Abstract

 Abstrak: Itsbat nikah merupakan sebuah proses penetapan pengesahan pernikahan yang telah dilangsungkan berdasarkan syariat Islam, namun tidak dicatat di KUA. Tujuan dari itsbat nikah adalah untuk mendapatkan akta nikah sebagai bukti sahnya perkawinan sesuai dengan peraturan perundang-undangan yang berlaku di Indonesia, sebagaimana diatur dalam pasal 2 ayat (1) dan (2) UU No. 1 Tahun 1974 dan pasal 7 ayat (1), (2), dan (3) Kompilasi Hukum Islam. Prosedur pengajuan itsbat nikah di Pengadilan Agama Manado setelah berlakunya Undang-Undang Nomor 1 Tahun 1974 yaitu, melakukan pendaftaran ke Pengadilan Agama Manado, membayar panjar biaya perkara, menunggu panggilan sidang dari pengadilan, serta menghadiri persidangan dan putusan pengadilan. Ada beberapa yang menjadi alasan pengajuan itsbat nikah di Pengadilan Agama Manado, antara lain; (1) kehilangan akta nikah, (2) pengurusan perceraian, (3) Perkawinan yang dilangsungkan sebelum berlakunya UU No. 1 Tahun 1974, dan (4) perkawinan yang dilakukan oleh mereka yang tidak mempunyai halangan perkawinan menurut Undang-Undang No. 1 Tahun 1974. Perkara itsbat nikah (pengesahan nikah) bisa diajukan secara voluntair (permohonan) dan diajukan secara kontentius (gugatan) ke pengadilan agama. Dasar pertimbangan hakim dalam memberikan penetapan itsbat nikah di Pengadilan Agama Manado diantaranya yaitu: 1) Legal standing (kedudukan hukum) pemohon untuk mengajukan perkara itsbat nikah di pengadilan agama berdasarkan ketentuan pasal 7 ayat (4) KHI, 2) Posita (fakta kejadian dan fakta hukum), 3) Keterangan saksi dan bukti di persidangan, serta 4) Alasan-alasan mengajukan itsbat nikah. Kata Kunci: Perkawinan, Itsbat Nikah, Voluntair, Pengadilan Agama Abstract: Itsbat of marriage is an endorsement of the assignment process, which has been held on the basis of Islamic jurisprudence, but not recorded at KUA. The goal of itsbat is to get a marriage license deed as evidence of legitimate marriage in accordance with the legislation in force in Indonesia, as provided for in article 2 paragraph (1) and (2) of law No. 1 of the year 1974 and article 7 paragraph (1), (2) and (3) Compilation Of Islamic Law. Itsbat procedure for making marriage a religious Court in Manado, after the enactment of law number 1 year of 1974, namely, registration to court Religious bias, pay fees, waiting for the call from the Court of session, as well as attend the trial and the verdict of the Court. There are some who became the reason of filing itsbat of marriage in a religious Court in Manado, among others; (1) the lost deed, (2) management, (3) the marriage took place before the enactment of law No. 1 year 1974, and (4) a marriage conducted by those who have no impediments to marriage according to the law No. 1 year 1974. Itsbat matter of marriage (endorsement of marriage) may be filed in voluntair (the petition) and filed in kontentius (the suit) to the Court. Basic consideration of judges in giving the setting of itsbat marriage in a religious Court in Manado of which namely: 1) Legal standing (legal position) the applicant to litigate itsbat marriage in a religious court based on the provisions of article 7 paragraph (4) KHI, 2) Posita (facts and legal facts of the incident), 3) witnesses and evidence in the trial, as well as 4) the reasons for filing the itsbat marriage.

Abstract

The main problem in this study is the legality of zakat managers' existence and the effectiveness of zakat management at mosques and langar in Banjarmasin as the most significant potential among Banjarmasin people who are known to be religious. The research seeks to reveal the existence and role, and efforts to revitalize the presence and function of amil zakat formed by the ta'mir/ mosque administrators who are the research objects. The research method applied is classified as field research. The research type is qualitative research. Data mining is carried out by interviewing the mosque ta'mir administrators and the committee / amil zakat and BAZNAS Banjarmasin administrators. Also, data collection is carried out by documentation. Based on the study results, it was found that the existence of amil zakat in most mosques in Banjarmasin. According to the zakat law, the form of committees was formed seasonally before Eid al-Fitr and did not formally and permanently establish management as Zakat Collection Units (UPZ). Only a small number of them have officially started the administration of amil zakat to become UPZ. The existence of amil, which is only ad hoc, has not shown the maximum function and role in the direction of zakat, especially in the management of zakat fitrah. Most of the amil/zakat committees formed by mosque administrators are only limited to serving the acceptance and distribution of zakat fitrah. The type of zakat mal is still relatively small. Regarding the optimization of the collection, especially the kind of zakat mal, the amil / mosque zakat committee, which is the subject of this research, has never made any efforts to pick up the ball (zakat mal) to the surrounding muzaki. Socialization or invitations for zakat distribution through amil's mosque are also only carried out in limited media (through mosque loudspeakers or banners).

Abstract

Purpose – This study aims (i) to analyze the readiness of zakat management institutions in zakat digitalization and (ii) to analyze the problems and solutions in managing zakat funds through digital platforms.Methodology – The study used two methods, called the interview and the Delphi-ANP methods. The data used in this study were the results of interviews with zakat managers (OPZ) in South Kalimantan (BAZNAS and LAZNAS). Besides practitioners, it also involved experts from various universities in South Kalimantan.Findings – The results showed that most zakat institutions in South Kalimantan, Most zakat institutions have a good understanding and readiness to shift to digital platforms. Based on the analysis of problems and solutions in using digital platforms in zakat management, the study found alternative priority problems and solutions for zakat institutions. The problems and solutions covered human resources, IT, institution management and socialization and communication, muzakki, society, government and digitization. In particular, the main cluster of priority problems was management, and the main cluster of priority solutions included human resources.Originality – The researchers reviewed several studies that explained problems and theories of zakat management through digital platforms. However, there is still seemingly no study reviewing problems to manage zakat funds through digital platforms provided by zakat institutions.Practical implications – This research shows that OPZ needs to recruit IT and Digital Marketing people. In addition, it suggests OPZ designs and creates crowdfunding, e-wallet, e-commerce, website, and social media. Following that, OPZ should do digital planning for zakat collection and training conducted by BAZNAS Province and Center to OPZ periodically. They also need to establish a partnership with scholars (Ulama) and the government agencies to increase the payment zakat digitally.

Abstract

Kota Banjarmasin merupakan kota yang memiliki begitu banyak aliran sungai dan dihuni mayoritas oleh kaum muslim, yang seyogyanya mengerti akan pentingnya manfaat sungai karena Islam mengajarkan hal tersebut. Namun kenyataannya masih banyak masyarakat yang membuang sampah ke aliran sungai bahkan membangun pemukiman di bantaran sungai. Tujuan penelitian ini adalah untuk mengetahui efektivitas implementasi kebijakan pemerintah terhadap konservasi sungai di Kota Banjarmasin dan mengetahui respon masyarakat muslim Banjarmasin terhadap kebijakan pemerintah terkait konservasi sungai di Kota Banjarmasin, serta mengetahui sejauh mana kultur pemahaman keagamaan dan persepsi masyarakat muslim di Kota Banjarmasin yang dapat mendukung terhadap upaya pemanfaatan dan konservasi sungai. Penelitian ini merupakan penelitian lapangan, dengan masyarakat kota Banjarmasin dan dinas-dinas terkait sebagai subyek penelitian. Teknik pengumpulan data yang digunakan adalah wawancara, observasi dan studi dokumentasi. Teknik analisis penelitian secara deskriptif dan menggunakan modal teoritik yang dimiliki oleh peneliti. Berdasarkan hasil penelitian diketahui bawah Kebijakan konservasi sungai telah diatur dalam berbagai regulasi oleh Pemerintah Kota Banjarmasin, bahkan menjadi isu strategis dalam perencanaan tata ruang wilayah Kota Banjarmasin 2013-2032. Kebijakan tersebut mendapat respon positif dari masyarakat Kota Banjarmasin, namun partisipasi dan keterlibatan mereka terhadap konsevasi sungai masih rendah. Selain itu, pemahaman keagamaan masyarakat muslim di Kota Banjarmasin dalam pemanfaatan dan konservasi sungai juga masih rendah karena belum didukung oleh pengetahuan mereka terhadap konsep fikih dan aturan-aturan terkait pemanfaatan air dan pelestarian sumber air dan konservasi lingkungan. Banjarmasin city is a city that has so many rivers and is inhabited by the majority of Muslims, who should understand about the importance of the rivers’ benefits because Islam teaches it. However, in reality there are still many people who throw garbage into the river, even build settlements along the river. The purpose of this study is to determine the effectiveness of the implementation of government policies on river conservation in Banjarmasin City and to know the response of the Banjarmasin Muslim community to government policies related to river conservation in Banjarmasin City, and to know the extent to which the culture of religious comprehension and perceptions of the Muslim community in Banjarmasin City can support the river utilization and conservation efforts. This research is a field research, with the people of Banjarmasin city and related agencies as research subjects. The techniques of data collection used were interviews, observation and documentation study. The research analysis technique is descriptive and uses theoretical capital owned by the researcher. Based on the research results, it is known that the river conservation policy has been regulated in various regulations by Government of the Banjarmasin City, and has even become a strategic issue in the spatial planning of Banjarmasin City 2013-2032. This policy received a positive response from the people of Banjarmasin City, but their participation and involvement in the river conservation was still low. In addition, the religious understanding of the Muslim community in Banjarmasin City in the use and conservation of rivers is also still low because their knowledge is not supported by their knowledge of the fiqh concept and rules related to water use and preservation of water sources and environmental conservation.

Abstract

This article seeks to identify and describe the construction of zakat thought contained in a number of local works by Banjarese Ulama and to find the relevance of zakat thought as proposed by modern zakat management concepts. The study of the Banjar Ulama's conception of zakat thought was carried out through reading library materials in the form of a number of fiqh works written by Banjar Ulama in the 18-19M century which were also the targets or objects of study. The search results and analysis of the intended local fiqh literature found a number of constructs for discussion of zakat fiqh that discuss the legal provisions of zakat obligations, criteria for zakat objects, zakat distribution mechanisms, the concept of productive zakat, and amil criteria, as well as zakat management authority. From a number of fiqh formulations found, some provisions are still limited conventionally and conservatively, especially regarding the subject of zakat and the criteria for assets which are the object of zakat. While some contain jurisprudence ideas that are relevant to the context of modern management in zakat management, namely related to the productive use of zakat, zakat agency institution with their various duties and functions, and the active role of the government in providing regulatory support and facilitation of operational facilities and infrastructure for zakat management. Some of these fiqh ideas can even be considered as a progressive thought that transcends fiqh thinking in the context of their time.Tulisan ini berupaya mengidentifikasi dan mendeskripsikan konstruksi pemikiran zakat yang terdapat dalam sejumlah karya lokal Ulama Banjar serta menemukan relevansi pemikiran zakat yang dikemukakan dengan konsep manajemen zakat modern. Kajian tentang konsepsi pemikiran zakat Ulama Banjar ini dilakukan melalui penulusuran bahan pustaka berupa sejumlah karya fikih yang ditulis Ulama Banjar dalam rentang abad 18-19M yang sekaligus menjadi sasaran atau objek kajian. Hasil penelusuran dan telaah dari literatur fikih lokal dimaksud menemukan sejumlah konstruk bahasan fikih zakat yang mengulas seputar ketentuan hukum kewajiban zakat, kriteria objek zakat, mekanisme distribusi zakat, konsep zakat produktif, dan kriteria amil, serta otoritas pengelolaan zakat. Dari sejumlah rumusan fikih yang ditemukan tersebut sebagian ketentuannya masih terbatas secara konvensional dan konservatif terutama menyangkut subjek zakat dan kriteria harta yang termasuk objek zakat. Sementara sebagian lagi mengandung gagasan fikih yang relevan dengan konteks manajemen modern dalam pengelolaan zakat, yakni terkait pendayagunaan zakat secara produktif, lembaga keamilan dengan berbagai tugas dan fungsinya, serta peran aktif pemerintah dalam memberikan dukungan regulasi maupun fasilitasi sarana dan prasarana operasional pengelolaan zakat. Beberapa gagasan fikih tersebut bahkan juga dapat dinilai sebagai sebuah pemikiran progresif yang melampaui pemikiran fikih pada konteks zamannya.

Abstract

Abstract: This study discusses the implementation of the DSN-MUI Fatwa No. 108/DSN-MUI/X/2016 concerning Guidelines for the Implementation of Tourism Based on Sharia Principles, particularly related to the provisions of sharia hotels on the Karunia Syariah Guest House, Adana Guest House Syariah, and Guest House Syariah Gatsu. The purpose of this research is to find out how the implementation of the DSN-MUI Fatwa No. 108/DSN-MUI/X/2016 as well as obstacles in its implementation on the Karunia Syariah Guest House, Adana Guest House Syariah, and Guest House Syariah Gatsu. This research used qualitative descriptive analysis techniques through a qualitative descriptive approach. The results of this study conclude that: first, Karunia Syariah Guest House, Adana Guest House Syariah, and Guest House Syariah Gatsu have implemented 4 of the 7 sharia hotel provisions in the DSN-MUI Fatwa No. 108/DSN-MUI/X/2016. Second, several obstacles have caused the DSN-MUI fatwa not to be implemented yet, 1) The unavailability of food and beverage services at sharia lodgings. 2) Sharia lodging managers have collaborated with conventional financial institutions in terms of service and the number of guests who use conventional banks in making payments. 3) Sharia lodging managers do not know about the DSN-MUI Fatwa No. 108/DSN-MUI/X/2016. 4) There is no guideline for implementing the fatwa regarding the DSN-MUI Fatwa No. 108/DSN-MUI/X/2016. Abstrak: Penelitian ini membahas mengenai implementasi Fatwa DSN-MUI No. 108/DSN-MUI/X/2016 tentang Pedoman Penyelenggaraan Pariwisata Berdasarkan Prinsip Syariah, khususnya terkait ketentuan hotel syariah pada Adana Guest House Syariah, Guest House Syariah Gatsu, dan Karunia Syariah Guest House. Adapun tujuan dari penelitian ini adalah untuk mengetahui bagaimana pengimplementasian Fatwa DSN-MUI No. 108/DSN-MUI/X/2016 serta kendala dalam pengimplementasiannya pada Adana Guest House Syariah, Guest House Syariah Gatsu, dan Karunia Syariah Guest House. Penelitian ini merupakan penelitian lapangan (field research) dengan menggunakan teknik analisis deskriptif kualitatif melalui pendekatan deskriptif kualitatif. Hasil penelitian ini menyimpulkan bahwa: pertama, Adana Guest House Syariah, Guest House Syariah Gatsu, dan Karunia Syariah Guest House telah mengimplementasikan 4 dari 7 ketentuan hotel syariah pada Fatwa DSN-MUI No. 108/DSN-MUI/X/2016. Kedua, ada beberapa kendala yang menyebabkan fatwa DSN-MUI tersebut belum dapat terimplementasi, 1) Belum tersedianya pelayanan makanan dan minuman pada penginapan syariah. 2) Pengelola penginapan syariah sudah bekerjasama dengan lembaga keuangan konvensional dalam hal pelayanan, serta banyaknya tamu yang menggunakan bank konvensional dalam melakukan pembayaran. 3) Pengelola penginapan syariah belum mengetahui mengenai Fatwa DSN-MUI No. 108/DSN-MUI/X/2016. 4) Belum adanya pedoman implementasi fatwa mengenai Fatwa DSN-MUI No. 108/DSN-MUI/X/2016.

Abstract

Abstract: Conceptually, the existence of religion is actually an alternative for the creation of a reality without violence, especially against women. Islam introduces the concept of preventing violence against women which refers to substantive verses (ushuliyah), as well as a general purpose / basis of sharia (maqashid al-syariah). In the context of married life, there are some basic rules put forward by the Al Quran as a guarantee for the benefit of a wife to avoid physical and psychological violence in relation to fulfilling her rights as a woman. This paper seeks to analyze and find the idea of benefit outlined by sharia in its relevance to efforts to prevent violence in a broad sense as upholding the principles of justice, human rights, and protection of life as the embodiment of maqashid al sharia. In understanding several verses, it is often questioned that the interpretation tends to give priority to men and downplay metaphors. In fact, these verses do not mean to denigrate women, they only refer to social roles and roles based on gender (gender roles), even generally having a history of sabab al-nuzul, so they are very historical. Generally verses like this are intended to support and realize the general purpose (maqashid) of the essential verses (ushul) which are also the central theme of the Quran. Abstrak: Secara konsep, keberadaan agama sesungguhnya menjadi alternatif bagi terciptanya realitas tanpa kekerasan khususnya terhadap perempuan. Islam memperkenalkan konsep pencegahan kekerasan terhadap perempuan yang mengacu pada ayat-ayat subtantif (ushuliyah), sekaligus menjadi tujuan umum/dasar syariah (maqashid al-syariah). Dalam konteks kehidupan berumah tangga terdapat beberapa aturan dasar yang diketengahkan Al Quran sebagai jaminan kemaslahatan bagi seorang istri untuk terhindar dari tindakan kekerasan fisik maupun psikis dalam kaitannya dengan pemenuhan hak-haknya sebagai perempuan. Tulisan ini berupaya menganalisis dan menemukan gagasan kemaslahatan yang digariskan syariat dalam relevansinya dengan upaya pencegahan tindak kekerasan dalam makna yang luas sebagai penegakkan prinsip keadilan, hak asasi, dan perlindungan hidup sebagai perwujudan maqashid al-syariah. Dalam memahami beberapa ayat, sering dipermasalahkan penafsiran yang cenderung memberi keutamaan kepada  laki-laki dan mengecilkan perumpuan. Padahal sesungguhnya ayat-ayat ini tidak bermaksud  merendahkan kaum perempuan, ia hanya merujuk pada fungsi dan peran sosial berdasarkan jenis kelamin (gender roles), bahkan umumnya mempunyai riwayat sabab al-nuzul, jadi sifatnya sangat historis. Umumnya ayat-ayat seperti ini dimaksudkan untuk mendukung dan mewujudkan tujuan umum (maqashid) ayat-ayat esensial (ushul) yang juga menjadi tema sentral Al Quran.

Abstract

Perkembangan cryptocurrency sebagai aset digital dan instrumen ekonomi berbasis teknologi blockchain menimbulkan berbagai persoalan hukum, khususnya dalam perspektif hukum Islam. Kehadirannya memunculkan perdebatan terkait status hukum, unsur gharar, qimar, dharar, serta relevansinya dengan prinsip-prinsip ekonomi syariah. Penelitian ini bertujuan menganalisis Fatwa Majelis Ulama Indonesia (MUI) mengenai hukum cryptocurrency melalui perspektif maq??id al-syar?‘ah dan teori tiga nilai dasar hukum Gustav Radbruch yang meliputi keadilan, kemanfaatan, dan kepastian hukum. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan filosofis dan konseptual melalui studi kepustakaan terhadap bahan hukum primer dan sekunder. Analisis dilakukan secara deskriptif-analitis untuk mengkaji dasar filosofis serta konstruksi argumentasi hukum dalam fatwa MUI. Hasil penelitian menunjukkan bahwa fatwa MUI merepresentasikan pendekatan kehati-hatian (i?tiy??) yang berorientasi pada perlindungan harta (?if? al-m?l) dan kemaslahatan masyarakat. Fatwa tersebut menilai praktik cryptocurrency lebih dominan mengandung unsur mafsadah akibat tingginya spekulasi dan ketidakpastian. Dalam perspektif Gustav Radbruch, fatwa MUI cenderung mengutamakan keadilan protektif dan kemanfaatan preventif dibandingkan kepastian hukum yang absolut. Kebaruan penelitian ini terletak pada integrasi analisis filsafat hukum Islam berbasis maq??id al-syar?‘ah dengan teori hukum Gustav Radbruch dalam mengkaji fatwa cryptocurrency, sehingga menghasilkan perspektif yang lebih komprehensif terhadap dinamika hukum Islam kontemporer dalam merespons perkembangan ekonomi digital.
