<![CDATA[Abstrak - Pasal 7 Ayat (3) KUHAP telah mengatur tentang penanganan suatu tindak pidana yang diawali tingkat penyidikan sampai ke pelaksanaan putusuan, selain KUHAP terjabar tentang khusus kedalam perlindungan anak dimana untuk menangani anak yang berhadapan dengan hukum diperlukan penanganan khusus terhadap anak tersebut.Tujuan penulisan skripsi ini adalah Untuk menjelaskan mengenai perlindungan hukum terhadap anak yang menjadi korban kekerasan seksual di Kepolisian Resor Kota Banda Aceh, untuk menjelaskan mengenai upaya penyidik terhadap pelaku dalam tindak pidana kekerasan seksual terhadap anak yang terjadi di wilayah kabupaten Aceh Besar tapi di tangani oleh Polresta Banda Aceh dan untuk menjelaskan mengenai hambatan penyidik Polresta Banda Aceh dalam menangani setiap kasus kekerasan seksual terhadap anak.Penelitian ini menggunakan metode penelitian hukum empiris dengan jalan mengidentifikasikan hukum sebagai perilaku yang mempola. Analisis pengumpulan data dilakukan dengan cara menggunakan pedekatan kualitatif berupa data primer,Teknik observasi, sampel, dan pengumpulan data dengan melakukan wawancara secara langsung dengan responden dan informan sehingga dapat memberikan analisis karya ilmiah.Hasil penelitian menunjukan bahwa penangan terhadap korban pelecehan seksual pihak Satreskrim sendiri sudah melakukan penyidikan terhadap kasus ini serta menangkap pelaku dan melakum visum terhadap korban pelecehan tersebut, pihak Satreskrim sendiri juga sudah melakukan pelindungan hukum terhadap anak sebagai korban kekerasan seksual, anak yang menjadi korban perlu juga mendapatkan perhatian khusus baik dari dinas sosial dan rumah aman mengingat faktor usia anak tersebut masih sangat muda. Upaya-upaya penyidik dalam menangani kasus kekerasan seksual ini pihak penyidik dari Polresta Banda Aceh setalah mendapat laporan serta mengumpukan bukti-bukti maka selanjutnya penyidik menangkap pelaku untuk penahanan dan penyidik mengirim berkas ke Kejaksaan Negeri Banda Aceh. Dari segi hambatan pihak penyidik tidak memiliki hambatan-hambatan ataupun kendala-kendala pada saat penangkapan pelaku karena polisi menuju ke TKP pada sore hari menjelang magrib setelah melakukan pemeriksaan terhadap pelaku penyidik membawa pelaku ke Polresta Banda Aceh untuk dimintai keterangan lebih lanjut.Disarankan agar ketentuan-ketentuan yang ada dalam Pasal 7 Ayat (3) KUHAP tentang penyidikan dan Undang-Undang Perlindungan Anak diterapkan dengan baik dan benar guna melindungi anak yang manjadi korban termasuk meningkatkan koordinasi antara penyidik dan psikolog.Kata Kunci: Hambatan, Penanganan, Perlindungan Hukum, Tindak Pidana Pelecehan Seksual, Upaya Penanggulangan. Abstract - Article 7 Paragraph (3) The Criminal Code Procedures has regulated the handling of criminal acts ranging from the level of investigation to the implementation of decisions, besides that Criminal Code Procedures specifically also regulates child protection, to deal with children who are dealing with the law special handling is needed for these children..The aim of this study is to explain the legal protection of children who are victims of sexual violence in the Banda Aceh City Police Department, investigator's efforts against the perpetrators of crimes of sexual abuse violence against children that occurred in the district of Aceh Besar but handled by the Police Banda Aceh and Constraints for Banda Aceh City Police investigators in handling every case of sexual violence against children.This study uses empirical legal research methods by identifying the law as patterned behavior. Analysis of data collection is done by using qualitative approaches in the form of primary data, observation techniques, samples, and data collection by conducting interviews directly with respondents and informants so that can provide analysis of scientific work.The results showed that the handling of victims of sexual abuse by Satreskrim himself had investigated this case and arrested the perpetrators and conducted a Visum et repertum on victims of sexual abuse, Satreskrim itself had also provided legal protection for children as victims of sexual violence, victims who needed special attention from services social and home security, given the age factor of very young children. The investigators' efforts in handling cases of sexual violence investigators from the Banda Aceh Police Office after receiving reports and collecting evidence then investigators arrested the perpetrators for detention and investigators sent files to the Banda Aceh District Attorney's Office. In terms of the obstacles the investigators did not have obstacles or obstacles at the time of the arrest of the perpetrators because the police headed to the locus delictie on the afternoon before sunset after conducting an examination of the perpetrators of the investigation to bring the perpetrators to the Banda Aceh Police for further information.It is recommended that the provisions contained in Article 7 Paragraph (3) of the Criminal Code ProcedureS concerning investigations and the Child Protection Act be applied properly and correctly in order to protect children who become victims, including increasing coordination between investigators and psychologists.
