Abstract

Tujuan penelitian ini adalah untuk menjelaskan faktor penyebab terjadinya tindak pidana pencurian, hambatan penyidik dalam menanggulangi tindak pidana pencurian baterai listrik tenaga surya, serta menjelaskan upaya dalam pencegahan pencurian baterai listrik tenaga surya. Data penelitian ini diperoleh melalui penelitian kepustakaan dan lapangan. Data sekunder dilakukan dengan cara mempelajari kitab undang-undang hukum pidana, peraturan perundang-undangan, buku, serta artikel yang berkaitan dengan tindak pidana pencurian baterai listrik tenaga surya. Penelitian lapangan dilakukan untuk mendapatkan data primer melalui wawancara dengan responden dan informan.Hasil penelitian menunjukkan bahwa tindak pidana pencurian baterai listrik tenaga surya tersebut karena faktor ekonomi, rendahnya pemahaman tentang hukum, karena adanya kesempatan. Hambatan penyidik dalam menanggulangi tindak pidana pencurian tersebut karena sulitnya mencari pihak yang bertanggung jawab disebabkan barang tersebut milik Negara, serta sulitnya dalam mencari saksi yang melihat kejadian langsung. Upaya yang dapat dilakukan dalam melakukan pencegahan pencurian baterai listrik tenaga surya yaitu dengan melakukan pengawasan dan memperketat penjagaan di area tersebut. Disarankan kepada pihak yang berwenang hendaknya melakukan koordinasi antar penegak hukum, mendayagunakan prosedur dan mekanisme peradilan pidana, serta disarankan kepada pihak yang mempunyai kewenangan dalam hal pengurusan baterai listrik tenaga surya agar dapat melakukan pengawasan dan pencegahan dari dinas atau perusahaan yang terkait.Crime of Theft by weighting stipulated in Article 363 of the Criminal Code which states that threatened imprisonment of 7 years against cattle theft, burglary at the fire time, volcanic eruptions, earthquakes, floods, riots, insurrection or war danger, theft at night, theft committed by two or more people, and theft committed by damaging, cutting or climbing, or by using false keys, false commands or false positions. Although it is stipulated that theft as a prohibited act but there are many cases of theft in reality.The aim of this thesis is to explain the factors causing the occurrence of the theft crime, the obstacles of investigators in tackling the crime of solar electric battery theft, as well as describing the efforts in the prevention of the solar power theft. Data of this thesis were obtained through library and field research. The secondary data is done by studying the laws of criminal law, legislation, books and articles relating to the theft of solar power batteries. Field research was conducted to obtain primary data through interviews with respondents and informants. The results showed that the theft of solar electric batteries occurs due to economic factors, low understanding of the law, the chance. The barriers from investigators in tackling the crime of theft are the difficulty of finding the responsible party caused such goods belong to the State, as well as the difficulty in finding witnesses who saw the incident directly. Efforts that can be done in the prevention of solar electric battery theft are to conduct surveillance and tighten the guard in the area. It is suggested that the authorities should coordinate among the law enforcement agencies to utilize procedures and criminal justice mechanisms, and it is also suggested to the parties who have authority in the management solar power battery to conduct surveillance and prevention of offices or related companies.
