Abstract

Adanya basis kekuatan ekonomi yang beralih ke tangan istri ditambah dengan pengaruh budaya negara di mana perempuan pekerja migran pernah bekerja, alih-alih menjadi bergesernya pola relasi gender dalam keluarga perempuan pekerja migran. Pergeseran pola relasi gender ternyata bukan akar dari eskalasi cerai gugat, melainkan ketidakadilan gender (beban ganda, stereotipe, dominasi, subordinasi dan kekerasan) yang sudah lama dirasakan oleh para perempuan pekerja migran dalam kehidupan rumah tangganya itulah yang merupakan akar penyebabnya.

Abstract

Ngemplang (javanese term to call nonpayment deed of obligation) has been frightening many Batik industrialists in Pekalongan. In short, it harmed Batik industrial badly. They should get some profits for their work, just because of partner who broke the agreement by not settle his obligation, it would be gone and away. Unfortunately, the cheating practice has looked a like to be an habit in Pekalongan Batik industrials. So, I intended to study closer this phenomena and brought the facts to you. Therefore, I gathered the primary data (field research) purposively in order to show the details of Ngemplang deed in Pekalongan Batik industrials, ins and outs. I did so to the dispute resolution of it. The data were analyzed by using symbolic interactions theory and market-firm one. The result show us that ngemplang might occurred in every single chains of industry: from supplying phase, in the beginning, up to marketing one. To arrange the ngemplang dispute, the victims (owner) has performed all the way in which they can draw their credits back. Somehow, they collected the claim from ngemplang doer by hook or by crook, by using mediation; hiring some debt collectors; and/or seizing the debitorís assets/properties, activa and passiva.

Abstract

This study aims to analyze the effectiveness of the implementation of compulsory registration of fiduciary security as stipulated in Article 11 of Law No. 42 of 1999 concerning Fiduciary Security in mudharabah financing at Baitul Maal wat Tamwil (BMT) Pekalongan, as well as the legal implications when fiduciary security is not registered at the Fiduciary Registration Office. Interviews and literature studies were used to collect data, while data triangulation was applied to ensure credibility, and the Interactive Model was used to analyze the data. The results show that the fiduciary registration requirement as stipulated in Article 11 paragraph (1) of the Fiduciary Security Law has not been effectively implemented because: (1) substantively, the article is not yet fully understood by all parties affected by the regulation; (2) law enforcement officials have not provided optimal services; (3) the legal infrastructure and facilities available do not yet provide sufficient ease and accessibility to implement the regulation; and (4) there is a lack of legal awareness among BMT managers. Legal consequences arise if fiduciary security is not registered at the Fiduciary Registration Office, namely: (1) the non-fulfillment of the principles of specialty and publicity; (2) the absence of preferential rights (the right of precedence) in debt repayment if the debtor defaults; and (3) the lack of executorial power.
