya memilih beberapa hadis, yang terkategorikan dalam empat tema besar, yaitu prinsip relasi laki-laki dan perempuan, martabat perempuan, posisi dan hak-hak perempuan, dan relasi suami istri. Kajian ini bertujuan untuk mengetahui bagaimana Abdul Kodir mengaplikasikan teori qira’ah mubadalah-nya terhadap hadis-hadis pilihan. Pendekatan yang digunakan adalah pendekatan konseptual (conceptual approach) dan analisis isi (content analysis). Kajian ini menemukan bahwa qira’ah mubadalah adalah teori interpretasi progresif yang  bertumpu pada dua hal, nilai universal Islam dan gagasan substansial sebuah teks. Mendialektikan keduanya akan mampu menghasilkan interpretasi yang mengusung nilai kesetaraan secara holistik. Dalam tataran aplikasi, Abdul Kodir telah mengintegrasikan universalisme Islam dalam memahami substansi teks.

Abstract

Obligations of conjugal need by a husband, also with the issue of responsibility and the husband's condition to provided. As a prisoner makes a polemic to be provided obligation of the husband. the loss of independence and restrictions on movement cant liability, for physically and mentally. Through this research there are can be discussed; first, how to implement the obligations of a prisoner's husband's conjugal need, and how to understand of living according to Islamic law views this crucial issue. The aim  to find the burden of conjugal need status the implication by a husband, which becomes constrained and then as a prisoner. This study was analyzed using a sociological-empirical approach. The results obtained from this study, there are three typologies in the implementation of livelihood obligations of husbands who are prisoners in Rutan Batusangkar; First, implemented with the business going on, and producing. The second is not implemented, the provision of income is inadequate, and the third is not carried out, the opposite is the case, the wife always spends her husband during the criminal period. The view of Islamic law in this case doesnt contradictions, although other side liability for the husband must be fulfilled. Islam seen this with two legal standing, the first is the obligation to maintain a living on the typology of implementation. Second, conjugal need obligations fall and become debt to the typology of the implementation of less and not implemented.

Abstract

This study responds to the Determination of marriage permits by the Jember Religious Court which was accompanied by a Divorce Decision submitted by the same party in a short period of time. Child divorce is the result of hasty marriages, without knowing more about the holistic and substantive meaning of marriage. Methodologically, this study uses a sociological normative approach with primary data on the decisions and decisions of judges at the Jember Religious Court and reduces various cases of child marriage which result in divorce at a young age. The result is that the judge uses the diction "worried" in each determination and tends not to represent urgent events or events for marriage. In the end, not a few cases of divorce/divorce were filed by the party who originally applied for a marriage permit. Therefore, it is very necessary to make new reasoning and patterns that are limiting in nature, so that it is expected to be able to minimize divorce at a young age complete with the consequences it bears.)

Abstract

This study departs from the phenomenon of dying the sacrificial animals before the day of slaughtering at Luhak Nan Tigo, a communal in West Sumatra, Luhak Tanah Datar, Luhak Limo Puluah and Luhak Agam. The death of the sacrificial animals before the day of slaughter certainly makes a problem between the Shohibul Kurbaan and the organizing committee to determine the status of ownership and legal an animal itself. The main issues of this paper at least talk about the regulation of the sacrificial animals at Luhak Nan Tigo and the form of settlement by related parties to the phenomenon. This study was analyzed with a qualitative descriptive model that began describing a phenomenon and then drew a concrete conclusion from various basic sharia laws regarding the status of animal ownership and the value of the sacrificial animals itself. The results of the study found that the process of collecting funds and purchasing the sacrificial animals in Luhak Nan Tigo which became one of the regulations in the view of Islamic law didn’t experience debate, ranging from age, ownership status, to the health of the sacrificial animals. However, the phenomenon of the death of this the sacrificial animals has various forms of settlement which are not regulated exclusively by Islamic law, so the solution found is one cow for more than seven people, replace together, two cows for three groups, and replacing one cow with two goats. The settlement is analyzed with Islamic legal sources and some forms of settlement can be said to be less relevant if viewed in terms of the value and essence of the sacrificial animal itself.

Abstract

This paper discusses about women as wives of convicted criminals in Batusangkar, West Sumatra. This study concentrates on the reasons of their attitudes to stay at becoming wives of these convicted criminals.  This study is an empirical research by utilizing the theory of social action of Max Weber. This article argues that the wives of convicted criminals have chosen to keep their household as a fruit of both traditional and rational action choices. The wife loyalty and the stigmatization of widow status are among traditional values which give strong influence to them. At the same time, some consider their age, their nuclear family and financial needs as rational reasons behind their choice.Tulisan ini membahas tentang perempuan yang menjadi isteri narapidana di Batusangkar, Sumatera Barat. Fokus kajian dalam tulisan ini adalah alasan mengapa mereka tetap memilih bertahan menjadi isteri narapidana. Dengan menggunakan teori tindakan sosial Max Weber, artikel ini menyatakan bahwa para perempuan tersebut tetap memilih bertahan untuk menjadi para isteri narapidana dikarenakan alasan tradisi dan alasan rasional. Kesetiaan perempuan dan stigma negatif terhadap status janda menjadi alasan tradisional yang melatari pilihan mereka. Sedangkan alasan rasional mereka dapat dilihat dari pernyataan di antara mereka yang mempertimbangkan usia mereka yang sudah lanjut. Sebagian lagi mempertimbangkan nasib anak-anak mereka. Terdapat pula sebagian isteri yang berargumen karena kebutuhan ekonomi mereka.

Abstract

This study departs from the widespread social media content created and distributed by conservative groups. One of the topics frequently addressed by this group is family law discourse, which includes instructions for selecting a mate, marriage advice, the fulfillment of rights and obligations in the family, and other topics related to relationships in domestic life. Using Foucault's discourse analysis approach, this article investigates the dominant narratives that portray family law. The data for this study was gathered by examining discourse on the Instagram platforms @nikahsyari.com, @nikahbarokah, and @yuknikah.syari. These platforms were selected based on their popularity—number of followers. This research finds that marriage content on those Instagram platforms reflects what I refer to as fiqh-oriented and gender bias. The vast number of followers divided into online premarital classes enables account managers to subtly support and spread their ideology while attracting as many members as possible to their online courses. As a result, this conservative teaching influences the religious views and practices of their members, particularly regarding marriage and gender relations in the household.Kajian ini berangkat dari maraknya kehadiran konten-konten di media sosial yang dibuat dan disebarkan oleh kelompok konservatif. Salah satu wacana yang sering diusung oleh kelompok ini adalah hukum perkawinan seperti petunjuk memilih jodoh, anjuran menikah, pemenuhan hak dan kewajiban dalam rumah tangga serta topik-topik lain seputar relasi dalam kehidupan rumah tangga. Tulisan ini bertujuan untuk membedah narasi-narasi dominan yang merepresentasikan hukum keluarga dengan pendekatan analisis wacana Foucault. Data penelitian ini didapatkan dengan cara menginvestigasi wacana dalam platform “@nikahsyari.com”, “@nikahbarokah”, dan “@yuknikah.syar_i”. Platform ini dipilih berdasarkan banyaknya pengikut. Penelusuran terhadap konten-konten pernikahan di Instagram ini merepresentasikan hukum perkawinan dengan berorientasi fikih dan bias gender. Jumlah pengikut yang terbilang ratusan hingga ribuan, yang terbagi kedalam kelas-kelas pranikah online, membuat pengelola akun memiliki kuasa atas pengiringan opini dan penyebaran ideologinya sekaligus menarik sebanyak-banyaknya member dalam kelas onlinenya. Konsekuensinya, ajaran konservatif ini mempengaruhi praktik keagamaan dan cara pandang para member terhadap perkawinan dan relasi gender dalam rumah tangga khususnya.
