<![CDATA[POLEMIK PENOLAKAN UQUBAT CAMBUK DI LEMBAGA PEMASYARAKATAN (LP) ACEH ( IMPLEMENTASI PERGUB NO.5 TAHUN 2018 TENTANG HUKUM JINAYAT DI BANDA ACEH)Andri Kurniawan[1] Cut Maya Aprita Sari[2](andriikurniawann@gmail.com, cutmayaapritasari@unsyiah.ac.id)Program Studi Ilmu Politik, FISIP, Universitas Syiah Kuala ABSTRAKPergub No. 5 Tahun 2018 tentang hukum jinayat atas pemindahan pelaksanaan uqubat cambuk di lapas telah disahkan sebagai aturan dalam bidang Syariat Islam sebagai pedoman sehari-hari untuk seluruh komponen masyarakat serta sebagai payung hukum bagi masyarakat Aceh. Hampir sebagian besar Kabupaten/Kota di Aceh belum efektif menjalankan Pergub No.5 Tahun 2018 tentang hukum jinayat, seperti kota Banda Aceh. Tujuan penelitian ini untuk mengetahui polemik penolakan uqubat cambuk di lembaga pemasyarakatan (LP) Aceh di Kota Banda Aceh. Penelitian ini menggunakan pendekatan secara kualitatif dengan sumber observasi lapangan, dokumentasi dan wawancara mendalam. Hasil penelitian ini bahwa ada beberapa kendala yang menjadi hambatan dalam tidak terlaksanakannya proses uqubat cambuk di lembaga pemasyarakatan bagi pelanggar Syari’at Islam di Kota Banda Aceh. Terkait fasilitas yang kurang memadai dari lapas yang tidak dapat menampung jumlah penonton yang ingin hadir dalam proses pelaksanaan uqubat cambuk. Kendala terbesar lainnya yaitu perlu adanya transparansi kebijakan yang telah dibuat oleh pemerintah Aceh dalam proses pemindahan uqubat cambuk di lapas. Hal ini terlihat masih banyak pihak-pihak yang berwenang seperti Wilayatul Hisbah dan Satpol PP masih melakukan proses pelaksanaan uqubat cambuk tetap dilaksanakan di pekarangan masjid atau tempat terbuka demi menjaga transparansi dari kebijakan yang telah dibuat pemerintah yang disahkan melalui Pergub No.5 Tahun 2018 tentang hukum jinayat atas pelaksanaan uqubat cambuk di lapas. Kesimpulan penelitian ini bahwa Dinas Syari’at Islam, Satpol PP dan WH masih menjalankan peraturan yang telah dibuat oleh Qanun Jinayat, sebelum adanya perintah yang wajib dari Gubernur Aceh terkait pemindahaan pelaksanaan uqubat cambuk di lembaga pemasyarakatan. The purpose of this research is to know the polemic rejection Uqubat whip in the prison (LP) of ACEH in Banda Aceh. The study used a qualitative approach with field observation sources, documentation and in-depth interviews. The results of this research that there are some obstacles that have become an obstacle in not doing the process of whip Uqubat in correctional Institution for sharia offenders in the city of Banda Aceh. Regarding the insufficient facilities of the prison that can not accommodate the number of spectators who want to attend the process of the whip Uqubat execution. Another biggest obstacle is the need for transparency of policy that has been made by the ACEH government in the process of transferring the whip Uqubat in the prison. This is seen there are still many authorities such as Wilayatul Hisbah and Satpol PP still perform the process of execution of the whip Uqubat remain implemented in the yard of the mosque or the open place to maintain the transparency of the policy that has been made government passed through the struggle No. 5 year 2018 on the law of Jinayat on the implementation of the whip Uqubat Conclusion of this research that Dinas Syari'at Islam, Satppol PP and WH are still running the rules that have been made by Qanun Jinayat, before the mandatory orders from the governor of Aceh regarding the transfer of the execution of the whip Uqubat in Correctional Institution.
